Re: CUP Extension of Time / FFCL Amendment
For a Commercial Kennel at 702-730 New Day Parkway
Background:
Larry Dunn received a Conditional Use Permit (CUP) from the Commission in July 2023
for a pet boarding business.' Several issues delayed the project, including the failure of
access agreements with neighboring property owners.
In July 2024, the former Community Services Director (CSD) authorized an 18 -month
extension of the CUP to January 2026, acknowledging the progress of potential
development on neighboring parcels that would provide a different access point. No
conditions listed in City Code 18.28.020.G would require that an extension be denied.
Since that time, the neighboring property owners have changed their development
plans, without access to Mr. Dunn's property. This request is for one more extension of
time with an amendment to the Findings of Fact and Conditions of Law (FFCL) from the
Commission (see attached).
Request:
Mr. Dunn requests the removal of the first condition on the FFCL "When agreement is
reached among neighbors for a new road access, and upon its construction, access to
the site will change from New Day Pkwy to the new street, and the street frontage will
require landscaping per City Code", and replace it with a condition allowing an
extension of time for 24 months, to expire on January 23, 2028.
At that time, the business was defined as an Animal Care Site. Under current definitions in Title 18 the business
would be a Kennel (Commercial). It has the same use/conditional use requirements as it did before the change.
Per the direction of the Commission, additional information is provided regarding the
original application and extension of time.
Summary:
To accommodate a different access point via the neighboring property Mr. Dunn's site
would need a different layout, engineering, grading, etc. His request at this time is for an
extension of time only, not to authorize any change to the site as originally approved
with the CUP.
The term of approval for a CUP is stated in City Code 18.28.020.F that unless the
Commission approves a longer term, the CUP will expire in 12 months if construction
does not commence.
In agreement with City Code 18.28.020.G the CSD granted an 18 -month extension of
time. Any further extension of time may be granted by the Commission but not by the
CSD.
If Mr. Dunn has not commenced construction by the date determined by the
Commission, he will apply for a new CUP from the Commission.
Recommendation:
• Approve the request to remove the first condition of the FFCL
"When agreement is reached among neighbors for a new road access, and upon
its construction, access to the site will change from New Day Pkwy to the new
street, and the street frontage will require landscaping per City Code."
• Replace the first condition with a new condition
"The term of approval for this CUP shall be extended 24 months from this date
to 73 January, 2028. If construction has not commenced by said date the CUP
shall become void and a new CUP shall be required for the project to move
forward. "
Exhibits:
1. Request for Condition on Amended FFCL: 26 December, 2025
2. Findings of Fact and Conclusions of Law: 11 July, 2023
3. Facts, Findings, & Decision: July 2, 2024

Request for Condition on Amended FFCL
From LARRY DUNN <larrydunn1332@msn.com>

To Joey Bowers <JBowers@cityofchubbuck.us>
Cc Don Matson <dmatson@cityofchubbuck.us>
Hi Mr. Bowers, I am writing to request an amended FFCL for an existing CUP. My original CUP is under
FFCL "New Day 730 CUP_FFCL_Approval.pdf". The first amendment I would like to have is under
Condition of Approval 1.a. I would like that removed from the FFCL. The agreement describes was
cancelled by the neighboring developer after approximately six months of delay during the construction
of Bluff Point Rd. My second amendment request is to have a Condition of Approval added to the FFCL
that would allow me another 24 months extension on the CUP. The first 18 months were approved in
"Approval_702 New Day Parkway Animal Care CUP Extension Request_07.02.2024.pdf". I did not realize
how much effort, time, and money the cancellation of the agreement would affect my proposed project.
When I received the agreement stating that my business access would have to spur off Bluff Point Rd. I
began getting new engineered drawings and architectural drawings. The cancellation of the agreement
forced me to make changes to my business plan, financial projections, engineering, architectural
drawings, construction bids, etc. This causes me to have to start over with lending institutions as well.
These delays and the recent government shutdown have caused substantial delays to the overall
progress of my project. I would like to point out that to my knowledge there have been no significant
amendments to the Comprehensive Plan or Land Use ordinance, or any significant land use changes in
the vicinity which would adversely impact the project or would be adversely impacted by the project.
There also have not been any hazardous situations which have developed or discovered in the area. I am
also still planning on the same use, layout, and all other details that were presented in the original
approved project plan review and CUP application. If this extension is granted, I would fully expect the
City of Chubbuck to require a complete reapplication for a new CUP if the extension time expires. I
appreciate your time. Please let me know if you have any questions or comments. Thank you, Larry

