The subject property comprises approximately .4 acres and is located at 111 W Briscoe Rd, Chubbuck, ID. The application will be reviewed against criteria in section 18.28.020.C.5 of City Code. Type of Action: Decision. BACKGROUND: A hearing was held on this item on July 14. The Commission requested a change to the site plan and offered other recommendations to the applicant before tabling the item. This small parcel is difficult to develop as land has been or will be dedicated to widen W Briscoe Rd and Yellowstone Ave. The strict application of various standards for access management, landscaping, etc. led to adjustments through the Design Review process. For example, the sidewalk along Belva Ln will be in an easement on the property and the entrance will be closer to Briscoe Rd than would normally be allowed. The west side of the property borders Belva Ln, which was built and dedicated in other plats at 25' wide. Current standards are a 50' right-of-way that include curb, gutter, and sidewalk. Per staff evaluation it was not effective to request a 50' right-of-way for this short section. RECOMMENDATION: City staff have analyzed project facts, the Standards for Approving a CUP, the Conditions for Approval, and find that it meets the standards established by the City for a CUP. Further, the project property and location warrant consideration for adjustments to various standards City staff recommend approval of the Findings of Fact and Conclusions of Law, including the following conditions: Work with City staff to identify potential improvements and adjustment for the approach designs, etc. to be closer to City standards. Revise landscaping plan per final site and improvement plans; approval of landscaping plan required before receiving building permit. Follow all conditions of the Design Review Clearance, except as may be altered by the Commission 4. The Commission may identify other mitigation measures. The changes and exceptions are as follows: 1. The radius at the corner of Belva and Briscoe has been adjusted to a 25' radius. 2. Because the radius on the corner of Belva and Briscoe is held at a 25' radius, a 30' radius on the street side of the sidewalk cannot be achieved. a. In accordance with the Access Management Guidelines, we request an exception. The intersection of Belva Ln and Briscoe Rd is currently controlled by a yield sign. A potential solution is we suggest changing that sign to a stop sign. This would ensure traffic would be traveling slow and stopping near the intersection and that a 30' high speed approach radius would not be necessary. 3. Per Access Management Guidelines a 50' throat length is required. Given the current layout and size of the lot that is not possible to be achieved, we request an exception to that guideline. Summaries of goals, objectives, and policies may not be verbatim. RELEVANT POLI2045:CIES FROMCOMPREHENSIVE CHAPTER 3: HEALTHY CONNECTIONS A COMMUNITY WITH EASY ACCESS TO HEALTHY OPPORTUNITIES AND SERVICES OBJECTIVE 3.1: CONTINUE TO MAINTAIN AND IMPROVE CITY'S TRANSPORTATION SYSTEMS INCLUDING ALTERNATE MODES OF TRANSPORTATION. STRATEGY 3.1.b Consistently evaluate traffic impacts of new development to ensure that there are adequate roadways. The proposal, for 9 small residential units, may generate 9 to 10 trips in the peak hour. COMMENT This would have minimal impacts on Yellowstone Avenue or Briscoe Rd. Although Belva Ln is only 25' wide, the project and design will likely result in minimal impacts as well. STRATEGY 3.1.d Support and coordinate with PRT to ensure stops and routes are consistent with land use designations. COMMENT PRT bus stops are nearby on Yellowstone Ave, but there are no sidewalks as of yet. They are planned with the ITD widening project. STRATEGY 3.1. f Require development and redevelopment projects construct the necessary sized transportation infrastructure and dedicate appropriate rights-of-way and easements as indicated in this plan. COMMENT The project is also submitting a plat that will require construction of curb, gutter, and sidewalk. OBJECTIVE 3.2: PROVIDE SAFE CONNECTIONS THROUGH WELL MAINTAINED SIDEWALKS AND ACCESSIBLE PATHWAYS. STRATEGY 3.2.e Provide sidewalks along both sides of all public streets. COMMENT The project is required to install sidewalks on Belva Ln and W Briscoe Rd. HEALTHY CONNECTION POLICIES POLICY 3P.4 Require the consideration of transit access in subdivision review. POLICY 3P.5 Require the inclusion of bicycle