0513 Occupancy Permit 1999CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 513 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION 15.04.030 TO DELETE CERTAIN AMENDMENTS TO THE UNIFORM BUILDING CODE; AMENDING SECTION 15.04.031 TO DEFINE THE OCCUPANCY OF A STRUCTURE FOR WHICH AN OCCUPANCY PERMIT HAS NOT YET BEEN ISSUED TO CONSTITUTE AN INFRACTION SUBJECT TO A PENALTY OF ONE HUNDRED DOLLARS ($100) PER DAY; AMENDING SECTION 15.04.090 REGARDING FEES, PLAN REVIEW FEES AND METHOD OF DETERMINING COST; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 15.04 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SECTION 1. 15.04.030 Amended. Section 15.04.030 of the Chubbuck Municipal Code is amended as follows: 15.04.030 Amendments. Notwithstanding any of the provisions of the 1997 Uniform Building Code, section 3.01(b)0 106.2 of the 1997 Uniform Building Code is amended to allow a one- story detached accessory buildings to have a PFeteeted reef floor area not exceeding two hundred forty square feet. SECTION 2. 15.04.031 Amended. Section 15.040.031 is amended as follows: 15.04.031 Occupancy Permit Amendment. Notwithstanding Section 388 109 of the 499-1- 1997 Uniform Building Code and the same or subject matter related sections of any future editions of the Uniform Building Code, a certificate of occupancy shall be required for all buildings, structures or portions thereof after August 1994, without exception. AW person or entity occupying a building, structure or portions thereof constructed after August, 1997 and for which no occupancy permit has been issued shall be Quilty of an infraction and be subjected to a penalty of One Hundred Dollars ($100)_ Each day of occupancy without a permit shall constitute a separate infraction. SECTION 3. 15.04.090 Amended. Section 15.04.090 is amended as follows: 15.04.090 Fees and Method of Determining Cost of Construction. For purposes of determining the cost of new and remodeled construction within the city for permit assessment purposes, the Building Department shall utilize the following: A. Table 1-A of the 1997 edition of the Uniform Building Code is adopted as the permit fee schedule for building permit fees in the city. Upon adoption by the city of any subsequent building code or edition thereof, the equivalent table in the code adopted shall apviy. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapter 15.04 not herein amended shall remain in full force and effect. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
