L .r CITY OF CHUBBUCK, IDAHO RESOLUTION No. ~ -2007 WHEREAS, Dell Road which was platted with the Del Mar Acres subdivision plat ends in a cul-de-sac; WHEREAS, with the development of Homestead Estates, Dell Road will become a through street; WHEREAS, the current configuration of Dell Road and the cul-de-sac is shown on Exhibit A attached to this resolution; WHEREAS, as a result this configuration, the. real estate depicted on Exhibit A and described on Exhibit 2 and Exhibit 4 are small tracts of land that are owned by the adjacent homeowners at 649 and 650 Dell Road; WHEREAS, the property shown on Exhibit A and described as Exhibit 1 and Exhibit 3 are portions of the cuhde-sac that are dedicated to the City of Chubbuck and which will no longer be needed when Dell Road is extended through to Homestead Estates; WHEREAS, Titie S0, Chapter 14 of Idaho Code allows a City to exchange real estate; WHEREAS, the City Council deems it in the best interest of the public and the City for the City to give up the property described on Exhibit A and Exhibit 1 and Exhibit 3 and acquire in exchange therefore the property described on Exhibit A as Exhibit 4 and Exhibit 2; NOW, THEREFORE, BE IT RESOLVED by the Mayor and City Council of the City of Chubbuck as follows: DECLARATION OF INTENT TO EXCHANGE It is the intent of the City of Chubbuck, in cooperation with the owners of the property at RESOLUTION -PAGE 1 chubbuck03127.resolution.wpd 1 ~ . t 650 and 649 Dell Road, for the City to convey the property described on Exhibit 1 to the owner of the property at 650 Dell Road in exchange for that homeowner deeding to the City of Chubbuck the property described an Exhibit 2 which will then become part of the Dell Road right-of--way. It is further the intent of the City to convey to the homeowner at 649 Dell Road the real estate described on Exhibit 3 in exchange for that homeowner conveying to the City the real estate described on the attached Exhibit 4. These exchanges will be without further payment. or consideration, the City Council deeming the real estate acquired by the City to be of equal value to the real estate conveyed by the City, given the size of the parcels and the relationship to Dell Road. The City Clerk shall publish a summary of this declaration of intent in the Idaho State Journal and provide for a public hearing before the Chubbuck City Council at a regularly scheduled City Council meeting. Notice of the public hearing shall be published in the Idaho State Journal at least 14 days prior to the date of the hearing.