and pedestrian systems during subdivision review and development to support alternative modes of transportation. POLICY 3P.7 Continue to implement standards for sidewalks to be constructed at the time of subdivision development. COMMENT The project is within walking distance (via future sidewalk) to a transit stop on Yellowstone. Project will include sidewalks on Belva Ln and W Briscoe Rd. POLICY 3P.8 Design local streets serving residential areas as "skinny" streets to slow traffic and accommodate all modes of travel. COMMENT Belva Ln will continue as a "skinny" street with 25' width for travel lanes. Exhibit 4B I Page 1 CUP I Project No. PZ 26-013 FROM • ir 14 CHAPTER 4: LIVABLE SPACES ENVIRONMENT THAT ESTABLISHES A UNIQUE IDENTITY FOR CHUBBUCK OBJECTIVE 4.1: ENCOURAGE A VARIETY OF LAND USES THROUGHOUT THE COMMUNITY TO PROVIDE ACCESS TO EMPLOYMENT CENTERS AND COMMERCIAL AND PROFESSIONAL SERVICES. STRATEGY 4.1.i To discourage sprawl and promote compact development patterns, all new development projects shall be located within City limits and the USB. The project is in the City limits and the USB, it is also a compact infill development. LIVABLE SPACE POLICIES POLICY 4P.2 Direct urban growth to urban infill areas. The project location and size denote infill status. POLICY 4P.4 Encourage a transition of land use from low -intensity land uses (i. e., residential, quasi -public park) to higher intensity land uses (i. e., commercial, and industrial) and taller structures. Purposefully arranged land use transitions avoid conflicting uses while keeping distances between uses short enough to facilitate communications, transportation, and human activity between them. The proposal is a small medium density residential development, which is well-defined as a buffer use between single family development and a highway or more intense development. 4P.5 For infill of underutilized and isolated properties, implement innovative approaches for the provision of access and utilities. Several considerations have been approved to adjust standards and find compromise on the site design. 4P.9 New infill and redevelopment housing shall be designed so thatgarages and carports are set back farther from the street than the front of the dwelling, and usable front porches or balconies are provided and oriented toward the street. The proposed project is a tight fit and the units are very small. No porches or balconies will be provided. 4P. 12 Strongly encourage infill and redevelopment to be pedestrian oriented. 4P. 17 Encourage higher densities and site designs that support access to transit. 4P. 19 Permit increased residential densities in targeted areas for infill and redevelopment. This site can be considered infill. Sidewalks are planned for Belva Ln, W Briscoe and E Briscoe, and Yellowstone Ave, with access to PRT stops. 4P. 13 All new development shall be provided with adequate public facilities and services, including water, sewer, roads, fire protection, EMS, police protection, and access to parks and schools. All services are provided to the project site. 4P.20 Use development standards, buffers, architecture, site planning and Design Reviews to create a high level of compatibility between adjacent uses while striving to achieve a complementary mix of possible uses and protect property values and investments within neighborhoods and communities. The project was reviewed by the Design Review Committee and approved only after several modifications were made to the submittal. Exhibit 4B I Page 2 CUP I Project No. PZ 26-013 11511 • • / • CHAPTER 6: ENVIRONMENTAL QUALITY 7NATURAL NVIRONMENT THAT REFLECTS THE COMMUNITY'S DESIRE FOR CLEAN WATER AND OPEN SPACE OBJECTIVE 6.1: PROTECT SURFACE AND GROUNDWATER SUPPLY TO SERVE CURRENT AND FUTURE GENERATIONS. STRATEGY 6.1.b Evaluate impacts of new development on water quality and ensure that any negative impacts to stormwater from potential on-site pollutants, are minimized. Stormwater will be retained on site. STRATEGY 6.1.c Require use ofirrigation water instead of groundwater for non -potable wateruses where feasible. 7.2.d Require lighting plans to address safety, while not amplifying light pollution. The property is eligible for surface water irrigation via the Fort Hall Irrigation Project. ENVIRONMENTAL QUALITY POLICIES: COMMUNITY SERVICES AND SAFETY POLICIES: 6P.3 Require paving of parking lots to reduce fugitive dust (PM10). 