Facts, Findings, & Decision
www.CityofChubbuck.us
To: Larry Dunn, Applicant; City Planning Division, City Building Division, City Development Services Division
From: Devin Hillam, Community Services Director -N
Date: July 2, 2024
Re: Animal Care Site — 702 New Day Parkway CUP — Extension Request
Request:
• On July 2, 2024, Larry Dunn formally requested an extension of their approved conditional use permit
(CUP) for 18 months.
Facts:
• At the July 11, 2023 Land Use and Development Commission meeting, a CUP was approved, subject to
conditions. The approval was effective 10 days after the signing of the FFCL by the Mayor (July 21, 2023).
• Per Chubbuck City Code, CUP approvals are valid for 1 calendar year unless the use has commenced, and
conditions are satisfied.
o Between receiving this approval and the request for extension, an adjacent property owner filed a
preliminary plat with the City to construct a roadway adjacent to the Dunn property. Condition
1.A of the CUP stated that "When agreement is reached among neighbors for a new road access,
and upon its construction, access to the site will change from New Day Parkway to the new street,
and the street frontage will require landscaping per City code." The discussions amongst the
adjoining landowners (Freed/Harvest Springs) were outside of the Applicant's control and he has
made all good faith efforts possible to proceed while waiting for the agreement to be reached. It
was only as recently as last week (end of June 2024) that the adjoining landowners determined to
not construct a roadway adjacent to the Dunn property at this time.
• Chubbuck City Code states that extensions of the permit may be requested if a written petition is filed at
least 30 days prior to the lapse of the permit. An extension under the code may be approved one time for
up to 2 years if the Community Services Director (CSD) finds that certain criteria are satisfied. If the CSD
finds that any of the following exist, an extension shall be denied.
o There have been significant amendments to the Comprehensive Plan or Land Use ordinance
which will affect the CUP authorization.
There have been significant land use changes in the vicinity which would adversely impact the
project, or which would be adversely impacted by the project.
There are hazardous situations which have developed or have been discovered in the area.
Findings:
J:\Planning\Land Use Projects\Conditional Use Permit (CUP)\2023\New Day 730 E - Northgate Pet
Boarding\Final_702 New Day Parkway Animal Care CUP Extension Request_Approved_dbh_7.2.2024.docx
• Based upon the several steps taken since the CUP was approved in working with City staff and trying to
work with circumstances outside of his control, and the recent change to development plans of the
adjacent property owners as indicated in the Facts, the requirement for this extension request is waived so
that a review of the extension request could occur prior to the permit's expiration.
• The applicant requests an 18 -month extension from July 21, 2024.
• The CSD deems commencement of the use as occurring from the time when a building permit is obtained
AND the foundation is poured and approved by the Building Division.
• The CSD finds that none of the conditions listed in Chubbuck City Code section 18.28.020.G exist which
would require that an extension be denied.
Decision:
Upon review of the request, the facts, and findings, it is hereby decided that the request for an extension to the
approved Conditional Use Permit is granted, and that the one-time extension allowed is for an additional 18
months from July 21, 2024 (January 21, 2026) in order to obtain a building permit AND to have the foundation
poured and inspected/approved by the Building Division. If the use as defined herein has not commenced by
January 21, 2026, and the Applicant wishes to proceed with the project, a new CUP will be required to be obtained
in accordance with City Code.
Decisions of the Director may be appealed by an applicant or any person having a bona fide interest in real property
as defined in Idaho Code §67-6521. The appeal petition must be submitted within ten (10) business days of the CSD's
final decision and contain a description of the grievance as it pertains to the specific standards for approval. The appeal
shall be heard within a reasonable time by LDDC to review the decision of the PWD and to hear testimony of the
appellant and applicant (if different from appellant). LUDC shall determine whether to remand, uphold, modify, or
overturn the decision of the CSD, including whether to remove or add conditions. (Chubbuck City Code 18.28.070)

