ORDINANCE NO. 524
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION
12.04.040 TO REQUIRE A PERMITTEE UNDER CHAPTER 12.04 TO HAVE
GENERAL PUBLIC LIABILITY INSURANCE OF NOT LESS THAN ONE MILLION
DOLLARS ($1,000,000); TO NAME THE CITY AS AN ADDITIONAL INSURED;
REQUIRING NOTICE OF CANCELLATION BE PROVIDED BY THE INSURANCE
COMPANY TO THE CITY; AMENDING SECTION 12.04.060 TO ALLOW THE
PERMIT FEE TO BE SET BY RESOLUTION OF THE CITY COUNCIL.
REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE
SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING
THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 12.04 NOT
HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Section 12.04.040 is amended as follows:
12.04.040 FtHmishirw General Pubic Liability Insurance �. All individuals,
persons, firms, or corporations participating in any project for which a permit is obtained pursuant
to this chapter shall:
A. Have in forceeg, neral public liability insurance coverage in an amount of not less than
One Million Dollars ($1,000,000) per occurrence;
B. Name the City as an additional insured under said policy;
C. Provide notice of cancellation by the insurance company to the City if coverage is
canceled;
D. Furnish to the City at the time of filing the surety or corporation performance bond,
the nature and extent of liability insurance. in fef:ee to preteet ether-. IS
Section 2. Section 12.04.060 is amended as follows:
12.04.060 Permit fee. The City shall charge a permit fee in an amount set from time to
time by resolution of the Chubbuck City Council ef twenty five dellaf s for each permit issued
pursuant to this chapter.

ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City
of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict
with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other
sections and provisions of Chapter 12.04 not herein amended shall remain in full force and effect.
Section 2. Severability. If any provision of this ordinance is held invalid, for any reason,
by any court of competent jurisdiction, such holding shall not affect the validity or enforceability
of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall
become effective upon its passage, approval and publication as provided by law.