7P.3 Direct urban growth to urban infill areas. Parking lot will be paved. The project location and size denote infill status. 6P.9 Assure that new development manages stormwater retention to minimize runoff and prevent flooding downstream. 7P.9 To promote compact development patterns, all new development shall be located within City limits and the USB, and be provided with adequate public services, including water, sewer, roads, fire and police protection, EMS, and access to parks and schools. Stormwater will be retained on site. CHAPTER 7: SERVICES AND SAFETY A SAFE AND HEALTHY CITY FOR ALL 9 OBJECTIVE 7.1: PROACTIVELY PROVIDE UPGRADES TO WATER AND SEWER INFRASTRUCTURE AND SEEK SUSTAINABLE SOLUTIONS FOR SANITATION DEMANDS TO KEEP UP WITH GROWTH. ..1.c Require use of irrigation water instead of groundwater in all places available. The property is eligible for surface water irrigation via the Fort Hall Irrigation Project. OBJECTIVE 7.2: ENSURE THAT A VARIETY OF LAW ENFORCEMENT AND EMERGENCY SERVICES ARE AVAILABLE TO SUPPORT ALL MEMBERS OF THE COMMUNITY. 7.2.d Require lighting plans to address safety, while not amplifying light pollution. Lighting for the site will be mounted on the buildings and facing downward. COMMUNITY SERVICES AND SAFETY POLICIES: 7P.3 Direct urban growth to urban infill areas. The project location and size denote infill status. 7P.9 To promote compact development patterns, all new development shall be located within City limits and the USB, and be provided with adequate public services, including water, sewer, roads, fire and police protection, EMS, and access to parks and schools. This project meets these requirements. SELLING BROKERAGE COMPENSATION PAID BY SELLER AND/OR LISTING BROKERAGE: 329 ❑ SELLER agrees to pay Selling Brokerage compensation of ❑ an amount equal to % of the final sales price OR ❑ other: 330 SELLER'S payment obligation may be satisfied by Selling Brokerage receiving compensation from Listing Brokerage, from SELLER, or any 331 combination of the two. The parties' agreement as stated in this subsection is expressly and primarily for the benefit of the Selling Brokerage, a 332 third party, who shall have direct enforcement rights to collect the specified payment pursuant to Idaho Code 29-102 and other relevant laws. 333 334 0 Selling Brokerage compensation does not need to be addressed in this agreement. 335 336 A Selling Brokerage's entitlement to compensation is conditioned upon Selling Brokerage procuring a buyer ready, willing and able to purchase, transfer 337 or exchange the PROPERTY. Real estate broker compensation is not set by law and is fully negotiable. Selling Brokerage's compensation shall be paid 338 at closing unless otherwise designated by Selling Broker in writing. The closing company identified in this agreement is hereby authorized to pay the 339 above-mentioned compensation at closing. BUYER acknowledges that any agreement by SELLER to pay compensation to Selling Brokerage may not 340 completely satisfy BUYER's contractual obligation to Selling Brokerage; BUYER's obligation will remain unless separately changed in a document signed 341 by Selling Brokerage. All parties acknowledge that Selling Brokerage may accept compensation from SELLER and/or BUYER so long as the total 342 compensation received does not exceed that which is agreed to in writing with BUYER. 343 344 30. DEFAULT: If BUYER defaults in the performance of this Agreement, SELLER has the option of: (1) accepting the Earnest Money as liquidated 345 damages or (2) pursuing any other lawful right or remedy to which SELLER may be entitled. If SELLER elects to proceed under (1), SELLER shall make 346 demand upon the holder of the Earnest Money, upon which demand said holder shall pay from the Earnest Money the costs incurred by SELLER's Broker 347 on behalf of SELLER and BUYER related to the transaction, including, without limitation, the costs of title insurance, escrow fees, credit report fees, 348 inspection fees and attorney's fees; and said holder shall pay any balance of the Earnest Money, one-half to SELLER and one-half to SELLER's Broker, 349 provided that the amount to be paid to SELLER's Broker shall not exceed the Broker's agreed -to commission. SELLER and BUYER specifically 350 acknowledge and agree that if SELLER elects to accept the Earnest Money as liquidated damages, such shall be SELLER's sole and exclusive remedy, and 351 such shall not be considered a penalty or forfeiture. However, in the event the parties mutually