There is always a list of things to change, but only the following are suggested at this time. These are minor updates and changes except for a section to be deleted, Item # 2 below, and one policy recommendation, Item #7. Repeal. This proposal would delete these sections from City Code: 1. Section 18.08.050 Zero Lot Line Residence Waiver — requires permission from the Commission to construct a twin home or detached zero lot line home in the Limited Residential P (R -2P) zone. This paragraph is no longer necessary. It was added to City code in 2013 along with the creation of the R -2P zone. Since that time the regulations on lot sizes and setbacks were altered, and the Commission is still involved in decisions on zero lot line residences via Conditional Use Permit and/or platting processes. 2. Chapter 18.32 Enforcement — forbids construction of buildings in improper places and extending services to them, outlines civil and criminal remedies for abatement of such buildings, followed by several pages of instructions for a Conditional Occupancy Permit. This chapter of Title 18 has become nonoperational since its inception in 1983 and amendment in 1985. Procedures are in place to remedy the issues in the first 3 sections of the chapter, and the 4t" section details criminal remedies that need to be repealed. The lion's share of the Chapter outlines a Conditional Occupancy Permit that doesn't exist, and focuses on special events including detailed mandatory presence of members of the police and fire departments. laot\ CHUBBUCK 1 A A H A Public Works Department Planning Services 290 E Linden Ave, Chubbuck, ID 83202 Phone 208.237.2430 www.CityofChubbuck.us 3. Chapter 18.06 Definitions - subsection 240.E, Production Building Cluster Arrangement, is a two-part definition for a cluster arrangement, more commonly known as a mobile home park. The first part describes characteristics of a mobile home park. The second part of the subsection states: "Is located in an area which was included in the R -2T use district by Chubbuck city ordinance 98, regardless of whether such subdivision, park, court or area was constructed, built or maintained in conformance with subsection 18.12.030 of this title." This small subsection (18.240.8.2) is obsolete. The R -2T zone was abolished and mobile home cluster arrangements are allowed in 3 other districts. Mobile home parks cover each of the former R -2T zone areas. Safety at Intersections and Driveways. This section focuses on Sight Triangles. 4. Section 16.12.025 Access Management - In 2016 the City adopted the Access Management Guidelines from the Bannock Transportation Planning Organization for roadway design and safety This includes building placement and most landscaping outside of a vision triangle that is narrower but much longer to increase safety (see below). 280' Sight Clearance for 2 -Lane Street - 25 mph Dashed lines show previous 4U' triangle Frontage Landscaping Curb Curti Frontage Landscaping Sight or vision triangles are placed in City code to make intersections and driveway access points safer. Current references to the vision triangles are simply 40'x 40'x 56; or 75'x 15' by 21' at driveways. This configuration does not adequately address the safety goals of Access Management. Changes to reference the Access Management Guidelines should be placed in the following sections in City Code: a. Chapter 16.12.040.A: Landscaping b. Chapter 18.12.020.A: Visibility at Intersections c. Chapter 18.14.020.F.- Sight Distance for Landscaping Adjacent to Public Rights of Way and Points of Access Reference to the Access Management Guidelines is also needed in the PUD requirements with landscaping along roadways and in park strips. Add a reference with similar language as in the other parts of City code: d. Chapter 18.20.100.8: Streetscapes and Sign Standards in PUDs City code includes a 40'x 40'x 56' sight triangle for railroad crossings. This bears the same issues as intersections. Staff will prepare a recommendation for the Commission with the other sight triangles. e. Chapter 18.12.020.A: Visibility at Intersections Other Minor Updates. Minor changes to clarify issues or to bring sections of code in alignment with each other. Chapter 18.20.040.E: PUD Approval or Denial — this code still references having a public hearing with the City Council after a hearing before the Commission. Since 2022 when Chapter 18.28 was amended public hearings for the City Council regarding land use issues were abolished. Propose to delete phrase about a 2nd hearing: 18.20.040.E.2: E. Approval Or Denial: "2. Within sixty (60) days after receipt of the recommendation of the Commission, the Council shall review the PUD Zone and MDP and approve, approve with supplementary conditions or deny said plan. " 6. Chapter 15.24.020.A.5.b Additional fSicinl Location, Size and Other Standards — addresses sign size and placement. The sign industry standard for monument signs are 4 feet tall, as referenced in this code section (see table). However, a base of up to 1 foot tall is used to keep the sign above the ground and out of landscaping/lawns and sprinkler water. A footnote should be added to the table regarding monument signs, that a sign base of up to 1 foot may be placed under the monument sign. 15.24.020.5.b Sign standards table — add footnote 4: /644c\- CHUBBUCK 1 0 290 E Linden Avenue, Chubbuck, ID 83202 Phone 208.237.2430 www.CityofChubbuck.us "4. Monument signs may incorporate a sign base no more than one foot (1) above ground level, for a maximum total sign height of five feet (5)." 7. Chapter 18.16.040 Design Review Criteria; Clearance Approval — covers the required elements for early planning of commercial, industrial, and multifamily sites. A Design Review is required before applying for a Conditional Use Permit (CUP) or a building permit. CUPS, building permits, and plats have a term of approval or expire within an established limit, but Design Review approvals do not. Because conditions surrounding a site may change, as well as City standards or codes, a term of approval is desired. A clause would be inserted at the end of the Clearance Approval section, mirroring language for a CUP term of approval: 18.76.040.1 (new section): "1. Term of Approval: Unless a longer time shall be specifically established as a condition of approval, a Design Review Clearance shall lapse and become automatically void one (1) calendar year following the date on which such clearance became effective, unless prior to expiration, the use has commenced, and all conditions of the permit are satisfied." [This is the only policy recommendation in this proposal.] 8. Chapter 18.19 Chubbuck Village Criteria — included the creation of the Highway Corridor (HC) and Village (V) zones. However, several places in Title 18 have descriptions or references to all other zones but not HC or V. Add descriptions of the zones with the others in Chapter 18.08.010, and add footnotes to relevant tables in Title 18, i.e. parking standards, wireless communication facilities. 9. Chapters 18.06 Definitions and 18.08.040 Land Uses by District (table) — several land uses in the table don't have definitions in code, are outdated, or have a different name than a similar land use in the definitions section. This includes shop vs. machine shop, service station vs. convenience store, etc. Terms between the two sections of code should be made more uniform. Others need to be added per current development patterns. Specifics will be provided prior to the next LUDC meeting. /640t\- CHUBBUCK 1 0 290 E Linden Avenue, Chubbuck, ID 83202 Phone 208.237.2430 www.CityofChubbuck.us
