HomeMy WebLinkAbout0507 Major Home Occupations 1999CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 507 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, TO ALLOW TRAINED MASSAGE THERAPISTS AS A HOME OCCUPATION; TO CLARIFY MASSAGE BY AN UNTRAINED PERSON IS NOT ALLOWED; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 18.12 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Section 18.12.030(2)(k) is amended as follows: 2. Major home occupations — The following regulations shall apply to all major home occupations. k. Permitted major home occupations, provided the above regulations are met, shall include but are not necessarily limited to the following: (i) Any use allowed as a minor home occupation; (ii) Single -chair beauty parlors and barber shops; (iii) Photo developing and photo studios; (iv) Organized classes with up to six students at one time; (v) Television and other electrical repairs excluding major appliances such as refrigerators or storage, (vi) Small engine repairs, excluding major automobiles, motorcycles and snowmobiles; (vii) Upholstering; (viii) Dressmaking; and (ix) Woodworking excluding cabinet making; and (x) Trained massage therapists. The uses specified below shall not be permitted as home occupations: (i) Minor or major auto repair, painting of vehicles, trailers or boats, (ii) Funeral chapel or home; (iii) Gift shop; (iv) Medical or dental clinic, (v) Rental businesses; (vi) Medical or dental clinic; (vii) Massage parlors, (viii) Welding or machine shops; and Ordinance - Page 1 dsc chbbck04.301 0 • (ix) Any use which changes or tends to change the character of the neighborhood. in. A trained massage therapist as used above shall meet the following requirements: (i) Successfully complete a course of training at a massage therapy school that is either approved or certified by the State of Idaho. (ii) Have completed a minimum of 300 hours of training in massage therapy. (iii) Have in force at all times an insurance for professional misconduct (commonly known as malpractice insurance) with a minimum liability limit of not less than $100,000. Proof of insurance shall be provided to the CitX upon application for a permitted home occupation and shall be provided at any time by request of the City or when requested by City official. (iv) The certificate of completion of course training shall be displayed in a conspicuous place at the place of business at all times. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapter 18.12 not herein amended shall remain in full force and effect. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