agree in writing that any Earnest Money shall become non - 352 refundable, said agreement shall not be considered an election of remedies by SELLER and the non-refundable Earnest Money shall not constitute 353 liquidated damages; nor shall it act as a waiver of other remedies, all of which shall be available to SELLER; it may however be used to offset SELLER'S 354 damages. If SELLER elects to proceed under (2), the holder of the Earnest Money shall be entitled to pay the costs incurred by SELLER's Broker on behalf 355 of SELLER and BUYER related to the transaction, including, without limitation, the costs of brokerage fee, title insurance, escrow fees, credit report fees, 356 inspection fees and attorney's fees, with any balance of the Earnest Money to be held pending resolution of the matter. If SELLER defaults, having 357 approved said sale and fails to consummate the same as herein agreed, BUYER's Earnest Money deposit, including but not limited to any Earnest Money 358 that has become non-refundable, shall be returned to BUYER and SELLER shall pay for the costs of title insurance, escrow fees, credit report fees, 359 inspection fees, brokerage fees and attorney's fees, if any. Design Review Conditions - Page 1 PZ# 26-008 — Belva & Briscoe Design Review Conditions of Approval SPECIFIC CONDITIONS Fire / EMS Findings - The proposed Briscoe & Belva development is a Group R-2 multi -family occupancy, which is subject to the hydrant location and spacing requirements of IFC §507. Fire hydrants must be located such that the maximum distance from any point on the exterior of the building to a hydrant, measured along an approved fire apparatus access route, does not exceed: 0 300 feet for non-sprinklered buildings, or 0 400 feet for sprinklered buildings. For multi -family occupancies, hydrant spacing along fire apparatus access roads shall not exceed 300 feet. Based on preliminary site layout and access configuration, hydrant distribution may not adequately serve all sides of the building for fire attack and apparatus positioning without an additional hydrant. Conditions for Approval - Prior to construction plan approval, the applicant shall verify and demonstrate compliance with IFC §507.5.1 and §507.5.1.2 by providing fire hydrants such that: 1. The maximum travel distance from any point on the exterior of the Briscoe & Belva building to a fire hydrant does not exceed 300 feet for a non-sprinklered building or 400 feet for a sprinklered building, measured along an approved fire apparatus access route; and 2. Fire hydrant spacing along fire apparatus access roads serving the development does not exceed 300 feet; and 3. If compliance cannot be demonstrated with existing hydrants, an additional fire hydrant shall be installed at a location approved by the Fire Code Official to improve fire department operations and apparatus access. 4. Demonstrate compliance on construction plans. Traffic Study Standards Findings- The traffic impact statement needs to be updated to meet the city's requirements. See the BTPO Traffic Impact Analysis Guidelines. See note in Appendix A for the trip generation numbers to be used. Condition for Approval - 5. Submit updated traffic impact statement meeting the city's requirements, to be reviewed and accepted prior to receiving building permit. Street / Approach / Access Management Findings- Approach on Belva must be a commercial style approach with 30' radius curb returns and pedestrian ramps in accordance with the city's access policy. Size and geometry of approach must meet the city's access policy. The approach on Belva is closer to the Briscoe intersection than allowed by the city's policy. However, if requested, and appropriate conditions are agreed to, the city may allow the placement of the approach as shown. Condition for Approval - 6. Applicant must request deviation from city's access policy and work with city to include appropriate conditions in the development agreement. a. Send letter with request and reasons/background to staff at permits@cityofchubbuck.us. Staff will retain information for evidence of deviation. Stormwater Management Findings- Stormwater must be retained on site and the plans appear to show that will take place. Condition for Approval - 8. Submit a detailed drainage and grading plans and a stormwater report in accordance with the PVSDM for review and approval. Water / Sewer Standards Findings -Private water and sewer services will be installed. Due to the single access point, the fire department will require an on-site fire hydrant near the east end of the parking lot. This parcel has surface irrigation water rights through Fort Hall Irrigation and city code requires this development to utilize that secondary irrigation water for irrigation. Conditions for Approval - 9. Include the proposed water and sewer services and fire hydrant for review with Construction plans. 