Hello Devin, I am writing this email to ask the City of Chubbuck to grant an extension to my
CUP that was approved at the LUDC meeting on July 11, 2024. The reason for the extension
is because I was directed by the city (Finding I of the CUP) to wait for the construction of
Bluff Point Rd. for my commercial access. I have been waiting for many months and asking
for updates from the developer of that road. I have been continually told the construction of
the road was delayed but still happening. I have also paid for engineering services for my
proposed access that will no longer be needed with the revised plan to not build Bluff Point
Rd. I am asking the for an 18 month extension so that I can now focus back on my original
plan of accessing my property, for commercial purposes, from my driveway. I will need to
time to align with my engineer, architect, and general contractor to make the necessary
changes to the plans. I appreciate your time and always being willing to meet with me on this
project. Please contact me if you have questions or comments. I can be reached at this email
or (208) 240-4012. Thank you, Larry

La rry,
Devin at the city asked me to reach out to you and let you know where things currently stand with the
previously proposed road, so that is what I did. It was not known until just recently that the costs for
the previously proposed road through Freed would no longer be considered reimbursable through the
city since the new road option just came to light and that changed the city's perspective as well as the
contract we had with the Freed's. We have been upfront as new information on the situation has come
to light between all the players. Hopefully you can move forward with your project and it can be
successful for you.

Good morning Larry - I am not sure if you have heard, but there have been some recent changes
with road plans. Terraventure has come forward with plans for developing their property which will
allow for Harvest Springs Blvd to go directly to New Day Parkway so we no longer need to build the
Bluff Point Rd through the Freed property as we had planned. It will now be up to Chris Freed to
decide what he will be doing with his property and we are no longer involved inthe development
there for that road. It may be wise for you to coordinate with Chris Freed as he moves forward with
development on his property with any questions you have about layout, etc. Thank you.

Subject: Recent Access Road Meeting
Hi Sean, I wanted to take a few minutes and recap some of my concerns I brought to the attention of the city in
our meeting this afternoon. It is my hope that these concerns can be placed in the packet for the meeting on
Tuesday, November 14th. I originally sent an email to Ryan Satterfield on October 20, 2023. The email contained a
list of items I wanted addressed in a proposed agreement in the event that my driveway needed to be replaced
because of the new road proposed by Ryan and his business partners. Ryan responded to me on October 31,
2023. After reading that email is seems to me that it is going to be difficult to come to a reasonable agreement
with Ryan. I would like the following items to be considered as the City of Chubbuck works through the process of
analyzing the effects of the proposed road on my property:
• The building of the road would not allow me to use the current access to my home that was in use when I
purchased the property.
• The proposed road will be used for a for-profit private enterprise. I am not expected to receive any benefit
from that road and should not have to pay for anything or be burdened by the construction. I was using the
access to my property first.
• The proposed driveway would split my property and make some of the property no longer useable and
completely change the dynamics of the property. My property would lose use and value.
• I currently have cattle on my property. The cattle would have to cross the proposed driveway to access
water and shelter. This would create a huge mess and safety issues.
• I would have to open and close gates each time I wanted to leave or return to my property.
• The proposed road could be placed to the east and cross through other property where there are not
currently homes, or businesses.
• I have made contact with J. Stuart Adams of Terraventure Development, LTD. He advised me that he is
willing to negotiate with Ryan and come to an agreement on crossing his property vice building the
proposed road and displacing my property access.
• A portion of City of Chubbuck property would have to be crossed to install the proposed road. Currently
installed concrete islands would have to be demolished to gain access to the new road. This would not be
the case if moved to the east.
I purchased my property within the City of Chubbuck in good faith that the city would protect my interests. I do
not believe this is a civil matter since it is the city that would be allowing him to build the road. I also feel that
proposed a reasonable list of items in my email to Ryan. I appreciate your time today.
Respectfully,
Larry Dunn

