• The zoning designation will not take effect until approved by City Council and enacted by

ANALYSIS AND RECOMMENDATIONS
SPOT ZONING:
As described in the Idaho Supreme Court ruling regarding Evans v. Teton County "a claim of 'spot zoning' is
essentially an argument the change in zoning is not in accord with the comprehensive plan. There are two
types of 'spot zoning.' Type one spot zoning may simply refer to a rezoning of property for a use prohibited
by the original zoning classification. The test for whether such a zone reclassification is valid is whether the
zone change is in accord with the comprehensive plan. Type two spot zoning refers to a zone change that
singles out a parcel of land for use inconsistent with the permitted use in the rest of the zoning district for the
benefit of an individual property owner."
The proposal does not meet either of the definitions of spot zoning. The proposal:
1. Complies with the Comprehensive Plan. The A zone is unique in the plan. Agriculture zones and uses
are located throughout the city but not specifically noted as a planned use. When parcel in the A
zone is developed it must comply with the Comprehensive Plan with any change in zoning. See also
section 2 below.
Does not single out a parcel for development inconsistent with allowed uses in the zone to benefit an
individual property owner. The purpose of the A zone is to "provide for orderly transition of
farmlands, by limiting their use to low density residential neighborhoods until such time as other
uses, consistent with the comprehensive plan, become appropriate" (Title 18.08.10.A.). The proposed
zone, and proposed use of the property, do not meet the definition of type two.
STANDARDS REVIEW:
The Commission must determine if it is in the best interest of the City of Chubbuck and adjacent landowners
to recommend a Title Change to the Land Use (zoning) Map. See additional standards for approving a zone
change in EXHIBIT 2B and additional relevant Comprehensive Plan policies in EXHIBIT 3B.

E6. Conceptual development plan and/or plat if future uses are known. ❑ Yes ❑ N/A
E7. Provide a response to each of the following (use an additional sheet if necessary):
a. How is the proposal in the community's best interest?
The purposed annexation is in the community's best interest because it creates consistent
jurisdictional oversight. Annexing this parcel into the City of Chubbuck ensures that the land is
regulated under the same zoning, maintenance standards, and long term planning framework as the
surrounding area. This also creates uniform zoning across all parcels owned by applicant.
b. How do the list of uses permitted by Chubbuck Municipal Code section 18.08.040 for the requested zone blend with surrounding
land uses?
As a canal right-of-way, the annexed parcel will continue to serve low -intensity, infrastructure -related
functions that fit within the civic and public-service uses allowed by the zone, ensuring seamless
integration with adjacent properties and maintaining uniform land -use compatibility.

c. How are the uses permitted in the proposed zone harmonious in terms of scale, mass, coverage, density, and intensity with
adjacent land uses?
The uses permitted in the proposed zone are harmonious with adjacent land uses because the parcel is a
narrow canal right-of-way that will continue to function as low -intensity infrastructure, with no structures,
building mass, or density added to the area. Under the permitted uses, any realistic activity on the corridor—
such as maintenance access, utilities, drainage, or other civic/infrastructure functions—has minimal physical
presence and does not introduce new bulk, coverage, traffic, or operational impacts. This aligns naturally
with the surrounding residential and commercial properties, as the scale and intensity of the corridor remain
substantially lower than nearby developed parcels. As a result, the permitted uses are fully compatible with
the existing urban pattern and support a seamless land -use transition without altering the surrounding
neighborhood's character.
d. To your knowledge, is there anything that would prevent the site under the proposed zoning from being served by transportation
routes, police, fire, EMS protection, water/sewer, schools, and other public agencies or facilities?
To my knowledge, there is nothing that would prevent the site from being served by transportation
routes or by City of Chubbuck police, fire, EMS, and other public agencies. Because the parcel is a
canal right-of-way with no residential or commercial development potential, it does not require school
services, water, sewer, or other urban utilities, and its access needs are limited to routine
maintenance or emergency response. The site is already adjacent to established City service areas,
and the annexation does not create any physical, legal, or operational barriers that would inhibit the
City from providing service coverage consistent with surrounding properties.
e. How is the proposed map amendment supported by the Chubbuck Comprehensive Plan?
Cite specific goals, objectives, and policies, including the future land use map, which relate to your proposal.
The proposed map amendment is supported by the Chubbuck Comprehensive Plan because it
promotes orderly growth, consistent land -use planning, and coordinated management of public
infrastructure within the City's area of influence. Annexing the canal right-of-way and applying City
zoning eliminates a jurisdictional outlier within the planning area, allowing the corridor to be regulated
under the same policies that guide surrounding development. This supports the Comprehensive
Plan's goals of efficient service delivery, infrastructure coordination, and long-term community
sustainability by ensuring that public facilities and infrastructure are planned and managed within a
unified municipal framework.