10. All onsite water and sewer lines will be considered private and must be maintained by the property owner. This will be addressed in the development agreement. 11. Include a plan and design for a private irrigation system to utilize Fort Hall Irrigation; show on construction plans. Right-of-way Findings - The comprehensive plan shows Briscoe Road as a collector. ITD is currently designing the Yellowstone Widening Project along the property frontage. With the majority of development along Belva Lane being complete, the city will not require any additional ROW to be dedicated for Belva Lane. Conditions for Approval - 12. Dedicate additional ROW on Briscoe Rd for a total of 33' from centerline — include in plat. 13. Verify the Yellowstone ROW with ITD; include verification with plat application. Curb, Gutter, Sidewalks / ADA Findings - Pavement widening, curb and gutter, sidewalks, and pedestrian ramps are required on all three street frontages. The planned ITD project includes curb, gutter, and sidewalk on Yellowstone. Conditions for Approval 14. Include all required frontage improvements on the plans for review. 15. Applicant may request postponement of Yellowstone improvements if ITD will be completing those improvements. Provide copy of verification from ITD. Zoning Code Standards Findings- Property is in the General Commercial (C-2) zone; the use is conditionally permitted Condition for Approval - 20. A Conditional Use Permit from the Land Use and Development Commission is required for residential development. CUP application must address conditions of this memo. Lighting Standards Condition for Approval 21. Clarify on building permit application where lights will be placed on buildings, fixture types, etc. Light must not trespass off site nor shine upwards into night sky. Parking / Accessible Parking Findings- Parking stalls meet requirements for 180 ft2 minimum as shown. 10 residential units require 20 parking spaces, it appears only 19 are provided, 1 space is van accessible as required per ADA Condition for Approval - 22. Adjust parking area for 20 spaces on construction plans/site design. Landscaping Findings- A 10' wide landscape strip is required along all street frontages outside the ROW/on the property side. Any fencing must be located behind the landscape strip. Internal landscape beds must also be provided adjacent to parking area and equal at least 5% of the paved areas. Conditions for Approval - 23. Provide the final landscape plan for approval, prior to or with building permit application with the following: a. Landscaping and any fencing will need to account for all sight triangles b. Any fencing must be behind required landscaping c. All landscaped areas, and other non -built areas, must also have a ground cover of mulch, river rock, living materials, etc. 24. Trees shrubs and groundcover requirements to be included with final landscaping plan: a. Street frontages require 1 tree/50 linear feet and 1 shrub/5 linear feet: - Yellowstone frontage approx. 100 linear feet; 2 trees and 20 shrubs required - Briscoe frontage approx. 150 linear feet; 3 trees and 30 shrubs required - Belva frontage approx. 76 net linear feet; 2 trees and 16 shrubs required b. Internal landscape beds are required adjacent to parking: - Minimum 343 square feet of internal landscape beds (5% of paved area) - Landscape beds must be at least 50 square feet, no less than 5 feet per side - 2 trees are required in the internal landscaping bed(s) Design Review Conditions - Page 4 PZ# 26-008 — Belva & Briscoe Design Review Conditions of Approval Addressing / Display The existing address is 111 W Briscoe Rd. Design Review Conditions - Page 5 dr Outlook Belva and Briscoe Exemptions From Joshua Redge <joshua.redge@sunrise-eng.com> Date Mon 3/30/2026 8:11 AM To permits <permits@cityofchubbuck.us>; Don Matson <dmatson@cityofchubbuck.us> Cc jonathan vincent <gatecitybuilders@yahoo.com> D 1 attachment (2 MB) DESIGN REVIEW - SITE PLAN 2.pdf; Don and whoever else it may concern, Attached is a revised