la4,5-c" \ CHUBBUCK IDAHD all:] I 14TIT111 A ALV Memo Public Works Department Planning Services 290 E. Linden, Chubbuck, ID 83202 208.237.2430 — 208.239.3252 www.CityofChubbuck.us To: Honorable Mayor and Chubbuck City Council From: Don Matson, Planning Services Manager Date: September 2, 2026 Re: An application for the annexation of 25.17 acres, located approximately 1,900 feet south of Siphon Rd, approximately 100 feet west of Cole St, north of the Church Lateral Canal, and approximately 970 feet east of Philbin Rd in Bannock County, ID. The application will be reviewed against criteria in section 18.28.060.G of city code. (Action Item) SUMMARY DESCRIPTION. The City has received an application for annexation of approximately 25.17 acres, located on the north side of the Church Lateral Canal as described above; the boundary of the subject area is approximately 1,900 feet south of Siphon Rd, approximately 100 feet west of Cole St, north of the Church Lateral Canal, and approximately 970 feet east of Philbin Rd. Fifty percent of the perimeter (2 sides) borders the City boundary. FINDINGS. After reviewing the application, staff finds that it meets the description and requirements for an Annexation with Consent. • It is contiguous to the City boundary and within the Urban Service Boundary. • Utilities are available at the boundary of the property. • The owner has consented to (applied for) the annexation. • The Land Use and Development Commission has recommended a zoning district for the subject property (approval of the zoning district is a separate item on this agenda). o The recommended zoning district is Limited Residential (R-2). o See companion item regarding zoning. • The property is included in the Comprehensive Plan Future Land Use Map and is within the Urban Services Boundary. PZ 26-019 Annexation RECOMMENDATION: Staff recommends approval of annexation of the property and accompanying ordinance, with the conditions that the annexation is not in effect until approved by the State of Idaho and a record of survey or plat is recognized by Bannock County to define the property boundaries. FACTS BACKGROUND: The subject property is level ground that has been irrigated farmland for many years. It is in the Bannock County Agricultural zone. To the north lies approximately 75 acres of farm land — this acreage and the subject property formed 2 parcels that were under the same ownership. The Church Lateral canal flows along its southern border. Four single-family home subdivisions lie on the southern border, and one lies to the east — all five subdivisions are in the city limits. Agricultural parcels and homes with acreage lie to the west, along Philbin Road. TYPE OF APPLICATION: Legislative (Subject to request for reconsideration; decision should be based on the standards for approval). The Council may approve, table a decision, or deny the application. In accordance with City Code 18.28.060 and the current resolution, a complete petition and fees for Annexation were filed with the City and which contained the appropriate documents. 2. In accordance with City Code 18.28.010, the application is scheduled to be considered at a Regular Meeting of the City Council. 3. In accordance with Idaho Statute §50-222 and City Code 18.28.010, notices of the public meeting were posted prominently at the City offices and on the City website at least 5 days prior to the meeting. 4. Prior to the review, the Land Use and Development Commission reviewed an associated application requesting an initial zoning designation and the recommendation was forwarded to the Council for review and consideration. STANDARDS FOR APPROVING ANNEXATIONS Per City Code Title 18.28.060.G, annexations may be approved by the City Council if affirmative written findings of fact are made on each of the following standards: 1940f-'\ CHUBBUCK 1 0 A A 0 290 E Linden Avenue, Chubbuck, ID 83202 Phone 208.237.2430 www.CityofChubbuck.us Standard. a. The land is contiguous or adjacent to the City boundary. The land is contiguous to the City boundary — 50% of the perimeter. b. All portions of highways, streets, or roadways lying wholly or partially within an area to be annexed shall be included within the area requested for annexation unless expressly agreed between the city and the county, N/A. c The annexation meets the requirements for its Annexation Classification under Idaho Code. The area proposed for annexation meets the standards for an Annexation with Consent; the landowner has applied for the annexation. 