ANALYSIS AND RECOMMENDATIONS ADVANCING THE COMPREHENSIVE PLAN: Here are the strategies and policies from the Comprehensive Plan that appear most relevant to this application (Standards for Approval, Policy 5, below). See also Exhibit 3B. 1. Strategy 4.1.i: To discourage sprawl and promote compact development patterns, all new development projects shall be located within City limits and the USB. a. The property is within the Urban Service Boundary with similar density zoning as neighboring developments; it is not sprawl. 2. Policy 4P.10: Per the descriptions in Table 3 FLUM Designations, only the identified zones shall be allowed in the corresponding plan districts as shown on the FLUM. The PUD and Creative Community (CC) zones may be located in any area of the City. a. The R-2 zone implements the Residential -Medium Density designation on the FLUM. 3. Policy 4P.13: All new development shall be provided with adequate public facilities and services, including water, sewer, roads, fire protection, EMS, police protection, and access to parks and schools. a. All city services are available to the site. 4. Policy 4P.16 Protect prime farmland from premature development and discourage smaller -lot subdivisions which may place undue burdens on the County and the City. a. The subject property is considered "Prime Farmland (if irrigated)" by the USDA. However, it is not premature for development as it is adjacent to the city on two sides and all services are available. SPOT ZONING: As described in the Idaho Supreme Court ruling regarding Evans v. Teton County "a claim of 'spot zoning' is essentially an argument the change in zoning is not in accord with the comprehensive plan. There are two types of 'spot zoning.' Type one spot zoning may simply refer to a rezoning of property for a use prohibited by the original zoning classification. The test for whether such a zone reclassification is valid is whether the zone change is in accord with the comprehensive plan. Type two spot zoning refers to a zone change that Project No. PZ 26-018 1 Page 4 N 290 E Linden, Chubbuck, ID 83202 CHUBBUCK Phone 208.237.2430 1 www.CityofChubbuck.us 1 0 A H 0 singles out a parcel of land for use inconsistent with the permitted use in the rest of the zoning district for the benefit of an individual property owner." The proposal does not meet either of the definitions of spot zoning. The proposal: 1. Complies with the Comprehensive Plan. The R-2 zone implements Medium Density development as designated on the Future Land Use Map. 2. Does not single out a parcel for development inconsistent with allowed uses in the zone to benefit an individual property owner. The purpose of the R-2 zone is to "provide for neighborhoods of single household dwellings, class I production buildings, and abutting zero lot line residences." (Title 18.08.10.C.). The proposed zone, and proposed use of the property, do not meet the definition of type two. STANDARDS REVIEW: The Commission must determine if it is in the best interest of the City of Chubbuck and adjacent landowners to recommend a Title Change to the Land Use (zoning) Map. See additional standards for approving a zone change in EXHIBIT 2B and additional relevant Comprehensive Plan policies in EXHIBIT 3B. Project No. PZ 26-018 1 Page 5 CHUBBUCK Phone 208.23290 E Linden, Chubbuck, ID 83202 7.2430 1 www.CityofChubbuck.us 10AH0 STANDARDS• -MLAL: CIZLLODE SECTION POLICY 1 The proposed map amendment would be in the community's best interest. RESPONSE Subject property is similar to infill; properties to the east and south are completely developed and water, sewer, and irrigation mains are at the edge of the property. Extension of services to the property will not be necessary. POLICY 2 The list of uses permitted by the land use ordinance would blend with surrounding land uses and the uses permitted in the proposed zoning district would be harmonious in terms of their scale, mass, coverage, density, and intensity with adjacent land uses. RESPONSE The requested zone, R-2, is the some zone as over half of properties to the south. To the east and part of the southern boundary the neighboring properties are in the R-7 zone. There are a few differences between the 2 zones. POLICY 3 The subject site is suitable for the type and intensity of land uses permitted under the proposed zoning district. RESPONSE The land is suitable for the uses permitted in R-2. POLICY 4 The subject site would be adequately served by transportation routes, police, fire and EMS protection, water/sewer, schools, and other public facilities and services, or agencies, to serve the public health, safety, and general welfare under the proposed zoning district RESPONSE All streets, public services, public and private utilities, and other agency services are already serving the area. POLICY S The proposed map amendment is generally not in conflict with the goals, objectives, and policies of the adopted Comprehensive Plan. LUDC and Council shall have discretion in interpreting exact boundary locations of the future land use map designations when considering map amendment requests. RESPONSE The proposal furthers the goals, objectives, and policies of the Comprehensive Plan. More information can be found in EXHIBIT 3B. INITIAL ZONING NARRATIVE 1. How do you believe that the proposed zoning is in the community's best interest? The proposed zoning is in the community's best interest because it aligns with the city's comprehensive plan and goal of providing additional housing options by utilizing a current agricultural property to create new residential units in an area already surrounded by development, thus minimizing the need for new City infrastructure. Zoning the property as R-2 would help to provide the community with more housing opportunities as well as generate additional tax revenue for the City to invest in essential services such as schools, roads, and parks which would benefit the community in multiple ways. 2. How do you believe the list of uses permitted by Chubbuck Municipal Code section 18.08.040 for the requested zone blend with surrounding land uses? The list of uses permitted under Chubbuck Municipal Code Section 18.08.040 for the requested R-2 zone for the subject properties blends well with the surrounding land uses by supporting a practical and complementary expansion of the residential area. Single household dwellings are permitted in the proposed R-2 zoning and would align naturally with the existing residential subdivision to the South and East. This land use would provide a continual residential character while allowing growth in housing options. The proximity of the proposed development to Cole Steet would offer residents convenient access to major thoroughfares including Siphon Road and Chubbuck Road, enhancing the overall livability and connectivity of the community. 