site plan for the project Belva and Briscoe per a design review received on March 18, 2026. Don, per our conversation last week, below are a list of items we wish for an exemption on for the attached project: 1. Per the design review, in "Fire / EMS" a fire hydrant must be located and equal to the spacing of 300' for non-sprinklered buildings and 400' for sprinklered buildings. In the section "Water/ Sewer Standards" It states that due to single access point, the fire department would require a hydrant to be placed at the east end of the property. I have checked hydrant radii in the area. They hydrant located on Belva Ln south of the proposed development meets the 300' maximum requirement for fire hydrants. Clarification on the code and what would be enforced through the city would be appreciated. 2. Per the design review, in "Street / Approach / Access Management" a commercial style approach with 30' radius curb returns is required. We request to use the approach in the attached site plan per the city's approval. Given the size of the lot, and the setback and landscape requirements there is not enough room to adequately have a commercial style approach with 30' radius curb returns. 3. Per the design review, in "Curb, Gutter, Sidewalks / ADA" , we request not being required to construct sidewalk and curb and gutter along Belva Ln. There is not enough right-of-way along Belva Ln to install curb, gutter, and sidewalk as well as no current existing curb, gutter, or sidewalk to tie into. We do agree however and will construct curb, gutter, sidewalk, and pedestrian ramps along Briscoe per city code and will coordinate with ITD for the improvements on Yellowstone. 4. Per the design review, in "Parking / Accessible Parking" because of the 10 units, 2 parking spots are required per unit totaling 20 spaces. The proposed buildings for this development are 1 - bedroom townhomes. Per city code 18.34.070 "Parking Standards" we are requesting a reduction based on unit -on -unit size containing one bedroom only. The reduction we are requesting is based on the table in section 18.34.070. We are requesting 1.75 required spaces per unit which would total 17.5 total spaces, 18 rounded up. 5. Per the design review, in "Landscaping" it is required that internal landscape beds equal to 5% of the paved area be put into the parking lot. We are asking for an exemption on this based on the acreage size of the lot to start, 0.4 acres, and the 10' landscape buffer with tree and shrubbery already being planted on the lot that internal landscape beds not be required. If you have any questions, please reach out and I look forward to your response. Design Review Appeal Consideration - Page 1 PZ# 26-008 — Belva & Briscoe Consideration of Appeal on Conditions of Approval Based on preliminary site layout and access configuration, hydrant distribution may not adequately serve all sides of the building for fire attack and apparatus positioning without an additional hydrant. Conditions for Approval - Prior to construction plan approval, the applicant shall verify and demonstrate compliance with IFC §507.5.7 and §507.5.7.2 by providing fire hydrants such that: 1. Appeal Statement — Per the design review, in "Fire / EMS" a fire hydrant must be located and equal to the spacing of 300' for non-sprinklered buildings and 400' for sprinklered buildings. In the section "Water / Sewer Standards" It states that due to single access point, the fire department would require a hydrant to be placed at the east end of the property. I have checked hydrant radii in the area. They hydrant located on Belva Ln south of the proposed development meets the 300' maximum requirement for fire hydrants. Clarification on the code and what would be enforced through the city would be appreciated. Committee Final Decision — The Fire Department reviewed Sunrise Engineering's exemption requests for the Belva & Briscoe project, specifically as they relate to Fire/EMS items. Regarding fire hydrant placement, the requirement for a hydrant at the east end of the parking area remains. While Appendix C of the 2018 International Fire Code (IFC) establishes maximum hydrant spacing distances, spacing alone does not eliminate the Fire Code Official's authority to require additional hydrants based on site configuration and operational needs (IFC §507.5.1; Appendix C, Table C102.1). Given the single point of access and limited apparatus positioning within the site, the additional