Present: Mayor Steven M. England, Council members Leroy S. Quick, Kent Kearns, Dennis Stoddard, RichatdM()rgan, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to otder at 7:30 p.m. by Mayor England. PLEDGE ALLEGIANCE TO THE FLAG was led by Councilman Quick. APPROVAL OF MINt..1'1'BS .. Mayor England asked for corrections or additions to regular meeting minutes 'Of October 24th, 2006. Councilman Kearns moved to approve the regular meeting minutes of October 24t\ 2006 as read, with COr1'ection of typos, Councilman Quick seconded. All council members voted in favor of motion. PARK MEADOWS 9TH ADDITION FINAL PLAT - Darris Ellis, 4470 Wasatch presented the Park Meadows~Addition Final Plat. PWD Smart stat~Staffrecommends approval of the Park Meadows 9th Addition Final Plat as presented. Councilman Morgan moved to approve the Park Meadows 9th Addition Final Plat as presented, Councilman Quick seconded. All council members voted in favor of motion. BUSINESS LICENSE APPLICATION - Gene Kelly, 24535 N.W. Green Mountain Road, Banks, Oregon..... ..;....90/:.. ii..... _.. .0. 6..,iSant... ......... a. '.8. ..;ForestChristmas Trees has applied for a business license to sell Christ~kees on the east side of the Green Triangle Parking Lot. All departmentstee()mmended approval of the business license application. Councilman Stoddard moved to grant Gene Kelly, Santa's Forest Christmas Tree a business license to sell Christmas trees from the east side of the Green Triangle Parking Lot, subject to.Pire;Department inspection of the Christmas tree lot, Councilman Kearns seconded. November 14th, 2006 CHILD CARE F ACILlrY LICENSE - Tres Kinghorn, 5014 Liberty Street, Chubbuck, Idaho, Shooting Stars Day Care and Preschool has applied for a child care facility license to operate a day care and preschool at her residence at 5014 Liberty, Chubbuck. Tres Kinghorn, 5014 Liberty was present to answer questions the Council might have. All departments recommended the day care application be approved. Councilman Morgan moved to grant Tres Kinghorn, Shooting Stars Day Care and Preschool a child care facility license to operate Shooting Stars Day Care and Preschool at her residence at 5014 Liberty, Councilman Quick seconded. All council members voted in favor of motion. RESOLUTION #15-2006 - Amending the rates to be charged by the City for wastewater collection and treatment services furnished through the Municipal Wastewater System. PWD Smart stated the City ofPocatello adopted by resolution wastewater capacity fees. PWD Smart said under our contract the City of Chubbuck is obligated to pass the capacity fees for the treatment plant to City of Chubbuck customers. Councilman Kearns moved to adopt Resolution #15-2006 as read, Councilman Stoddard seconded. All council members voted in favor of motion. ORDINANCE - Amending Section 1.12.010 to provide for misdemeanor penalties of up to one thousand dollars or six months in jail or both. Attorney Holmes read ordinance by title only for the first reading. Council tabled the proposed ordinance until the November 28t\ 2006 Council Meeting. ORDINANCE #628 - Adopting Ordinance Section 18.06.200; definition for residential rental dwelling; amending Section 18.08.040, schedule of General Controls as to residential use; adopting Section 18.12.030 (P) specifying procedures to obtain a permit for a residential dwelling. Attorney Holmes presented the changes proposed from the October 24t\ 2006 Council Meeting. Attorney Holmes read Ordinance #628 by title only for the third reading, one of which was in full. Councilman Keamsstated he opposes the ordinance because he feels Ordinance #628 blurs definition of(R-2) and duplexes, opening the door for duplexes to be put in any neighborhood. C()l111cilman Kearns stated he is opposed to restrictive covenants as a way of enforcing where duplexes are allowed. Councilman Morgan moved to adopt Ordinance #628 as read, Councilman Quick seconded. Roll Call Vote: Quick, yes; Kearns, abstained; Stoddard, yes; Morgan, yes. Motion passes 3..). ORDINANCE - Adopting Section 13.04.025 rate relief. Mayor England presented the Rate Relief Ordinance. Attorney Holmes r-ead ordinance by title only for the first reading. Council tabledtbeordinancc\Jhlil the November 28th, 2006 Council Meeting. GENERAL DISCUSSION - 1. Dams Ellis expressed concern that when a developer presents and gets approval of a preliminary plat, things change, the market changes, the developer might have to come to the City and change his plans. Mr. Ellis asked the Council might consider giving relief if this happens. Mr. Ellis showed a proposed Park Meadows 10th,1lth & 12th Addition. All these are twin homes, Mr. Ellis stated the twin home proposal helps elderly people because of the cost of a unit. Mr. Ellis stated he is going to propose the Park Meadows lOth, 11 th &, 12th Addition to Land Use & Development Commission. CLAIMS - Computer print-out claims presented to Mayor England and Council. Councilman Morgan moved to approve computer print-out claims as presented, Councilman QUick seconded. All council members voted in favor of motion.