CASCADE FALLS AT HARVEST SPRINGS DIVISION 1
PRELIMINARY PLAT REQUEST - STAFF REPORT
CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION
REGULAR MEETING ON NOVEMBER 14, 2023
STAFF FINDINGS SUMMARIZED
After reviewing the proposed Cascade Falls at Harvest Springs Division 1 preliminary plat, Staff finds
that it meets the code requirements with the following comments:
• Preliminary Plat recommendations are conditional upon City Council approval of Cascade Falls
at Harvest Springs Division 1.
Bluff Point Road is being proposed to connect to New Day Parkway at the current Dunn
driveway access point to New Day Parkway. This proposal would require the Dunn
driveway/commercial access point to be relocated up Bluff Point Road just over 300 -feet away
from the new intersection to meet the City's adopted Access Management Guidelines and
requiring a new driveway through the existing pasture. Mr. Dunn was in the process of getting
a commercial pet boarding business approved through the City when the application for this
development was submitted to the City. Staff is supportive of allowing Mr. Dunn's personal
private access to remain at its current location for access to the single residence, and a
condition of approval for this application that any commercial accesses be located to meet the
required spacing distance from the intersection, and that the commercial access be in a
location agreed upon by the parties and be paved as is required by city code. Because the
Dunn commercial project was in the works prior to the application for this plat and the existing
driveway would have been approved for the commercial and residential use without any
change in location (it would need to be paved, however), staff is supportive of requiring the
plat applicant to work with the Dunns to determine the best location of the commercial drive
which minimizes impacts to the land uses, and to require the plat applicant to plat the ingress
and egress easement and to pave the driveway to the property line.
Secondary irrigation facilities will be required to be designed and constructed in accordance
with section 16.12.230 of city code, which will likely include a pump station
o The applicant has requested to defer the secondary pressure irrigation pump station to a
future division.
STAFF RECOMMENDATION: Staff recommends approval of the preliminary plat with the following
conditions or deviations:
• Development agreements between the adjacent and included property owners (Ryan
Satterfield, Chris Freed, Larry Dunn) be submitted for review prior to submittal of the final
plat.
• The secondary pressure irrigation pump station be deferred to a future division and
$10,297.00 per acre irrigation pump station guarantee be collected with building permit
applications for each lot.
• That the developer works with the Dunns to locate the Dunn's commercial drive in a location
which will minimize impacts to the Dunns' lands uses and which is amenable to the Dunns.
The drive up the Dunns' property line is required to be paved. Relocation of the shown drive
to accommodate the needs of the Dunns will not require resubmission of a preliminary plat.
• Based upon a recommendation from City Staff, a waiver from the Access Management
Guidelines is granted allowing the existing Dunn residential approach to remain at its current
location for the purpose of a single residential access.
FACTS
REQUEST: The applicant proposes a 6 lot Preliminary Plat for commercial building lots in the Cascade Falls At
Harvest Springs subdivision, Division 1. It includes providing public streets, water, sewer, and irrigation
system including services.
BACKGROUND: This is the 1st division of the Cascade Falls At Harvest Springs subdivision.
TYPE OF COMMISSION ACTION: Quasi -Judicial (Subject to appeal; decisions must be supported by
the evidence and by applying law to the facts; decisions shall be based on the standards for
approval). Recommendation/approval of this preliminary plat shall be whether it meets the requirements
of the City of Chubbuck ordinance and State of Idaho statutes. The Commission may recommend
approval with or without conditions, may table a decision, or may recommend denial of the
application.

Subject: Re: Property Access Replacement Agreement
Thanks Larry - I can review and discuss with everyone involved and begin to formulate an agreement
for review. We will likely need to discuss a number of your conditions, and for clarification purposes,
there are three parties involved in the road proposal, Chris and Janie Freed, View Pointe
Developments (Kevin Loveland), and Satterfield Realty & Development, so the agreement will likely
need to involve all four entities with you included. The main agreement, in my view, needs to be
between you and the Freeds since you are the two property owners that will need to plan in
conjunction to assure that any road or layout meets future needs for both parties, and where Freed will
be granting an access easement through his property, which neither myself or View Pointe
Developments has control over. I'll get back to you with some thoughts though. Thanks.