hydrant is necessary to ensure adequate fire department access and water supply during emergency operations, consistent with IFC §503.1 and §503.1.1. Waiving the remaining requirements identified in the request is not supported. These items are standard code and development requirements and have already been reasonably adjusted to account for the constrained right-of-way along Belva Lane. Further reductions to accommodate site yield would be inappropriate. If the applicant wishes to pursue relief, the appropriate path would be a formal waiver request to City Council. Design Review Appeal Consideration - Page 2 PZ# 26-008 — Belva & Briscoe Consideration of Appeal on Conditions of Approval COMMERCIAL APPROACH REQUIREMENT Street / Approach / Access Management — from Conditions of Approval Memo Findings- Approach on Belva must be a commercial style approach with 30' radius curb returns and pedestrian ramps in accordance with the city's access policy. Appeal Statement — Per the design review, in "Street / Approach / Access Management" a commercial style approach with 30' radius curb returns is required. We request to use the approach in the attached site plan per the city's approval. Given the size of the lot, and the setback and landscape requirements there is not enough room to adequately have a commercial style approach with 30' radius curb returns. Committee Final Decision — The Committee disagrees with the request to waive the requirement. As stated in the Conditions for Approval, the Committee may consider a deviation for the location of the approach with the appropriate request (see Condition #6 above) but does not approve a deviation from the required type and configuration of the approach. All of the listed requirements are standard requirements listed in City code, and are not meant to be waived to allow more dense development on any particular site. Nevertheless, an appeal to the City Council is allowed. BELVA ROAD IMPROVEMENTS Curb, Gutter, Sidewalks / ADA — from Conditions of Approval Memo Findings - Pavement widening, curb and gutter, sidewalks, and pedestrian ramps are required on all three street frontages. The planned ITD project includes curb, gutter, and sidewalk on Yellowstone. Conditions for Approval 74. Include all required frontage improvements on the plans for review. 75. Applicant may request postponement of Yellowstone improvements if ITD will be completing those improvements. Provide copy of verification from ITD. Appeal Statement — Per the design review, "Curb, Gutter, Sidewalks / ADA" , we request not being required to construct sidewalk and curb and gutter along Belva Ln. There is not enough right-of-way Design Review Appeal Consideration - Page 3 PZ# 26-008 — Belva & Briscoe Consideration of Appeal on Conditions of Approval along Belva Ln to install curb, gutter, and sidewalk as well as no current existing curb, gutter, or sidewalk to tie into. We do agree however and will construct curb, gutter, sidewalk, and pedestrian ramps along Briscoe per city code and will coordinate with ITD for the improvements on Yellowstone. Committee Final Decision — The Committee disagrees with the request to not construct the required curb, gutter and sidewalk along Belva. The Committee has already reduced the standard requirements listed in City code to account for the narrow Belva Right -of -Way (ROW). All of the listed requirements are standards in City code, and are not meant to be waived to allow more dense development on any particular site. Additional ROW can be dedicated on Belva to allow for the sidewalk, or it can be placed in an easement within the required setback from the street. As with other Conditions of Approval, an appeal to the City Council is allowed. PARKING REQUIREMENTS Parking / Accessible Parking — from Conditions of Approval Memo Findings- Parking stalls meet requirements for 780 ft' minimum as shown. 