AN ORDINANCE OF THE CITY OF CHUBBUCK, A MUNICIPAL CORPORATION
OF IDAHO, ENACTING A NEW SECTION 9.08.240 TO CHUBBUCK MUNICIPAL
CODE; PROHIBITING THE POINTING OF ANY LASER OR SIMULATED LASER
DEVISE AT ANOTHER PERSON OR ANIMAL FOR ANY PURPOSE OTHER THAN
IN AN EDUCATION, INSTRUCTIONAL, OR EMPLOYMENT PRESENTATION;
PROVIDING DEFINITIONS; PROVIDING OR THIS ORDINANCE TO BE IN FULL
FORCE AND EFFECT FROM AND AFTER ITS PASSAGE, APPROVAL, AND
PUBLICATION ACCORDING TO LAW, THE RULE REQUIRING THAT AN
ORDINANCE BE READ ON THREE SEPARATE OCCASIONS HAVING BEEN
DISPENSED WITH.
WHEREAS, there has been growing concern nation-wide over the misuse of both laser
pointer devises as well as simulated laser pointer devises; and
WHEREAS, even if the devises are of such low amplication and limited range that their
contact with human or animal bodies will not in itself cause physical harm, inasmuch as the light
projected resembles the light projected by laser sights on certain weapons, it is likely that the sight
of the light projected by the pointers will cause reactions which can be harmful to the public,
causing injury and even death; and
WHEREAS, the City Council has determined that it would be in the interests of public
welfare and safety to educate citizens concerning the dangers of use of the devices outside of an
educational, instructional, or employment presentation and to prohibit any such use;
NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE
CITY OF CHUBBUCK AS FOLLOWS:
Section 1: That a new Section 9.08.240 "Misuse of Laser Pointer Devices" be enacted to
read as follows:

9.08.240 Misuse of Laser Pointer Devices. It shall be unlawful for any person to direct
light emitted from a laser pointer towards another person or animal, or to direct such light in any
manner except at a screen, wall, board, or other similar surface being used as a visual aid in an
education, instructional, or employment presentation. For purposes of this section, the term
"laser pointer" means any device which emits light or projects a beam or point of light amplified
by the stimulated emission of radiation that is visible to the human eye, or any devise which emits
or projects light which simulates the appearance of such light.
Section 2: This Ordinance shall be in full force and effect from and after its passage,
approval, and publication according to law, the rule requiring that an ordinance be read on three
separate occasions having been dispensed with.