APPLICATION FOR A CONDITIONAL USE PERMIT
FOR AN ANIMAL CARE SITE (PET BOARDING) IN THE AGRICULTURE (A) ZONE
CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION
REGULAR MEETING ON JULY 11, 2023
(11I1LTA ILTA IA WA
DESCRIPTION: An application for a Conditional Use Permit for an animal care site (pet boarding) in the
Agricultural (A) zone on approximately 1.2 acres of land. Subject property is located at 730 New Day
Parkway, Chubbuck, Idaho. The Comprehensive Plan Future Land Use Map designates this area as
Commercial. The application will be reviewed against criteria in section 18.28.020.C.5 of City Code. Type of
action: Decision.
STAFF FINDINGS: After reviewing the application and related materials, staff finds that it meets the
standards established by the City for a Conditional Use Permit (CUP).
• Animal care sites are conditionally permitted in the Agricultural (A) zone.
• The Design Review Committee has reviewed the site plan against technical requirements of the
City as required by city code and requested revisions from the developer; the committee's
recommendations are reflected in the site plan included with this report. The Committee did
not approve the use and only reviewed technical requirements:
o The committee directly reviews and approves such details as parking, landscaping, access,
utility services, and sanitation.
o The Land Use and Development Commission may approve other or more stringent
conditions on the proposal.
The applicant has met City Code requirements to be heard for a CUP.
Staff and the applicant have met with neighboring property owners to clarify future
improvements to the site access.
Staff recommends approval of the proposed CUP and Findings of Fact and Conclusions of Law
with the following conditions:
When agreement is reached among neighbors for a new road access, and upon its
construction, access to the site will change from New Day Pkwy to the new street, and the
street frontage will require landscaping per City code.
In lieu of frontage landscaping on New Day Pkwy, applicant shall maintain area behind
pathway landscaped strip to their property to minimize weed growth. Contact Parks
Department before applying herbicides.
FACTS
BACKGROUND: The proposed project, at the northeast corner of Hiline Rd and New Day Pkwy, is on a slope
up from the corner. Development of the slope across the middle of the project area is not feasible for
development. A special access to the site was built with the construction of New Day Pkwy. The access is
through a parcel owned by the city, and weed control has been an issue.
TYPE OF COMMISSION ACTION: Quasi -Judicial (Subject to appeal; decisions must be supported by the
evidence and by applying law to the facts; decisions shall be based on the criteria and standards for
approval per section 18.28.020.C.5 of City Code). The Commission may approve with or without
conditions, may table a decision, or may deny the application.

GENERAL REQUIREMENTS AND PROCEDURES
The following code regarding CUPS should be used in evaluating and weighing the application:
18.28.020.CS. Standards for Approving a CUP: A CUP may only be approved if the Commission
makes affirmative findings of fact on each of the following standards. These are addressed by the
applicant with the submittal (see attached), section E8:
1. The proposed use is conditionally permitted in the subject zoning district and complies with all
of the applicable provisions of city code unless modified through the conditional use permit
process.
2. The proposed use is generally not in conflict with the goals, objectives, and policies of the
adopted Comprehensive Plan.
3. The proposed use is compatible with other existing and permitted uses in the general vicinity.
4. The proposed use is harmonious in scale, mass, coverage, density, and intensity with all
adjacent permitted land uses.
5. The proposed use would not place an undue burden on transportation, police, fire and EMS
protection, water/sewer, schools, and other public facilities or agencies, in the vicinity.
6. The proposed use, if it complies with all conditions imposed, will not adversely affect other
properties or the environment in the vicinity to a materially greater extent than would uses
permitted outright by this Code.
18.28.020.C6. Conditions for Approval: To make affirmative findings relating to the standards
established in section 18.28.020.C.5, the Commission may condition approval of the permit on
compliance, including but not limited to, the following:
Conformity to approved plans and specifications.
The Comprehensive Plan Future Land policy designates the area as Commercial, allowing for
General and Limited Commercial (C-2 and C-7) zones. If the property were to change to the C-2
zone in the future, on Animal Care Site is also a conditional use.
2. Provision of open spaces, pathways, buffer strips, walls, fences, landscaping, and lighting.
The site design includes the required landscaping and lighting. As a small site in an agricultural
setting, it is surrounded by undeveloped land.
3. Minimizing adverse impact on other development.
The proposed site plan, and recommended by the Design Review Committee, includes:
a. The project will only have road access via the current private drive across city property to
New Day Parkway.
b. Existing neighboring uses are pasturing of livestock and growing crops. The proposed
development is compatible with these uses.
c. The applicant has considered the presence of multiple animals on site. The building and
individual animal runs have been designed to reduce any impacts on the other properties.
4. Controlling the sequence and timing of development.
Because the project is not building any new streets, utilities are stubbed into the property, and
there is only one structure planned, the sequence and timing should not disrupt traffic or utility
service provision.