1940f-'\ CHUBBUCK 1 0 A A 0 290 E Linden Avenue, Chubbuck, ID 83202 Phone 208.237.2430 www.CityofChubbuck.us PZ 26-019 Annexation d. Annexation of the land is in the best interest of the City. Suggested considerations to evaluate for this criteria include: 1 Revenue generated by property taxes will exceed long-term costs associated with maintenance and provision of services and facilities. Elsewhere in the City, development in the R-2 zone does generate property taxes to meet long-term costs. 2 The advantages both to the City and to the area outweigh the disadvantages. There are no disadvantages to the City as a whole, including undue burden on city utilities. 3 If previously developed, the area has the opportunity to redevelop or to develop at higher intensity. N/A. 4 If expenses required to bring the properties to city standards exceed anticipated property tax income, the residents and/or Council agree to form a local improvement district. N/A. 5 Annexation is equitable and fair to existing residents; and Yes, it provides development that is similar to surrounding parcels. 6 Annexation would address a public health concern. N/A. E The land can be served currently, or within a reasonable time, by essential urban services. Utilities are available at the property border; it can be served currently. F A zoning district will be assigned via ordinance at the same time, or immediately following, the annexation approval. The Land Use and Development Commission has recommended a zoning district for the Council to act upon. RECOMMENDATION The Council must determine if it is in the best interest of the City of Chubbuck whether to annex the parcel(s) into the City. The proposal satisfies the 6 standards to consider for annexation (above) and is in compliance with the Comprehensive Plan (see Attachment Q. Staff recommends approval of annexation of the property and accompanying ordinance, with the following conditions: The annexation is not in effect until approved by the State of Idaho, and Bannock County has accepted a plat or record of survey defining the property boundary. 1940f_'\ CHUBBUCK 1 0 A A 0 290 E Linden Avenue, Chubbuck, ID 83202 Phone 208.237.2430 www.CityofChubbuck.us PZ 26-019 Annexation ATTACHMENTS A. ANNEXATION NARRATIVE The annexation of Homestead Ventures, LLC property located South of Siphon Road, East of Philbin Road, and West of Cole Street is in the City's interest and benefit. Annexing these properties would be expanding the City limits in a practical and sustainable way since the property is adjacent to the current City of Chubbuck limits with available public street and utilities. The annexation is proposed to be zoned as R2 which complies with the City Comprehensive Plan land use designation of Medium Density Residential. The proposed annexation would provide a positive change for the existing residential area by reducing dust generated by farming operations. The proposed annexation shares a southern and eastern boundary with the City of Chubbuck limits, making it a natural extension of the City. Public utilities can be easily accessed for the proposed annexation at the ends of Sheba Street and Homestead Street. The accessibility of the utilities allows the property to connect seamlessly into the City's utility systems. The future residential developments in the annexation area will be configured similarly to the existing adjacent subdivisions. The annexation will benefit the City by creating additional housing options and by providing additional tax base. It is anticipated that the tax base will offset the expense increase caused by additional City operations. Traffic access to the future development is available via existing public roadways such as Cole Street (Minor Arterial), Sheba Street (Local), Homestead Street (Collector/Minor Arterial), Siphon Road (Major Arterial) and Chubbuck Road (Major Arterial). These access points provide multiple points of ingress and egress to the subdivision and would provide adequate traffic access for the annexation area. The City Comprehensive Plan designates Homestead Street as a Minor Arterial but shows on the GIS portal to transition to a Collector west of Cole Street. While Homestead Street east of Cole Street may have a functional classification of a Minor Arterial, its current 66 -foot right-of-way dedication, streets section and driveway accesses limit its functional classification to that of a Collector. The City Comprehensive Plan also makes consideration for a proposed Collector roadway running north and south providing a future connection to Siphon Road. An anticipated layout for the future residential development will propose matching adjacent right-of-way widths for both Sheba Street and Homestead Street.
