HomeMy WebLinkAbout0481 Uniform Codes 1998CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 481 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, REPEALING SECTIONS 15.04.010, 15.04.020, 15.04.040, OF THE CHUBBUCK MUNICIPAL CODE, REVISING THE TITLE OF CHAPTER 15.04 TO "UNIFORM CODES;" REPEALING CHAPTER 15.08, 15.28 AND 8.32 IN THEIR ENTIRETY; ADOPTING A REVISED CHAPTER 15.04 TO ADOPT THE 1997 EDITIONS OF THE UNIFORM BUILDING CODE, UNIFORM FIRE CODE, UNIFORM MECHANICAL CODE, UNIFORM PLUMBING CODE; ADOPTING THE 1996 EDITION OF THE NATIONAL ELECTRIC CODE, ADOPTING APPENDIX B, CHAPTER 13 OF THE UNIFORM MECHANICAL CODE WITH RESPECT TO FUEL GAS PIPING; ADOPTING UNIFORM CODE FOR ABATEMENT OF DANGEROUS BUILDINGS, 1997 EDITION, SETTING FORTH A STANDARD TO DETERMINE WHEN AN EXISTING STRUCTURE MUST BE UPDATED TO THE HANDICAP ACCESSIBILITY CODE; REQUIRING THE BUILDING DEPARTMENT TO BE ADVISED WHEN A HABITABLE STRUCTURE IS DAMAGED; SETTING FORTH THE METHOD BY WHICH VALUE OF CONSTRUCTION IS DETERMINED FOR PURPOSES OF PERMIT ASSESSMENT; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Chapters. Chapter 15.08, 15.28 and 8.32 and Sections 15.04.010, 15.04.020 and 15.04.040 of the Chubbuck Municipal Code are repealed in their entirety and the title to Chapter 15.04 amended to "Uniform Codes." Section 2. The following Section 15.04.010, 15.04.020, and 15.04.040 are adopted: Chapter 15.04 UNIFORM CODES Sections: 15.04.010 Uniform Codes Adopted. 15.04.020 Procedure for adopting future editions. 15.04.030 Amendments. 15.04.040 Copies Available. 15.04.050 Hours of Operation. 15.04.060 Handicapped Accessibility. Ordinance - Page 1 dsc chbbck03.265 15.04.070 Gravel Base. 15.04.080 Notification of Building Department. 15.04.090 Method of Determining Cost of Construction. 15.04.010 Uniform Codes Adopted. These Uniform Codes and Appendixes are adopted: Uniform Building Code Uniform Fire Code Uniform Mechanical Code Uniform Plumbing Code National Electric Code Uniform Code for the Abatement of Dangerous Building - 1997 Edition Chapter 7, division I of the appendix Chapter 11 of the appendix - 1997 Edition - 1997 Edition Appendix B, Chapter - 1997 Edition - 1996 Edition - 1997 Edition 13, "Fuel Gas Piping" Inspection of electrical and plumbing shall continue to be done by the State of Idaho and not by the City Building Department. 15.04.020 Procedure of Adopting Future Editions. Future editions of said Codes may be adopted, as the same are published from time to time, by resolution of the Mayor and Council of the City. Such resolution shall identify and particularity the edition of the code so adopted and shall recite that it is adopted pursuant to this Chapter. Unless specifically stated to the contrary in the text thereof, such resolution shall have the effect of adopting the future edition and any appendices or standards previously adopted by ordinance. 15.04.040 Copies Available. Three copies of any uniform code, any amendment thereto, and the resolutions of the Mayor and Council adopting any amendments shall be maintained on file with the city clerk for use and examination by the public. 15.04.060 Handicapped Accessibility. If an existing structure is being repaired or being remodeled, the structure shall be updated to comply with CABO/ANSI A 117.1-1992 standards (Handicapped Accessibility Code which provisions are incorporated by reference) for any bathroom being remodeled or if 25% or more of the existing structure's value is being spent on the repair or remodel. .15.04.070 Gravel Base Any concrete slab upon which vehicles will park shall have a minimum base of three (3) inches of 3/4" minus gravel; provided, however, if any other code requires a larger base, such code shall control. 15.04.080 Notification of Building Department. The City Fire Department and Police Department shall notify the City Building Department of any damage to any habitable structure within the city. Upon such notification, the Building Department shall make an assessment to the extent of the damage and whether the building may continue to be used with repairs or whether condemnation is required. Ordinance - Page 2 dsc chbbck03.265 • 0 15.04.090 Method of Determining Cost of Construction. For purposes of determining the cost of new and remodeled construction within the city for permit assessment purposes, the Building Department shall utilize the following: A. The value of cost shall be based on the Uniform Building Code (UBC), Building Permit Fee table combined with "Building Valuation Data" from International Conference of Building Officials' (ICBO) "Building Standards" publication; B. Floors other than main floors based on 60% of the main floor valuation data; C. Finished basements shall be based on 35% of valuation date of the main floor; D. Basic permits for residential, non-commercial uses, for mechanical permits for furnaces/water heaters and Building Permits for re -roofing and residing to be based on 65% of the minimum hourly cost taken from UBC schedule. E. Mobile home foundations, double car garages, and single car garages valued at an average cost as determined by the Building Official. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