Phone 208.237.2430
CHUBBUCK www.CityofChubbuck.us

5. Assuring that development is maintained properly.
The development site is on the same land as the owner. The site frontage is not on the street,
but against a City parcel. In lieu of frontage landscaping on the parcel, staff recommends the
applicant maintain the area between his property line and City landscaping along the New Day
Pkwy pathway to minimize weed growth.
6. Designating the provision of on-site or off-site public facilities or services.
There are no outstanding issues.
7. Requiring more restrictive standards than those generally required by the Code.
The development is adhering to higher and more restrictive standards than are normal
requirements for the Agriculture zone.
8. Requiring the mitigation of effects of the proposed development upon service delivery to the
property by any political subdivision, including school districts.
During the Design Review no impacts or burdens were recognized. No comments have been
received from utilities, the school district, or other political subdivisions.
STAFF RECOMMENDATION
Based on the Standards for Approving a CUP, and Conditions for Approval above, staff recommends
approval of the Findings of Fact and Conclusions of Law, with the proposed use, site plan, and other
details of the project as presented.
When agreement is reached among neighbors for a new road access, and upon its construction,
access to the site will change from New Day Pkwy to the new street, and the street frontage will
require landscaping per City code.
In lieu of frontage landscaping on New Day Pkwy, applicant shall maintain area behind pathway
landscaped strip to their property to minimize weed growth. Contact Parks Department before
applying herbicides.

Conditional Use Permit Application for Northgate Pet Boarding, 730 New Day Parkway, Chubbuck,
83202.
Section D5
Larry and Heather Dunn are applying to the City of Chubbuck for a Conditional Use Permit (CUP) to
operate an Animal Care site at 730 New Day Parkway, Chubbuck, ID 83202. There is a definite shortage
of facilities that provide dog day care and dog and cat boarding in the areas of Chubbuck and Pocatello.
As Chubbuck grows the need for dog and cat daycare and boarding will grow as well. We have adequate
space on our land in the new area of New Day Parkway where we can build a state-of-the-art facility. We
believe our business will be a fantastic addition to the city. The project is being designed to be an
attractive building and site. Pet owners will have a safe and clean environment to take their pets when
needed. This will reduce the number of pet issues for the city.
A Design Review Clearance has been granted in leu of the following comments. Below are the responses
to the Committee's highlighted comments. All other comments will be satisfied to meet the City's
requirements.
• Lighting Standards — Fixture descriptions are being addressed by the building contractor and will
be submitted with the engineered site plan in progress.
• Curb, Gutter, Sidewalks/ADA - The project will provide payment with the building permit to
pave approximately eighty feet of the walking path along the frontage of the business entrance
(Subject to change with construction of new connector, construction will be negotiated with and
completed under the direction of the city.
• Site Plan / Traffic Circulation — (1) The driveway and parking area will be paved as soon as the
proposed connector is constructed. There will be ongoing discussions with the city and the two
parties that are developing the connector that will possibly be the future access to the business
and residence of the Owner. We have discussed with the city the possibility of a temporary
allowance for a gravel driveway until construction of the connector is finalized. (2) The culvert
will be installed per the city's requirements. The Owner has asked tin engineering firm to include
this on the civil plans.
• Sanitation — Owner has asked the engineering firm to include the requested location for the
dumpster enclosure on the civil plans.
• Fire Codes — A knock Box will be installed on the building and water supply for suppression will
be addressed in the civil plans.
• Stormwater—This will be addressed in the civil plans.
• Landscaping — An agreement between the Owner and the city will be completed prior to the
application for a building permit.
Conditional Use Permit Application for Northgate Pet Boarding, 730 New Day Parkway, Chubbuck,

Section E4
Attached are preliminary site drawings. Civil drawings are being prepared by Noesis Engineering Services
and will be available for submittal to the City of Chubbuck soon.
Section E8, Question #2
Chapter 4, Land Use: Goal 3, Provide convenient commercial service locations and limit their adverse
impacts on transportation systems, residences, and visual integrity. (There will not be any adverse
impacts to transportation systems. A traffic analysis was completed and approved by the city. There will
not be any adverse impacts to residences. There is only one residence in the vicinity. Visual integrity will
remain high. The building is a new construction and has a very nice design. Light pollution will be
reduced by using the proper fixtures and adjustments)
Chapter 7, Government Services: Policy 6.2.a, Minimize the cost of services and utilities needed to
support new developments using phased service extensions, concurrency of improvements, or through
other means. (Animal hair traps will be installed to minimize the hair at the city sanitary sewer).
Chapter 9, Natural Resources: Policy 2.1.f, Assure that new development manages stormwater runoff
and minimized the impact of flooding downstream. (Civil engineers are preparing drawings and plans to
install stormwater retention areas to mitigate flooding)
Chapter 9, Natural Resources: Policy 3.1.c, Require the inclusion of bicycle and pedestrian systems
during subdivision review and development to support alternative modes of transportation. (The project
will help fund a portion of the bicycle/pedestrian path on the North side of New Day Parkway)
Chapter 9, Natural Resources: Policy 3.3.d, Require paving of parking lots.
All parking areas will be paved when the project and adjacent roads are completed.