3. How are the uses permitted in the proposed zone harmonious in terms of scale, mass, coverage, density, and intensity with adjacent land uses? The proposed R-2 zoning is harmonious with adjacent land uses in terms of scale, mass, coverage, density, and intensity, ensuring a balanced fit with the surrounding area. In R-2 zoning, permitted uses like single-family homes would match the scale and mass of the existing residential subdivision to the south and east. The street widths are proposed to be similar to the existing streets to the East. Thus, maintaining a congruent neighborhood profile with comparable lot and house characteristics. KNUDSEN 444 Hospital Way, Suite 527 Pocatello, Idaho 83201 knudsen-eng.com ENGINEERING 4. To your knowledge, is there anything that would prevent the site under the proposed zoning from being served by transportation routes, police, fire, EMS protection, water/sewer, schools, and other public agencies or facilities? There is not anything preventing the subject properties from being served by essential services under the proposed R-2 zoning. Transportation routes are readily available. Access is provided via Cole Street, Homestead Street, Siphon Road, and Chubbuck Road. Police, Fire, and EMS protection can be provided by these accesses. Water and sewer services are accessible from Homestead Street and Sheba Road, which tie into the City's established utility systems. Schools, Churches, Parks, and other public facilities are within close proximity to the proposed development. Local districts and city agencies can support the area's needs. The proximity of the property to current infrastructure ensures these services can be provided without significant issues. 5. How do you believe the proposed zoning supported by the Chubbuck Comprehensive Plan? Please cite specific goals, objectives, and policies, including the future land use map, which relate to your proposal. The current land use designation from the City of Chubbuck Comprehensive Plan for the subject properties is Medium Density Residential. The requested R-2 zoning complies with the Comprehensive Plan land use map. The R-2 zoning supports Goal 2, "Improve residential neighborhoods and ensure their orderly and financially sound development," and Objective 2.1, "Improve the appearance of residential areas." It extends the existing residential subdivision northward and westward, fostering an orderly development that enhances the neighborhood's completeness. This zoning complies with the City of Chubbuck Comprehensive Plan and ensures consistent and coherent development. Public Hearing Fwlrfor hubb Calc Chu66urt .297.24; r i.'-<] Posted on 8/6/26 Outlook Formal Opposition to Proposed R2 Rezone, Homestead and Sheba Area From Emma theander <emmajtheander@gmail.com> Date Wed 8/5/2026 8:05 PM To Don Matson <dmatson@cityofchubbuck.us> Mr. Matson and Members of the Chubbuck Planning and Zoning Commission: I am writing to formally oppose the proposed R2 rezone of the property west of my residence at 867 Wendy Street, Chubbuck ID 83202. Please enter this letter into the official record for this application, confirm receipt in writing, and provide me written notice of every hearing, continuance, staff report, and revised submittal associated with this file. My family and my neighbors will absorb the direct consequences of this decision. We are not asking the city to stop growing. We are asking the Commission to hold this applicant to the standards Chubbuck has already adopted, and to decline to approve a density increase while deferring every problem it creates onto the people who already live here. 1. The street network cannot carry this. As proposed, every trip generated by the new density is funneled onto two streets, Homestead and Sheba. Two access points for a project of this size is not a circulation plan, it is a bottleneck. This is a life safety issue before it is a convenience issue. A single blocked intersection, a stalled truck, or a winter road event isolates hundreds of homes from fire and EMS response. Before this application advances, the city should require the applicant to produce a professionally prepared traffic impact study covering trip generation at full buildout, level of service at the Homestead and Sheba intersections, and a viable third point of access. If the applicant cannot provide additional access, the density does not belong on this parcel. 2. The proposal degrades streets that currently function as neighborhood space. Homestead and Sheba are low volume residential streets. Children ride bikes on them, families walk on them, and residents exercise on them because traffic volumes today make that reasonable. The proposed zoning converts them into the sole arterial outlet for a substantially larger population. I am asking that any approval be conditioned on a pedestrian safety analysis, continuous sidewalk connectivity, marked crossings, traffic calming, and a formal review of school walking routes with Pocatello/Chubbuck School District 25. 