Present: Mayor StevenM.England, Council members Leroy S. Quick, Kent Kearns, Dennis Stoddard, Ricbat<iMorgan, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called toordeI' at 7:30 p.m. by Mayor England. PLEDGE ALLEGIANCE TO THE FLAG was led by Councilman Richard Morgan. APPROV AL OF MINU1'ES - Mayor England asked for corrections or additions to regular meeting minutes~fN()vember 14th, 2006. Councilman Kearns moved to approve the regular meeting minutes of November 14th, 2006 as read witheorrectionoftypos, Councilman Quick seconded. All council members voted in favor (}f motion. ROADS SCHOLAR PQSENTATIONS - BruceDrews, 320 E. Front Street, Boise, Idaho, University ofIdaoo was present to present Roads Scholar Plaques to City Employees Kurt Eldridge and Cameron Lusk. PUBLIC HEARING - An application by Miller Properties, LLC, 6034 Fruitwood Lane, Pocatello, Idaho for Sunset West Subdivision annexation and a zoning change to Single Family, (R-l). The property is located at the northwest corner of Philbin and West Chubbuck Roads. The. Land Use and Development & Commission recommended approval. PWD Smart explained the proposed annexation and zoning change and recommended approval. Councilman Ke~~s~nted'a map showing a two mile radius for rating the City's response time ~the Chub~k Fire Station. Councilman Kearns expressed concern that if the currentg:r'owthpaftetneontinues, the City should look at two new fire station locations to meet demands. Councilman Kearns suggested the Council look at some sort of bond, or come up with a shorter term plan for construction of the two fire stations. November 28th, 2006 PUBLIC HEARING - SUNSET WEST SUBDIVISION ANNEXATION AND ZONING CHANGE - (cont.) Councilman Keams moved to accept the Land Use & Development Commission's recommendation to approve the application for Miller Properties, LLC for Sunset West Subdivision annexation and zone change to Single Family Residential, (R-l) located at the northwest comer of PhilbinlWest Chubbuck Roads, Councilman Stoddard seconded. All council members voted in favor of motion. PUBLIC HEARING - An application by Kevin Booth, et.al, 4745 Declaration for Grove Subdivision annexation and zone change to Single Family Residential, (R-I). The property is located approximately 1/4 mile south of West ChubbucklPhilbin Roads intersection, west side of Philbin Road. The Land Use & Development Commission recommended approval. Kevin Booth, 474SDeclaration explained the annexation and zoning change request. PWD Smart stated Mt; Booth has taken The Grove Subdivision through the Bannock County process an<.lreceived approval. Mayor England declared the public hearing open, there being no comment, Mayor England declared the public hearing closed. Councilman Stoddard moved to accept the Land Use & Development Commission's recommendation to approve the application by Kevin Booth for The Grove Subdivision annexation and zone change to Single Family Residential, (R-l), located approximately 1/4 mile south of West ChubbucklPhilbin Road intersection, west side of Siphon Road, Councilman Kearns seconded. All council members voted in favor of motion. ORDINANCE #629 - Annexing certain lands being generally known as the Sunset West Subdivision and The Grove Subdivision to be included within the boundaries and jurisdictional limits of the City of Chubbuck. Attorney Holmes read Ordinance #629 in full for the first and final reading. Councilman Morgan moved to dispense with the rule of reading Ordinance #629 on three separate days, Councilman Kearns seconded. Roll Call Vote: Quick, yes; Kearns, yes; Stoddard, yes; Morgan, yes. November 28th, 2006 BUSINESS LICENSE APPLICATION - Jerry Coon, 522 Denning, lona, Idaho has applied for a business license to sell and service Kirby Vacuums door to door in the City of Chubbuck. All Departments recommended approval of the business license application. Councilman Quickmoved to grant Jerry Coon a business license to sell and service Kirby Vacuums door to door in the City of Chubbuck, Councilman Stoddard seconded. Roll Call Vote: Quick, yes; Kearns, no; Stoddard, yes; Morgan, yes. Motion passes 3-1. ORDINANCE - Amending Section 1.12.010 to provide for misdemeanor penalties of up to one thousand dollars or six months in jail or both; amending Sections 5.05.230, 9.20.060 and 9.24.050 to conform penalties to the general misdemeanor penalty. Attorney Hobnesreaq ordinance in full for the second reading. Council tabled the ordinance until the December 12th, 2006 Council Meeting. ORDINANCE - Adoptin.g Section 13.04.025 Rate Relief. CLAIMS - Computer print...out claims presented to Mayor England and Council. Councilman Motpnmoved to approve computer print-out claims as presented, Councilman Stoddard seconded. All council members voted in favor of motion. GENERAL DISCUSSION - 1. 2006 City Official's Academy and Legislative Luncheon, November 30t\ 2006 from 9:30 a.m. to 3:30p.m at City ofPocatello Council Chambers. 2. Councilman Kearns suggested Councilman Richard Morgan be appointed to represent the City of ChUbbuck on SIeOG Board. City Clerk Ron Conlin was directed to put the appointment on the December 12th, 2006 Council Meeting. Councilman Morgan stated he will attend the December 6th, 2006 SICOG Board Meeting. Gary Black, Witl..Mart Manager donated a check for of$800.00 to each Chubbuck Police Department Chief of Police Randy Severe and Chubbuck Fire Department Chief Eric King. MJ,".Blaclc stated he appreciates the good service Wal-Mart receives from the City of Chubbuck. 4. CouncilmanK~presen'teda comparison tax bill as to what a North Bannock County Fire D.a,lidr\lwerCounty Fire District residence pays in comparison to a Chubbuck rest .'CoUnCftman. Kearns suggested .the Council consider negotiating the fire fighting district a~ts and gefthem to the amounts they should be.
