Present: Mayor StevenM. England, Council members Leroy S. Quick, Kent Kearns, Dennis Stoddard, Richard Morgan, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to <<defat 7:35 p.m. by Mayor England. PLEDGE ALLEGIANCE TO THE FLAG was led by Councilman Richard Morgan. APPROV ALOF MINU~>iMaY()tEngland asked for corrections and additions to the Special Meeting Minutes of August ~t!d, 2006 and Regular Meeting Minutes of August 22nd, 2006. Councilman Kearns moved to approve the Special Meeting Minutes of August 22nd, 2006 and Regular Meeting Minutes of August 22nd, 2006 as read, Councilman Morgan seconded. All council members voted in favor of motion. POLICE DEPARTMENT RECOGNITION - Tracy Beeton, Millie Flandro and Tracy McCulloch, Healt;hyPtomises for Healthy Youth recognized Police Chief Randy Severe and Corporal Todii Orrfor their partnership and involvement with the Asset Building Program. PUBLIC HEARING - Ordinance to repeal Section 18.04.05 and adopting Chapter 18.06 definitions, including definition for Residential Rental Dwelling. Mayor England_lared the public hearing open, there being no comment, Mayor England declared the public bearing closed. Councilman Stoddard moved to dispense with the rule of reading Ordinance #620 on three separate days, Councilman Kearns seconded. Roll Call Vote: Quick, yes; Kearns, yes; Stoddard, yes; Morgan, yes. September 12th, 2006 GROVE SUBDIVISION PRELIMINARY PLAT DIVISION NO. 1 - This subdivision is going through the commned City-County process. It is positioned on the west side of Philbin Road and such that we can annex it following annexation of McNabb property. Bannock County is askingfot Council recommendations on the development, along with construction standards. Brian Flynn, RMEpresented the Grove Subdivision Preliminary Plat Division No. 1. PWD Smart stated the Land Use & Development Commission recommended the City Council provide City Water and Sewer Service to Grove Subdivision, subject to the Grove Subdivision annexing into the City. Councilman Moram moved to approve providing City of Chubbuck Water and Sewer Services to the Grove Subdivision, subject to the following requirements; 1) Bannock County requiretbe developers of Grove Subdivision develop in accordance with City of Chubbuck Standards, 2) Grove Subdivision annex into the City of Chubbuck, Councilman Quick seconded. All council members voted in favor of motion. RESOLUTION #11-2006 -Changingthe designation of Kimball Avenue, as approved in Briscoe Estates Subdivision 4th Addition to Kymball Ave. Attorney Holmes read Resolution #11-2006 in full. Councilman Morgan moved to adopt Resolution #11-2006 as read, Councilman Stoddard seconded. All council members voted in favor of motion. CAMBRIDGE EST ArES DIVISION NO.2 FINAL PLAT - Brian Flynn, RME presented the Cambridge Estates Division No.2 Final Plat. PWD Smart stated Staff recommends approval of the Cambridge Estates Division No.2 Final Plat. S~ptember 12t\ 2006 NATIONAL POLLUTION PREVENTION WEEK - SEPTEMBER 18TH, 2006 - SEPTEMBER 23RD, 2006 - Mayor England read the proclamation in full. Councilman Morgan moved to authorize Mayor England to proclaim September 18th, 2006-September23rd, 2006 as National Pollution Prevention Week, Councilman Quick seconded. All council members voted in favor of motion. ORDINANCE #621 - Providing for change of Land Use District with respect to certain lands namely Hartland Estates Subdivision and all phases there oflying within the boundaries of the City of Chubbuck. Mayor England read Ordinance #621 by title only for the first and final reading. Councilman Kearns moved to dispense with the rule of reading Ordinance #621 in full and on three separate days, Councilman Stoddard seconded. Roll Call Vote: Quick, yes; Kearns, yes; Stoddard, yes; Morgan, yes. Councilman Kearns moved to adopt Ordinance #621 as read, Councilman Stoddard seconded. POLICE DEPARTMENT LIST OF SURPLUS EQUIPMENT, VEHICLES, ETC - Police Chief Randy Severe presented a list of surplus equipment, vehicles, etc. for disposal at public auction on Septetnber 16th, 2006, contracted through Prime Time Auctions. (List attached). Councilman Morgan moved to authorize Chubbuck Police Department to dispose of surplus equipment, vehicles,etc as presented, Councilman Kearns seconded. All council members voted in favor of motion. ACCEPTANCE OF DEDICATIONS - for Cambridge Estates Division No.1, Park Meadows 4th Addition, Park Meadow Sth Addition, Hartland Estates Phase II, Hartland Estates Phase III, Hartland Estates Phase IV, TaylorMade Estates and Cottage Park 1 st Addition. PWD Smart recommended approval of the Acceptance of Dedications. Councilman Kearns moved to approve the Acceptance of Dedications for Cambridge Estates Division No. 1, Park Meadows 4th Addition, Park Meadows 5th Addition, Hartland Estates Phase II, Hartland Estates Phase III, Hartland Estates Phase IV, TaylorMade Estates and Cottage Park 1 it Addition as presented, Councilman Morgan seconded. September 12th, 2006 ORDINANCE - Amending Section 2.28.020 of the Chubbuck Municipal Code to remove obsolete provisions with respect to the Land Use & Development Commission. Attorney Holtt1e$read ordinance in full for the ftrst reading. Councilman KeatnS suggested paragraph (E) state a chairman be elected annually. Attorney Holmes stated hewiU make the changes for the September 26th, 2006 Council Meeting. Councilman Quick moved to table the ordinance until the September 26th, 2006 Council Meeting, Councibnan Stoddard seconded. All council members voted in favor of motion. RESOLUTION - Confttming seats to be ftlled by current members ofthe Land Use & Development Commission. Councilman QuiCk moved to table the resolution until the September 26th, 2006 Council Meeting, Councilman Stoddard seconded. All council members voted in favor of motion. CHUBBUCK FIRE DEPARTMENT PROPOSED SERVICE CHARGE AND FEE SCHEDULE Fire Chief Eric lUng presented a proposed Fire Department Service Charge and Fee Schedule. (Attached). Councilman'K~~v<<l to direct City Clerk Ron Conlin to publish the proposed service chargeatld fee schedule as required by Idaho Code, for the public hearing to be conducted, Sept__:2(ilh, 2006, Councilman Morgan seconded. All council members voteditt favor of motion. .. CLAIMS - Computer print..out claims presented to Mayor England and Council. Councilman Keams moved to approve computer print-out claims as presented, Councilman Morgan seconded. All council members voted in favor of motion. GENERAL DISCUSSION- 1. Dams Ellis, 922 Sawtooth stated he is working with property owners north of Homestead Estates and would like clariftcation on what is needed to develop. Mr. Ellis was told City Water and Sewer out of the Urban Service Boundary is not available as of yet. PWD Smart stated the Cole Street Bridge will be required, and the City will also require a road out to Siphon Road. Dams Ellis asked for the requirements in writing.