DESIGN REVIEW
COMMENTS FOR
CLEARANCE
Thank you for your Design Review Clearance application and information for your project. Below are the
Design Review Committee (Committee) comments and requirements for clearance for the project.
Address items marked with a • at the appropriate points in the development process.
Notes: Access and alignment/site plan may result in changes depending on whether agreement is
reached among neighbors for a new road access.
Civil plans for paving, drainage, water supply etc., may be submitted with building permit
application.
For the Conditional Use Permit (CUP) application, you'll include this memo and a response to how
the issues have been addressed, or will be addressed with the building permit process, etc. Please
contact me if you have any questions or would like to meet with members of the Committee
about any of the decisions.
Regards,
Don Matson, Planning Manager
Phone: 208-239-3252 1 Email: dmatson@cityofchubbuck.us
Design Review clearance is not an approval of other required permits or licenses and is only an approval of
authorized functions of the Committee per Chapter 78.76 of Chubbuck Municipal Code.
Land Use and Zoning
Your project is defined as an animal care site per city land use/zoning code, where there are a few
unique references pertaining to your project. There are other references to kennels in the land use
and animal control chapters of City Code. A copy of both sections are attached; the kennel
references are provided for your information, and offer some guidance in complying with various
standards and codes.
Traffic Study Standards
The submitted traffic impact statement is acceptable to the city.
Lighting Standards
• Submit fixture descriptions at building permit to verify there will be no light trespass off site or into
night sky.
Street / Approach / Access Management
1. Will be using existing approach from New Day Parkway.
Page 1
Curb, Gutter, Sidewalks / ADA
1. City standards require developments to install curb, gutter, and sidewalk. Curb and gutter at site
are already in place, but sidewalk, in this case the pathway, is not yet finished.
2. The width of your project "frontage" is approximately 80 feet.
• Rather than finishing/paving an 80 foot section of the path, provide payment in lieu of
construction, with building permit. Construction will be completed later under direction of the
City with other segments of the path.
Site Plan / Traffic Circulation
1. Site plan shows driveway as gravel. Code requires pavement for drive aisles and parking, and
striping of stalls is required.
• Pave driveway and parking area with site construction.
2. The new driveway will block some runoff, a culvert is needed.
• At the time a new drive is constructed to the site a 12" diameter culvert is required from the east
to the borrow ditch on the west of the existing drive — see sketch.

Sanitation
1. The shown dumpster enclosure is too small for the city to service. It will need to meet the city's
minimum size of 11' wide x 10' deep, inside dimensions. It will also need to meet the minimum
requirements shown in the attached city's standard detail. The dumpster can be better served if it
is placed about 10' to the south of the shown location.
• Please adjust the location as shown in the attached layout.
• If sanitation facility/dumpster will contain animal waste, the facility shall be maintained so as to
prevent odors detectable from public areas and abutting properties
2. If applicant intends to have a commercial recycle container to be serviced by a private company,
the dumpster enclosure will need to be sized for both containers or a separate location for the
recycle container will need to be provided.
Fire Codes
• Install a KnoxBox on the building.
• Water supply for fire suppression will need to be addressed on civil plans.
Addressing / Display
1. 730 New Day Parkway will be assigned to the business. Please contact staff if a different address is
desired.

