AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ANNEXING CERTAIN
LANDS GENERALLY KNOWN AS SUNSET WEST PHASES 6,7 AND 8, TO BE
INCLUDED WITHIN THE BOUNDARIES AND JURISDICTIONAL LLN41TS OF THE
CITY OF CHUBBUCK, IDAHO; SPECIFYING THE ZONING CLASSIFICATION
WHICH SHALL BE APPLIED TO SAID LANDS NEWLY ANNEXED TO THE CITY
OF CHUBBUCK; DIRECTING THE CHUBBUCK CITY CLERK TO RECORD THE
ORDINANCE WITH BANNOCK COUNTY; REPEALING PRIOR CONFLICTING
ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF
THIS ORDINANCE, AND PROVIDING WHEN THIS ORDINANCE SHALL
BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Annexation. The following described lands, located within Bannock County
and contiguous to the existing boundaries of the City of Chubbuck, Idaho are hereby annexed and
included within the boundaries and jurisdictional limits of the City of Chubbuck, Idaho:
See Exhibit "A"- Sunset West Phases 6, 7 and 8
Section 2. Zonnt. The above-described lands newly annexed to the City of Chubbuck,
Idaho, shall be subject to the zoning classification of R-1, Single Family Residential.
Section 3. The Chubbuck City Clerk is hereby. directed to cause the ordinance to be
recorded in.the records of Bannock County.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the
City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in
conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict.
Section 2. Severability. If any provision of this ordinance is held invalid, for any reason,
by any court of competent jurisdiction, such holding shall not affect the validity or enforceability
of anv of the remaininss ntnvi-innq.

Section 3. Effective Ile. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading, in full, is hereby dispensed with, and this Ordinance shall
become effective upon its passage, approval and publication as provided by law.

A parcel of land located in the east half of the Southeast Quarter of Section 5.
Township 6 South, Range 34 East, Boise Meridian, Bannock County, Idaho,
described as follows:
Commencing at the Southeast comer of said Section 5, Township 6 South,
Range 34 East, Boise Meridian, being marked by 2 inch aluminum cap in a vault
as described in corn, perpetuation and recorded as inst. No. 20514184; Thence
North 00°16'08" West, along the east line of section 5, a distance of 932.53 feet
to the northeast corner of Sunset West Division 2, said point being the POINT OF
BEGINNING;
Thence in a westerly direction following the North boundary lines of Sunset West
Divisions 1 and 2 for the next five courses;
1. North 89°58'22" West a distance of 380.01 feet;
2. South 87°06'14" West a distance of 186.16 feet;
3. North 89049'01" West a distance 259.13 feet to a point of non tangency with a
233.00 foot radiue curve whose center bears South 87°27'03" West;
4. Following said curve in a northwesterly direction through a central angle of
07°49'10" with an arc length of 31.80 feet (the chord of said curve bears North
06027'32" west a distance of 31.77 feet):
5. South 88038'30" West a distance of 481.50 feet to a point on the east 1/16
line of said section 5, said point also being the Northwest corner of Sunset
West Division 1,;
Thence North 0003326" West, along said 1/16 line common with the west
boundary line of a parcel of land described in deed Inst. No. 517391, a distance
of 1079.58 feet;
Thence North 89026'34"`East a distance of 192.29 feet; Thence South 3S°08'04"
