Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, W. Dean Wood, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor John O. Cotant. APPROVAL OF MINUTES - Mayor John O. Cotant asked for corrections or additions to regular meeting minutes of July 26, 1994, and special meeting minutes of August 2, 1994. Councilman Wood moved to approve regular meeting minutes of July 26, 1994 as read. Councilman Gunter seconded. All council members voted in favor of motion. Councilman Quick moved to approve special meeting minutes of August 2, 1994 as read. Councilman Wood seconded. All council members voted in favor of motion. APPEAL OF LAND USE AND DEVELOPMENT COMMiSSiON DECISION - Jim Thilmont applied for a conditional use permit to operate a car lot at 4613 Yellowstone Ave. Land Use and Development Commission approved, but did not address dust abatement in parking area. PWD Smart stated the dust abatement requirement was not addressed in the Land use and Development Commission approval. Mr. Thilmont stated he will be agreeable to applying a dust abatement, so long as it is not too expensive. Councilman England moved to amend the Land Use & Development Commission's findings, and recommendations to include applying dust abatement chemical to areas not paved, or landscaped. Councilman Wood seconded. All council member~ voted in favor of motion. ORDINANCE #419 Amending Section i8.i2..020(D) of the Chubbuck Municipal Code to provide bay windows may extend into the front yard setback up to two feet. Mayor Cotant read Ordinance #419 by title for the third and final reading. 175 ORDINANCE #419 (cont,) Councilman Wood moved to adopt Ordinance #419 as read. Councilman England seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Gunter, yes. ORDINANCE #420- A proposal by the City of Chubbuck amending Section 18.20.030 to decrease the minimum area required for a Planned Unit Development; adding Section 18.20.075 to define how density is calculated in PUD. Mayor Cotant read Ordinance #42~ by title for the third and final reading. Councilman Gunter moved to adopt Ordinance #420 as read. Councilman Quick seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Gunter, yes. ORDINANCE #421 - An ordinance enacting a new Section 9.08.210, prohibiting the exhibition or drawing or pointing of a replica of a firearm in a threatening manner, Mayor Cotant read Ordinance #42i by title only for the third and final reading. Councilman Quick moved to adopt Ordinance #421 as read. Councilman Wood seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Gunter, yes. ORDINANCE - An ordinance enacting Chapter 9.32, "Public Disturbance Noises";" defining penalties for violations. Attorney Holmes read Public Disturbance Noises Ordinance in full for the first reading. After discussion, Council decided to table the ordinance until the August 23, 1994 Council Meeting. ORDINANCE - Amending Section 15.04.031 to the Code to amend the Uniform Building Code Permits for all structures. After discussion, Council decided to table the ordinance until the August 23, 1994 Council Meeting. 177 BUSINESS LICENSE APPLICATION - Ray Tolman, 5040 Dorian stated the intend of the two business license applicants is to help residents become more aware of what health care they have. The representatives of idaho Network would like to go door to door in the City, for the purpose of making people aware of Health Reform. Attorney Holmes stated as long the Idaho Citizens Network is Just providing information, they would not be required to have a business license, but, if they solicit funds they are required to have a ilcense. Councilman England moved to approve a business license to Derick Bernick, Idaho Citizens Network should they decide they will solicit funds for the Idaho Citizens Network. Councilman Quick seconded. All council members voted in favor of motion. 1994-95 FISCAL YEAR TENTATIVE BUDGET City Clerk Ron Coniin presented Mayor Cotant and Council the 1994-95 Fiscal Year Tentative budget. City Clerk Conlin presented the following Tentative Budget: Police Department Fire Department Parks & Recreation General and Adm. Highway, Streets & Roads 051,942. 385,357. 170,564. 223,450. 5a9,546. 2,420,859. Sanitation Fund Waterworks Fund Sewer Fund 551,438. 2,095,150. 932,304. Central Garage $ 3,578,892. $ 65,003. Total Ail Funds $ 6,689,554. 1994-95 FISCAL YEAR TENTATIVE BUDGET -(cont.) Mayor Cotant stated the primary reason for increase in the General Fund is, creating of our own Police, Fire and Public Works Dispatch. Bannock County is doubling the fee for dispatching. The fee can raise every year after~ which Police Chief Jerry Rowland feels they will raise every year. Ray Tolman, 5040 Dorian stated, he felt the City of Ch~abbuck should become self sufficient in dispatching. Mr. Toiman stated he is in favor of the property tax increase going to creating our own dispatch. Randy Broadhead, 785 Callie stated he is in favor of the increase to go for the City of Chubbuck creating own dispatching. Dee Stalder, 910 W. Chubbuck Rd. expressed concern about increased taxes. City Clerk Conlin stated the General Fund and Highway, Streets, and Roads proposed Tentative Budget increase will add $301,849. to property taxes collected in 1994-95 Budget. This will raise a property owners $50,000. home with home owners exemption approx. $80. annually. Mayor Cotant explained how the City is not receiving HS&R Funds needed to keep up with maintaining City Streets. FWD Smart gave a report on the following projects: Hawthorne/Chubbuck Rd Signal Hiline/Chubbuck Rd Signal 1-86 Landscaping Siphon/Hawthorne Project Vacuum Street Sweeper - $45,000. - $58,500. - $30,000. - $21,000. Mr. Broadhead suggested the projects be spaced o]]t over several years, rather than all at once. PWD Smart stated City participation on these projects is 20% while State/Federal participation is 80%. If City does not participate at once, the City might lose the participation of State/Federal monies. FWD Smart stated City has to provide all costs on the engineering on the projects up front. Mayor Cotant stated most of the problem, is unfunded mandates that come from the Federal and State Governments. Hopefully there will be some relief in the future. Mayor Cotant stated, City is looking at automated sanitation pick-up in the future. Discussion about composting. 1994-95 FISCAL YEAR TENTATIVE BUDGET - (cont.) 181 Discussion about drilling the three test wells in the City. PWD Smart suggested adding to well financing line item, another $16,000, making the Water Works Tentative Budget $2,095,150. Councilman England moved to approve the 1994-95 Fiscal Year Tentative Budget as presented, adding the $16,000. to the Tentative Waterworks Budget, setting the publlc hearing for adoption of the 1994-95, "Annual Appropriation Ordinance" on August 23, 1994 at 7:30 p.m., at Chubbuck City Council Chambers. Councilman Wood seconded. All council members voted in favor of motion. QUARTERLY REPORT for June 30, 1994 presented to Mayor Cotant and Council.
