Subject property is located between Park Lawn Dr and the Union Pacific Railroad, approximately 740 feet south of New Day Pkwy. At the meeting, the Commission will consider whether the proposal satisfies the approval criteria in municipal code section 18.28.040.D. Type of action: Recommendation. STAFF FINDINGS: After reviewing the application, Staff finds that it meets the requirements for an amendment to the Comprehensive Plan Future Land Use Map. • The Comprehensive Plan currently designates this area as Commercial, which permits the General Commercial (C-2) and Industrial (1) zoning districts. The change to Residential — High Density would be supported by the General Residential (R-3) and Dense Residential (R-4) districts. • The proposal would affect about one tenth of a 7.96 acre parcel, bringing the entire parcel into one designation — Residential — High Density. • The applicant has met City Code requirements to be heard for an amendment to the Comprehensive Plan Future Land Use Map. • Staff recommends approval; see additional information below and in the attached exhibits. FACTS BACKGROUND: The Legacy Park Division 2 plat boundaries don't align precisely with the Comprehensive Plan Future Land Use Map (FLUM). This correction is needed to permit a zone change request to proceed on the same sliver of land. TYPE OF APPLICATION: Legislative (Subject to appeal; decisions must be supported by the evidence and by applying law to the facts; decisions shall be based on the standards for approval). The Commission may recommend approval with or without conditions, may table a decision, or may recommend denial of the application. APPLICANT: G Brandon Ratliff 522 Sun Up Dr Pocatello, ID 83201 OWNER: Gary and Jennie Ratliff 2652 Wildhorse Pocatello, ID 83201 PZ 25-025 LOCATION: The property is located between Park Lawn Dr and the Union Pacific Railroad, approximately 740 feet south of New Day Pkwy. The site includes Bannock County parcel number RCLP2002600. Affirmative findings on each of the criteria are not required to approve an amendment. CRITERIA 1 The proposed change is required for the public convenience or necessity, or the general welfare of the community, and is in the community's best interest. COMMENT This is minor change to place a large parcel into the some future land use designation. CRITERIA 2 The proposed change is needed to recognize substantial changes in the actual conditions of the area or city that have occurred since the comprehensive plan was adopted, or is necessary to correct one or more goals, objectives, or policies that exist in the plan. COMMENT The proposal will allow a complementary change to the zoning district, bringing the parcel into compliance with city policy. CRITERIA 3 The proposed change will comply with the community's goals, objectives, and policies within the comprehensive plan, including its maps. Information on how the proposal relates to the Plan can be found in EXHIBIT 2B. COMMENT The proposal will allow a complementary change to the zoning district, bringing the parcel into compliance with city policy. CRITERIA 4 The proposed change will not place undue burden on transportation or other public facilities in the planning area and does not adversely impact the delivery of services by any political subdivision. COMMENT This is a small change, less than one acre, about one tenth of a larger parcel. Staff recommends approval of the amendment. It is a simple change to bring the parcel into compliance for future development. EXHIBITS 1. Application for Plan Amendment 2. Chubbuck 2045: Comprehensive Plan a. Future Land Use Map b.