Street address needs to be visible from New Day Parkway; city will display addresses for home
and business with the private drive sign.
Parking / Accessible Parking
1. No standard available — parking supply based on codes from other cities. Staff supports the
proposed number of parking stalls; there is also additional area for potential parking — any
overflow will not affect street traffic.
Stormwater
Stormwater must be retained on site. A stormwater report meeting the city's requirements (the
Portneuf Valley Stormwater Design Manual) and corresponding plan will need to be submitted for
review.
• Submit plan with building permit application.
Wastewater Pre -Treatment / Chemicals On-site and Disposal
Provide filtration system in kennel and grooming areas, to reduce amount of animal hair entering
city sewer.
A Nonresidential Wastewater Discharge Permit is required after beginning operations. City Public
Works will initiate contact at that time.
Water / Sewer Standards
1. Estimate of water/sewer usage needs to be provided to help determine appropriate wastewater
capacity fee. Water capacity fee will be based on service line/meter size.
• Submit plans showing water and sewer utilities for City review, as part of civil plans.
Building Codes / Setbacks
1. Emergency Services & Police Development Impact Fees will be due at building permit stage. Fees
below based on 7,200 sq. ft and "General Commercial" classification:
a. Emergency Services = $2,229.62
b. Police = $2,688.98
Building Design / Elevations
1. Design appropriate for site and zoning district.
Comment: Building looks great. Love the design for this use.
Signs
One wall sign is planned on building, future sign at drive entrance. Wall sign permit can be
processed at same time as building permit.
Future sign away from building will need review prior to permitting. Any sign facing street will
need to be on private property. See also comments under addressing.
Landscaping
1. Parking: parking lot area 660 sf landscaping is required, with at least 4 trees. Total sf in site plan
exceeds 800 sf, but no trees identified — appear to be shrubs on landscape plan. Please clarify.
2. Street frontage: approximately 750 sf is generally required of this project.
• Since the front of the parcel is against city property, not a street, City will consider landscaping
agreement for part of City parcel in lieu of property frontage landscaping.

290 E Linden Avenue, Chubbuck, ID 83202
Phone 208.237.2430
CHUBBUCK www.CityofChubbuck.us
1 0 R H 0

Subject: Info for Animal Care Site
Hi Dan,
It was great visiting with you. I've attached a copy of the completed design review clearance that contains items
related to design and approvals to move the project forward.
I've also attached a copy of the Conditional Use Permit form- in our experience, these CUP applications and the
presentations usually go best with the owner/developer making the presentation since they are the ones most
familiar with the specific use details and can horse trade on possible conditions of approval, with the
owner/developer having their designer in the audience should their technical expertise be needed. As I
mentioned, we'll need an application approximately 30 days prior to the scheduled public hearing meeting (our
commission meets on the 2nd Tuesday of each month); we can accept the application 28 days prior to the meeting
but if documents are missing or the application incomplete, the review will wait for the hearing 60 days out (thus
why I recommend getting it in at least 30 days in advance so that we can review and identify any deficiencies).
Don Matson is Cc'd and he's our Planning Manager and can walk you and/or Larry through any questions related
to the CUP.
I've also attached a copy of the Portneuf Valley Stormwater Design Manual.
I followed-up with the Fire Chief and provided the access lane is at or under 10% grade, that will work for his
department. Vehicle access around the building completely is not required. If the access exceeds 150' in length, it
will be deemed a fire apparatus road and require an approved fire turnaround.
While our code doesn't require it, I would recommend possibly platting the parcels so that the building does not
sit over property lines. As I'm sure you know, structures that sit over property lines can create issues when
properties sell and especially when any properties are finances. Again, just a strong recommendation. If the Dunns
decide to plat, Sean Harris, our Development Services Manager will be the best point of contact at
sharris@cityofchubbuck.us.
Best,

RE: Northgate Pet Boarding
Appx. 702 New Day Parkway
Northgate Pet Boarding is a proposed 7,200 SF Animal Care Facility located at Appx. 702 New Day
Parkway in Chubbuck, ID
The ITE manual does not have a classification for Animal Boarding or Pet Day Care. The AM and PM Peak
Hour Trip Rates were obtained from a study completed on a similar project in Mill Creek Washington.
The study developed a rate based on the maximum number of animals boarded. The rates are as
follows: AM Peak Hour Trip Rate = (.08), PM Peak Hour Trip Rate = (.07), Daily Trip Rate = (.87). This
formula would show that 53 peak hour trips will be added to New Day Parkway if the facility was at
maximum capacity. Total ADT is therefore 53.
The entire length of the driveway (TBD) and parking area will be paved. We are proposing a 1320 SF
parking area which will include 6 parking spaces, each 220 SF in size. One space will be a handicapped
van accessible space. The size and number of spaces is based upon rates published in two books
pertaining to dog boarding facilities.
The exact sign design has not yet been decided. The sign attached to the building will be approximately
40 square feet. Another sign of the same size will be placed near the entrance to the driveway and will
be placed in compliance with the city requirements.
Chemicals on site will be mostly household cleaning chemicals. Organic, biodegradable chemicals will be
used when possible. There will not be any oil used on the premises. A grease trap is not planned to be
used for the project.
The lighting descriptions and locations are described in the plans provided with the drawings.
