HomeMy WebLinkAbout03 14 1970 CM 101 Minutes of the recessed meeting of March 10, 1970, of the Mayor and Council of the City of Chubbuck, held in the City Office on ~[arch l~, 1970. Present - Cotant, Leslie, Romriell and Thompson. Absent - Taylor, excused, out of town. Called to order 10:20 A.M. Purpose - Resolve problem of Hensley's pay. Conversation as follows: Hensley stated that he came here as a gentleman and that he has never tried to cause any trouble, but one month has gone by and he has not received his pension as yet, because his final pay has not been recorded at the Retirement Syste~ Office. He wrote a letter to Cotant expressing his feelings, and others have read this letter and he should not be put off any longer. He is entitled to what others have had. He will compromise as he does not want to litigate. He is asking for a policy that has been set, as others have received sick leave and he feels he should be entitled to the same. Thompson - In all of my experience we never had sick leave unless we were really sick.~1 ScM~ol District is getting very strict about sick leave. Pupils need an excuse to mis~ school and teachers must be sick or they are released from their jobs. McDevitt told ~ us we were out of line in paying sick leave when the individual was not really sick. We may have a claim against the people who have received it or against the people who paid it. Hensley - He wanted to take his sick leave this oast year but Taylor asked Hensley not to leave the city in a bind by taking his vacation ~nd sick leave. Council did not know this had happened. Leslie - It appears that the City and Mayor only has authority granted to them by the Idaho Code. Hensley - Was under doctor's care during 1969 and he needed his sick leave but was asked to stay and work by Taylor. Leslie - never heard of taking time off from work and getting paid for sick leave. Cotant - there has nmver been an authorization to pay sick lea.ve by an Ordinance. Thompson - after letter from McDevitt was read, said McDevitt may be out of place by taking attitude he did because he was totally ignorant of anything in the past that was wrong, as was Thompson himself. Hensley - He has been here for almost 18 years and he does not want to be cut down. Thompson - There have been no sneak meetings that he was aware of. Bank does not pay sick leave unless they are sick. ~omriell - ~e are trying to go the extra mile ~ith Hensley and trying to be f~ir with him. Leslie - Do we have anything to pay? Cotant - Only way we can pay it is by Court order. Thompson - ~s it possible to pay it when he was asked to work when he was sick? We need legal council to pay this. Leslie - What is the accurate answer? Hensley - Wa~s his pension. Cotant - We need to pay his vacation so he c~n get his pension. Hensley - Does not need vacation pay to add fuel to fire by suing the city. He has money. Vacation time - Companies give i week vacation for the first five years, 2 weeks vacation for from 5 to l0 years, J weeks vacaticn for from l0 to l~ years, and 2 weeks vacation.. after 15 years. Leslie - If sick leave is illegal would you still want us to pay it? Motion then made by Thompson that according to time and record as it shows Hensley should be paid ~ weeks vacation. Motion seconded by Leslie. All in favor. Mayor and Council were not aware that Hensley's pension was not being paid, Hensley - He should not have been asked to pay for his long distance calls made on the police phone as most of those calls were made by his wife and she should be allowed that for answering the phone for the city all these years that they have lived there. He feels this was a service rendered the city. Council feels that they were repaid for that service by living in the apartment rent free all these years. H~nsley - Who notifies about the pension?
