HomeMy WebLinkAbout0488 Short Plat Procedure 1998CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 488 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ADDING SECTION 17.12.400, 410, 420 TO ADOPT A SHORT PLAT PROCEDURE; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 17.12 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. The following Sections 17.12.010, 020 and 030 are added to the Chubbuck Municipal Code: VI. SHORT PLAT PROCEDURE Sections: 17.12.400 Short Plat Designation 17.12.410 Planning Conference 17.12.420 Final Plat 17.12.400 Short Plat Designation: When the City Staff, after the Planning Conference referred to in 17.12.020, has determined that the proposed development requires the submission and recording of a plat, due only to 17.04.040(B)(3), the following "short plat" procedure may apply, provided the following conditions are met: A. Proper access is provided to the property; B. The development is consistent with the Comprehensive Plan. C. The City Engineer does not require the full platting process of this title to be followed. 17.12.410 Completion of Planning Conference: The developer shall complete any requirements determined at the planning conference. Ordinance - Page 1 dsc chbbck04.011 17.12.420 Final Plat: After the completion of all planning conference requirements, the developer shall submit a final plat according to Section 17.12.200 through 17.12.330 of this Title. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapter 17.12 not herein amended shall remain in full force and effect. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
