ORDINANCE NO. 480
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ANNEXING CERTAIN
LANDS TO BE INCLUDED WITHIN THE BOUNDARIES AND JURISDICTIONAL
LIMITS OF THE CITY OF CHUBBUCK, IDAHO; SPECIFYING THE ZONING
CLASSIFICATION WHICH SHALL BE APPLIED TO SAID LANDS NEWLY
ANNEXED TO THE CITY OF CHUBBUCK; DIRECTING THE CHUBBUCK CITY
CLERK TO COMPLY WITH THE FILING REQUIREMENTS CONTAINED IN
IDAHO CODE SECTION 63-2215; REPEALING PRIOR CONFLICTING
ORDINANCES AND SPECIFICALLY A PORTION OF ORDINANCE NUMBER 476;
PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS
ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME
EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Annexation. Certain lands, located within Bannock County and contiguous to
the .existing boundaries of the City of Chubbuck, Idaho were annexed by Ordinance Number 476
adopted November 11, 1997 however that Ordinance contained an incorrect legal description of
Tracts `B" and "C". By this Ordinance the prior Ordinance Number 476 is repealed with respect
to Tracts `B" and "C" and the following described tracts are hereby annexed and included within
the boundaries and jurisdictional limits of the City of Chubbuck, Idaho:
Hiline Acres Development - Lots 1, 2 and 3 of Hiline Acres Development
according to the Record of Survey thereof on file with the Bannock County
Recorder and which is more particularly described on the attached Exhibit "A".
Ellis School - 11888 N. Whitaker Road as more particularly described on attached
Exhibit "A".
Section 2. Zoning. The above-described lands newly annexed to the City of Chubbuck,
Idaho, shall be subject to the zoning classification of Single Family Residential (R-1).

Boundary Description for Hiline Acres Development
A parcel of land located in the NW'/, of the NW% of Section 2, T6S, R34E, B.M. More precisely
described as: Beginning at the NW corner of Section 2; said point also being the POB; thence
S89°55'36"E for a distance of 1052.39', along the north section line; thence S05°21'59"W for a
distance of 873.70'; thence N89 °54'34"W for a distance of 188.92'; thence N05 °21'59"E for a
distance of 696.36'; thence N89°55'36"W for a distance of 843.00'; thence NO1 '15'38"W for a
distance of 176.57', to the POB.
Boundary Description for Rulon Ellis Elementary School (School District 25 Property)
A parcel of land located in the NW% of the NW%4 of Section 2, T6S, R34E, B.M. More precisely
described as: Beginning at the NW corner of Section 2; thence SOI ° 15'38"E for a distance of
116.57' to the POB; thence S89°55'36"E for a distance of 843.00'; thence S05°21'59"W for a
distance of 696.36'; thence N89°32'36"W for a distance of 762.66' MOL to the centerline of
Whitaker Road; thence N01 '16'05"W for a distance of 688.47' MOL along the centerline of
Whitaker Road, to the POB.

Section 3. Filing. The Chubbuck City Clerk is hereby directed to comply with the filing
requirements contained in Idaho Code Section 63-2215.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City
of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict
with the provisions of this Ordinance and specifically those provisions of Ordinance Number 476
with respect to Tracts `B" and "C" are hereby repealed to the extent of such conflict.
Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by.
any court of competent jurisdiction, such holding shall not affect the validity or enforceability of
any of the remaining provIsions.
Sectior4 3.'.Eflc6e Date. The rule requiring an ordinance to be read on three separate
days, one of which°shall A a reading in full, is hereby dispensed with, and this Ordinance shall
beCorrle effective upod its passage, approval and publication as provided by law.