70 residential units require 20 parking spaces, it appears only 79 are provided, 7 space is van accessible as required per ADA Condition for Approval - 22. Adjust parking area for 20 spaces on construction plans/site design. Appeal Statement — Per the design review, in "Parking /Accessible Parking" because of the 10 units, 2 parking spots are required per unit totaling 20 spaces. The proposed buildings for this development are 1 - bedroom townhomes. Per city code 18.34.070 "Parking Standards" we are requesting a reduction based on unit -on -unit size containing one bedroom only. The reduction we are requesting is based on the table in section 18.34.070. We are requesting 1.75 required spaces per unit which would total 17.5 total spaces, 18 rounded up Committee Final Decision — The appeal statement above is based on City code Section 18.34.070 - this Chapter applies only to the Harvest Springs Creative Community zone (CC -HS). The site is in the General Commercial C-2 zone must follow requirements in Chapter 18.08.046, 2 parking spaces per residential unit. The Committee cannot support a reduction in spaces because there is no adjacent on -street parking to accommodate any overflow. And note, the parking for the neighboring daycare business is on private property. Design Review Appeal Consideration - Page 4 PZ# 26-008 — Belva & Briscoe Consideration of Appeal on Conditions of Approval LANDSCAPING REQUIREMENTS Landscaping — from Conditions of Approval Memo Findings- A 10' wide landscape strip is required along all street frontages outside the ROW/on the property side. Any fencing must be located behind the landscape strip. Internal landscape beds must also be provided adjacent to parking area and equal at least 5% of the paved areas. Conditions for Approval - 24. Trees shrubs and groundcover requirements to be included with final landscaping plan: a. Street frontages require 1 tree/50 linear feet and 1 shrub/5 linear feet: Yellowstone frontage approx. 100 linear feet; 2 trees and 20 shrubs required Briscoe frontage approx. 150 linear feet; 3 trees and 30 shrubs required Belva frontage approx. 76 net linear feet; 2 trees and 16 shrubs required b. Internal landscape beds are required adjacent to parking: Minimum 343 square feet of internal landscape beds (5% of paved area) Landscape beds must be at least 50 square feet, no less than 5 feet per side 2 trees are required in the internal landscaping bed(s) Appeal Statement — Per the design review, in "Landscaping" it is required that internal landscape beds equal to 5% of the paved area be put into the parking lot [Condition 24.b]. We are asking for an exemption on this based on the acreage size of the lot to start, 0.4 acres, and the 10' landscape buffer with tree and shrubbery already being planted on the lot that internal landscape beds not be required. Committee Final Decision — The Design Review Committee has authority to grant an adjustment of landscaping standards for the project (Title 18.14.030) but not a waiver of requirements. For the landscaping plan consider a final landscaping plan that includes a request to reduce the landscape bed area for the parking area (see illustration on following page). To accommodate the necessary sidewalk and landscaping along Belva, consider placing the sidewalk in an easement through the street -side landscaping, and request an accompanying 5' reduction in the Belva side landscaping strip. Further, because of the potential stormwater basin in the landscaping strip on the north side of the property, consider requesting an adjustment to reduce shrub requirements along Briscoe Road. The street itself isn't up to the standards. There aren't appropriate traffic signs the road itself is not even wide enough for two vehicles to pass by each other without having to make big maneuvers. The numbers provided on the sign posted to call also do not work. On Wed, Jun 24, 2026 at 6:47 AM Dallin Caudle <caudledallin@gmail.com> wrote: I just saw the sign on Briscoe Road Regarding the land use, I live down there on 252 and I think it's actually appalling that they want to put nine townhomes right there when there's absolutely no access or visibility on the entire street. It'll become a major hazard to children. There's no sidewalks throughout the whole Street or even onto Yellowstone it's going to be a major traffic issue and a development of more townhomes in such a small space is alarming to say the least. It's just a quick money grab leaving residence with more traffic less visibility when the road is in dire condition. I would love to know where everyone's going to park. There's literally a townhome right across the street. That's full of people that's parking on the street already and a daycare that has nowhere to park. Have you actually gone by and actually looked at that lot? The City is Liable for the lack of traffic signs, a narrow roadway I even address this with the mayor! It will also disrupt the visibility going onto Yellowstone. CAUTION: This email originated from outside the organization.
