COUNCIL MEETING MINUTES
May 14', 2002
Minutes of a regular meeting held at the Chubbuck City Council Chambers, May 14`'', 2002.
Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin
C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven
M. Smart and City Clerk Ron C. Conlin.
PLEDGE ALLEGIANCE TO THE FLAG
INVOCATION was given Bishop John Oborn, Chubbuck ls`. Ward, Chubbuck Stake, The
Church of Jesus Christ of Latter -Day Saints.
APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Special
Meeting Minutes of April 23rd, 2002 and Regular Meeting Minutes of April 23rd, 2002.
Councilman Kearns moved to approve the Special Meeting Minutes of April 23rd, 2002
and Regular Meeting Minutes of April 23rd, 2002, Councilman Quick seconded. All
council members present voted in favor of motion.
GREENER PASTURES 1ST ADDITION PRELIMINARY PLAT - An application by Tom
Holm, 5735 Sorrell Drive, Chubbuck, Idaho 83202. Property is located at the SW 1/4,
Section 34, Township 5S Range 34E. (Intersection of Lariat and Hawthorne Road). Was
tabled from April 23rd, 2002 Council Meeting.
Greg Evans, 5760 Sorrell stated the neighborhood had a meeting, then consulted an
attorney. Mr. Evans stated their attorney sent a letter to Tom Holm stating the residents
in the Greener Pastures Subdivision are trying to uphold the Greener Pasture Restrictive
Covenants. Mr. Evans said at this time, no one knows whether the Greener Pastures
Restrictive Covenants are in effect. Mr. Evans stated a home should not be allowed as
requested because Greener Pastures has been a subdivision for approx. 40 years. Mr.
Evans stated this is a matter for the courts. Mr. Evans stated, the residents are willing to
sit down with Mr. Holm and come to some kind of sensible solution.
Jack Miller, 5720 Sorrell said the residents were never told the restrictive covenants had
to be renewed to continue in effect. Mr. Miller said he is against approval of the
preliminary plat.
Attorney Holmes stated the City does not have a say in whether a double wide mobile
home goes anywhere in the City. Attorney Holmes stated if the plat is not approved, Mr.
Holm can still put two homes on the lot without approval from the City.

GREENER PASTURES 1ST ADDITION PRELIMINARY PLAT - (cont.)
Attorney Holmes stated the restrictive covenants is a contract within the subdivision, it is
up to the residents in the subdivision to keep updated.
Councilman England suggested the residents get together, do their best to feel good about
what is going to happen, then update the restrictive covenants.
Greg Evans, 5760 Sorrell requested the Council delay a decision on approving the
Greener Pastures I". Preliminary Plat until the Judge makes a decision.
Councilman Kearns moved to approve the Greener Pastures 1St. Addition Preliminary Plat
as presented, Councilman Gunter seconded. Roll Call Vote: Quick, no; England, yes;
Gunter, yes; Kearns, yes. Motion passes.
RECOGNITION TO CHUBBUCK POLICE DEPARTMENT - Asst. Police Chief Richard Webb
and Captain Ray Sandusky received a Certificate of Appreciation from the First Battalion
148' Field Artillery for their exceptional cooperation and support to the Idaho Army
National Guard. City of Chubbuck also has earned AAA recognition for its effort in
improving local traffic and pedestrian safety.
ORDINANCE - Providing for change of Land Use District with respect to certain lands within
the boundaries of the City of Chubbuck from Agricultural, (A) to General Commercial,
(C -2); declaring that the City Council finds that such change in Land Use District is
compatible with the Land Use Pattern.
Councilman England moved to table the ordinance, Councilman Kearns seconded. All
council members voted in favor of motion.
DESTRUCTION OF SCANNED POLICE DOCUMENTS - Police Department presented a list
of scanned police documents to be destroyed. (attached).
Councilman Quick moved to approve destruction of scanned police documents as
presented, Councilman Kearns seconded. All council members voted in favor of motion.
BUSINESS LICENSE APPLICATION - Randy Watson, Inland Empire Shows, Overton, NV has
applied for a business license to operate a carnival at the Pine Ridge Mall Parking Lot,
June 19th, 2002 through June 23rd, 2002.
Police Department recommended approval of the business license.

BUSINESS LICENSE APPLICATION - INLAND EMPIRE - (cont.)
Councilman Quick moved to grant Randy Watson, Inland Empire Shows, Inc. a business
license to operate a carnival at the Pine Ridge Mall Parking Lot, June 191h through June
23rd, 2002, subject to Fire Department approval, Councilman Kearns seconded. All
council members voted in favor of motion.
2000 -2001 FISCAL YEAR AUDIT - City Auditor Scott Jones presented the 2000 -2001 Fiscal
Year Audit to Mayor Cotant and Council.
Councilman Kearns moved to accept the 2000 -2001 Fiscal Year audit as presented,
Councilman Quick seconded. All council members voted in favor of motion.
CLAIMS - Computer print -out claims presented to Mayor Cotant and Council.
Councilman Quick moved to approved computer print -out claims as presented,
Councilman Gunter seconded. All council members voted in favor of motion.
GENERAL DISCUSSION - Richard Marley, 5150 Stuart reported a traffic hazard at 410 Stuart
Street, there are five vehicles parked on the street for as long a 4 months at a time. Mr.
Marley said you cannot see when turning the corner. Attorney Holmes will get with
Captain Jim Phelps to see what can be done.
At 8:50 p.m, Councilman England moved, Councilman Gunter seconded, with full council
approval to adjourn meeting.