3. The construction period will run for years and the city has proposed no protections for existing residents. Buildout of this scale means contractor traffic, heavy equipment, material deliveries, and construction parking routed through the same two access points for the foreseeable future. That burden falls entirely on existing homeowners. If this moves forward, I request that approval be conditioned on designated haul routes that do not run through Homestead and Sheba, restricted construction hours, dust and debris control, a pre and post construction pavement condition survey, and a bond or surety making the developer financially responsible for damage to existing streets rather than the taxpayers who live on them. 4. Compatibility and impact on existing property. Placing higher density directly against established single family lots with no transitional buffer is a design failure, not an inevitability. If the city or the applicant possesses evidence that this rezone will not adversely affect the value and enjoyment of adjacent properties, I ask that it be placed in the record so it can be examined. Absent that evidence, the burden belongs to the applicant. A workable alternative exists: maintain R1 density along the boundary with existing homes and step density inward, which is standard practice and which the applicant has not shown to be infeasible. 5. Service capacity has not been demonstrated. Idaho Code section 67-6511 requires that particular consideration be given to the effects of a proposed zone change on the delivery of services by political subdivisions, including school districts. I request that the record include written capacity analyses from the city water and sewer departments, the police and fire departments, and School District 25, addressing this parcel at full R2 buildout rather than at present conditions. 6. Comprehensive plan consistency. Under Idaho Code section 67-6511, zoning districts must be in accordance with the policies of the adopted comprehensive plan, and the governing board is obligated to analyze proposed changes to ensure they do not conflict with it. I ask staff to identify in writing the specific comprehensive plan policies relied upon to support this rezone, and to address the policies that speak to compatibility with established neighborhoods, connectivity, and adequate public facilities. Relief requested First, deny the R2 request as submitted. Second, in the alternative, continue this matter until a traffic impact study, service capacity letters, and a third point of access are part of the record. Third, if this ground is to develop, approve it as R1 with the transitional and infrastructure conditions described above. Finally, if the Commission or Council approves this application, I request the written decision and reasoned statement required by Idaho Code section 67-6535, specifically identifying the criteria and standards considered relevant, the contested facts relied upon, and the rationale for the decision, including how the access limitation and service capacity concerns raised in this letter were resolved. am an affected person under Idaho Code section 67-6521 and I am preserving these issues for the record and for any further review. We would much rather work with the city on a plan that respects the neighborhood than litigate one that does not. Outlook Proposed R2 zoning (Homestead St) From Jason Sutherland <j.sutherland_1972@yahoo.com> Date Wed 8/5/2026 4:56 PM To dmatson@cityofchubbuck.us <dmatson@cityofchubbuck.us> Don My family and I are responding to the proposal for R2 zoning West of my residence. I am opposed to the plan for R2 zoning. Reasons for our opposition. 1. Fully expect the zoning standard to decrease the value of our home and the homes around us. 2. The proposed zoning land locks all incoming and outgoing traffic to (2) streets. Homestead and Sheba. These (2) quiet streets will go from quiet residential to major traffic congestion. 3. All building contractors, personnel and their equipment for years to come will inundate our street and lives. Only (2) access points!!! 4. The increase in traffic will negatively impact the lives of the families and their children who ride bikes, take walks and exercise on what is now low traffic, quiet streets. 5. R2 zoning allows for the building of lower income homes which could lead to unsavory residents migrating to what is now a wonderful neighborhood. I understand the need for growth. Our neighborhood is one of the best areas in Chubbuck to live. If you value our community which I am sure you do please consider my concerns. Looking to the future if there is no way around the growth I would prefer R1 zoning so we can keep our neighborhood clean and safe for all. Outlook RE: Notice of Opposition to Proposed R2 Zoning From Melissa <melissa@epochera.com> Date Wed 8/5/2026 7:41 PM To dmatson@cityofchubbuck.us <dmatson@cityofchubbuck.us> Dear Board Members, I am writing as a resident to formally voice my strong opposition to the proposed R2 zoning of the farm field to the west of our home. While I recognize the need for thoughtful development, transitioning this property to R2 zoning introduces a level of density that is incompatible with the existing surrounding area. I urge the Commission to reject this proposal based on the following concerns: Increased Traffic Volume and Pedestrian Safety: The surrounding street network is quiet and family friendly. R2 zoning permits multi -family dwellings and two -unit residential developments, significantly increasing the daily vehicle trips on quiet residential streets, sidewalk coverage, or traffic -calming measures for high traffic volume. This will negatively impact the safety of our families and children, who are bike riders, runners and daily walkers on our low traffic, quiet streets. Neighborhood Character and Architectural Consistency: The surrounding area is defined by single family homes with quiet lifestyles. Introducing R2 density compromises the established character of the neighborhood, reduces privacy for adjacent properties due to taller structures and smaller setbacks. In addition, this will decrease the value of the surrounding homes. Approval of this rezoning sets an unsound precedent for spot zoning and piecemeal development in our community. I respectfully request that the Planning and Zoning Commission protect the integrity, and safety of our established neighborhood by voting NO on this R2 rezoning application. Thank you for your time, consideration, and service to our community. Sincerely, Melissa Huish CAUTION: This email originated from outside the organization.
