Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, W. Dean Wood, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 6:05 p.m. by Mayor Cotant. PURPOSE OF SPECIAL MEETING was to discuss Proposed Ordinance - Idaho Power Franchise Agreement. PROPOSED ORDINANCE - An ordinance in accordance with Idaho Code 50 -328, 50 -329 and 50- 329(a), granting a franchise to Idaho Power Co., a corporation, and to its successors and assigns, to construct, maintain and operate in and upon the present and future streets, highways and other public places within the corporate limits of the City of Chubbuck. Scott McDonald and Dan Olmstead were present at the meeting. Dan Olmstead, Idaho Power Co., P.O. Box 1000, Pocatello, Idaho was present to outline the procedural requirements for adopting the Idaho Power franchise ordinance. Mr. Olmstead went through Section 1 through 21, one section at a time. The proposed franchise agreement shows a term of 35 years. Mr. Olmstead explained the 35 year term was just put in, Council can change to their discretion, most cities are going 20 to 25 years. City of Carey went with a 10 year agreement. City of Pocatello has a 20 year agreement. Discussion about who pays for relocation of poles, too close to street, etc. Mr. Olmstead stated Idaho Power will compensate the City I % of the company's "gross revenues" on a quarterly basis. The City shall have the right during the term of the agreement to increase the I% franchise fee up to 3 %, by obtaining approval of a majority of voters of the City voting. City of Chubbuck will provide Idaho Power with a map of all properties within City Limits. 161 PROPOSED ORDINANCE - IDAHO POWER FRANCHISE AGREEMENT - (cont.) The following is a summary of the guidelines that need to be followed: City will introduce the franchise ordinance at the September 22, 1998 Council Meeting. City will publish the proposed ordinance before adoption. (15`. publication). City will adopt the proposed ordinance not less than 30 days after it is introduced. Idaho Power accepts the proposed franchise ordinance. City publishes the adopted franchise ordinance within one month after it was passed. (2 "d. reading). Council will discuss the length of proposed franchise agreement. At 7:15 p.m., Councilman Quick moved, Councilman England seconded, with full council approval to adjourn meeting. �;n6xvl Ron C.
