0537 Deannexation - Vista Park Subdivision Lot 2 2001CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 5 3 7 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, DE -ANNEXING CERTAIN LANDS PRESENTLY INCLUDED WITHIN THE BOUNDARIES AND JURISDICTIONAL LMTS OF THE CITY OF CHUBBUCK, IDAHO AND WHICH SHOULD HAVE BEEN INCLUDED IN ORDINANCE NUMBER 483; DIRECTING THE CHUBBUCK CITY CLERK TO COMPLY WITH THE FILING REQUIREMENTS CONTAINED IN IDAHO CODE SECTION 63-2215; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Purpose. Ordinance Number 483, recorded as Instrument No. 98008746 in the records of Bannock County, de -annexed certain lands that were the subject of a boundary line dispute between Gary H. Carlsen and Harold Scalf when Vista Park subdivision was surveyed. The land described on Exhibit "A' should have been included in Ordinance No. 483, but was inadvertently omitted. Section 2. De -annexation. The following described lands, located within Bannock County and included in the boundaries of the City of Chubbuck, Idaho, are hereby de -annexed and excluded from the boundaries and jurisdictional limits of the City of Chubbuck, Idaho: See Attached Exhibit "A." Section 3. Compliance. The Chubbuck City Clerk is hereby directed to comply with the filing requirements contained in Idaho Code Section 63-2215. "I, RON C. CONLIN, DULY APPOINTED CITY CLERKFOR THE CITY OF CHUBBUCK, IDAHO, HEREBY CERTIFY THAT THE FOREGOING DOCUMENT IS A TRUE AND CORRECT COPY OF THE ORIGINAL MAINTAINED IN MY CUSTODY IN THE OFFICIAL RECORDS OF THECITY OF CHUBBUCK". Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
