DEVELOPER shall provide a materials testing report acceptable to the City, prepared by a Certified Testing Laboratory or Professional Engineer, said report shall include copies of compaction test results and other applicable documentation as specified by CHUBBUCK. 4. On all public maintained improvements, the DEVELOPER shall provide a letter of certification from the suppliers of the materials utilized on the project, including piping and accessories, concrete, pre -cast concrete items, gravel, hot asphalt plant mix, and etc., stating that all materials supplied by them, meets or exceeds the standards set by the City, said letters shall list the types of materials supplied and, if applicable, the class and brand name. 5. DEVELOPER further agrees to submit the required technical data to the National Floodplain Insurance Program in accordance with NFIP regulations to facilitate a LOMR for changes that have been, or will be, made to the existing floodplain in this phase. 3. CHUBBUCK understands the desire to not put resources into protecting the road bank of Harvest Springs Blvd. located within the flood zone given the plans to adjust that area in future phases. if that protection is not done with the current phase of construction, DEVELOPER agrees that repairs to that road bank would be covered by the DEVELOPER as part of the 3 -year warranty 4. DEVELOPER agrees that the cluster mailbox units serving the PROJECT, will be owned, operated, and maintained by the DEVELOPER and/or the Individual Lot Owners. 5. DEVELOPER agrees to develop the public park In accordance with City Code 18.34.090, the dedicated park (Lot 1, Block 1) will require landscape plans designed or approved by either a landscape architect or Idaho State Master Gardener. Cost of park improvements will be credited Reflection Ridge at Harvest Springs Division 1 - Dev Agree Page 2 of 5 22111540 against park impact fees of this development (City Code 17.28). Requirements for the submittal of drawings, specifications, and construction cost of said park improvements are listed below: a. Detailed plans of the irrigation/sprinkler system to serve entire park area so it connects to the potable waterline and with the ability to be reconnected to the secondary irrigation system at a future date. Installation will be required during construction of subdivision and must meet "Park Construction Minimum Requirements" and "Park Master Development Plan". b. Provide applicable details to show irrigation system features, landscaping and planting specifications/requirements, transitions between different types of surface treatments, fencing components, and other information necessary to provide a complete review of the park plan. c. The park plan needs to provide enough information so the city can determine how the storm pond area will be maintained at the proposed slopes of 2:1. It is believed landscaping in the pond will be very difficult to maintain. The City would prefer reducing the slope along the storm pond. 9. Whereas the DEVELOPER proposed to build public parks and spaces, if building permits are desired to be issued prior to public park acceptance by CHUBBUCK, parks impact fees shall be paid as required by Ordinance 791; once qualifying parks are accepted by CHUBBUCK which meet the requirements of the same ordinance, the DEVELOPER may submit receipts for qualifying costs for public park system improvements and upon receipt, the CHUBBUCK Impact Fee Administrator shall reimburse monies or issue credits back to the DEVELOPER in accordance with Ordinance 791, if due.
