Holmes, City Attorney SUMMARY OF ORDINANCE 140. _ - Paye 1 bil chubbuck01.104 CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 5 41 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTIONS 17.12.170, 17.12.180 AND 17.12.190 TO UPDATE PLATTING REQUIREMENTS FOR LAND DEVELOPMENT; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 17.12 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Intent. A review by staff of the platting procedures of the City indicates some Sections that need updating, which recommendations this ordinance implements. Section 2. Amendments. Sections 17.12.170, 17.12.180 and 17.12.190 are amended as follows: 17.12.170 Existing conditions data. A. Topography by contours related to USGS survey datum, or other datum approved by the city engineer, shown on the same map as the proposed development layout. Contour interval shall be such as to adequately reflect the character and drainage of the land; B. Location of existing_ adjacent water wells, streams, canals, irrigation laterals, private ditches, washes, lakes, or other water features; direction of flow; location and extent of areas subject to inundation whether such inundation be frequent, periodic, or occasional; C. Location, widths, and names of all platted streets, railroads, utility rights-of-way of public record, public areas, permanent structures including water wells, and municipal corporation lines within or adjacent to the subject land; D. Name and recording numbers of any recorded plats having common boundaries with the subject land; E. By note, the existing land use (zoning) classification of the subject land; F. By note, the acreage of the subject land; G. Dimensions of the boundaries of the subject land. 17.12.180 Proposed conditions data. A. Street layout, including location, width and proposed names of streets,as ell -as cl-053vvalks mid easements-, together with connections to streets on adjoining lands where appropriate; B. Typical lot dimensions (scaled), dimensions of all corner lots and lots of curvilinear sections of streets, each lot numbered individually, and total number of lots; Ordinance - Page 1 blj chubbuck01.165 C. Location, width, and use of easements; D. Designation of land to be dedicated or reserved for public use, with use indicated; E. Contemplated use of remaining land; and if plat includes land for which a combination of land uses is proposed, such areas shall be clearly designated. 17.12.190 Proposed utility methods. A. Sewage Disposal. By note, state the proposed method of sewage disposal. Ordinance - Page 2 blj chubbuck01.165 ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapter 17.12 not herein amended shall remain in full force and effect. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
