Present: Mayor StevenM.England, Council members Leroy S. Quick, Kent Kearns, Dennis Stoddard, Richard Morgan, ,Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Attorney Thomas J. Holmes was excuSed. , -f- ~, ". Meeting called to order at 1:30 p.m. by Mayor Steven M. England. PLEDGE ALLEGIANCE TO THE FLAG was led by Councilman Richard Morgan. INVOCATION was given by Bishop Del Butler, 48th Ward, The Church of Jesus Christ of Latter-Day Saints. APPROVAL OF M.lNUTES . Mayor England asked for corrections and additions to the Special Meeting Minutes of July 25th, 2006 and Regular Meeting Minutes of July 25th, 2006. Councilman Keams.moved to approve Special Meeting Minutes of July 25th, 2006 with the following corrections; 1) Page 147, Sewer Connection Fee, $1,000 plus pass through sewer capacity charges from the City ofPocatello, 2) Spelling corrections, and July 25th, 2006 Regular Meeting Minutes as read, Councilman Morgan seconded. All council members voted in favor of motion. SPRING PARK RESIDENTIAL INFILL PLANNED UNIT DEVELOPMENT FINAL PLAT _ David Romriell, Harper-Leavitt Engineering presented the Spring Park Residential PUD Final Plat. Mayor England stated the items to be altered and added to the Restrictive Covenants were addressed and complied with. Discussion about waler rights. Councilman Kearns moved to approve the Spring Park Residential Infill Planned Unit Development Final Plat as presented, Councilman Quick seconded. All council members voted in favor of motion. PUBLIC HEARING. An application by the City of Chubbuck to abandon various easements for street construction in and adjacent to Mingo Subdivision. These easements affect properties adjacenUo Adams Street and Lucky Street in the City of Chubbuck. PWD Smart presented the application by the City to abandon various easements for street construction in and.adjacent to Mingo Subdivision. I I I 163 COUNCIL MEETING MINUTES - (cont.) July 25th, 2006 PUBLIC HEARING- ABANDON VARIOUS EASEMENTS - (cont.) PWD Smart stated John Bamhisel, Don and Gail Higgins would like to purchase an easement curreritfyOWneCibythe City of Chubbuck. The easement is located in the Mingo Subdivision. Pwn Smart stated it would be difficult for the City to sell its interest in the easement because of State Code. PWD Smart stated if the City would vacate the easements the property would revert to the owner of the real estate, then the owner would be in a position to negotiate a sale with anybody who wanted to purchase the access. Council reviewed the easements on an address map. PWD Smart stated after discussion in Staff Meeting, Staff felt it is in the best interest of the City to abandon the easements. Mayor England declared the public hearing open. John Barnhisel, 5281 Lucky stated he needs the access to and from his back yard. Mr. Bamhisel expressed concern everyone involved was not notified of this hearing. Mr. Barnhisel said there.are more residents interested in getting access to and from their back yards. Faye Burrows, 302 Adams stated her husband and her did not know there was an easement. Mrs Burrows spoke in favor of the easement across her property being done away with, it is of no use to anyone. Earl Romriell, 420()Philbin #5 stated he owns 5 acres that has an easement on it, Mr. Romriell needs thceasement for development of his 5 acres. Mr. Romriell spoke against the easement at29S Adams being abandon. Alan Romriell, 1264 Palmer Lane, Pocatello, Idaho spoke against the easement at 295 Adams being abandon. Gail Higgins, Lot 3,.Block 1, Mingo Subdivision stated her husband and her are developing the lot and need the easement. Todd Clement, 5280 Stuart spoke in favor of keeping the easements because it gives him access to his backyard. I I I 165 COUNCIL MEETING MINUTES - (cont.) July 25th, 2006 PUBLIC HEARING - ABANDONING VARIOUS EASEMENTS - (cont.) Gary Anderson, 410Adams, owner of Lot 6 and Lot 7 said he purchased the lots a year ago with the idea of developing Lot 6 and Lot 7, remove the existing homes there, then build stick built single family residences. Mr. Anderson spoke in favor of leaving the easements as they are. There being no further public testimony, Mayor England declared the public hearing closed. Councilman Stoddard moved to approve the application by the City of Chubbuck to abandon various easements for street construction in and adjacent to Mingo Subdivision as presented with the exception of the easements on 295 and 301 Adams and Lot 5, Block 2, Mingo Subdivision, Councilman Quick seconded. All council members voted in favor of motion. PROPOSED INCREASE TO WATER AND SEWER RATES ALONG WITH IMPLEMENTING W ATBR AND SEWER CONNECTION FEES - PWD Smart presented the following proposed water and sewer rates, including water and sewer connection fees. Water Sales $ 17.70 per equivalent dwelling unit. $ 3.30 billing charge $ 1.05 per 1000 gallons $ 2,250.00 per equivalent dwelling unit. Water Volumetric Rate Water Connection Fee Wastewater Monthly Service Rates V olumetricRate $ 17.50 per equivalent dwelling unit 2.17 per 1000 gallons metered water customers North ofI-86 $ $ 2.70 per 1000 gallons metered water customers south ofl-86. $ 1.35 billing charge Sewer Connection Fee $ 1,000.00 per equivalent dwelling unit. Including any pass through costs from the City ofPocatello. Councilman KeamsStated the $1,000 sewer capacity fee will include any pass through the City ofPocatelloadds on for their expansion of sewer capacity. I I I 167 COUNCIL MEETING MINUTES - (cont.) July 25th, 2006 PROPOSED WATER AND SEWER RATES AND IMPLEMENTATION OF WATER AND SEWER CONNECTION fEE - (cont.) PWD Smart stated the water connection fee is based on recommended capital improvements. . Tliesewer connection fee is based on the equity buy in of the existing sewer system. Mayor Englanddeclat'edthe public hearing open. John Boyle, 4891Cole stated he felt the water and sewer rates proposed are too high. Mr. Boyle said the developers shOUld pay more for the new connection fees. Syd Wood, 1303 Oelphic, Pocatello representing the Builder Contractors Association of SE Idaho and his Qwn business. Mr. Wood spoke against the water and sewer connection fees. Mr. Wood ~ted. he supports good water and sewer services, but would like to see the connection r_accomplished in an equitable way. Mr. Wood explained why he is opposed to a i~~connection fee. Susan Dewey,~BltSc"lliretary, 770E. Chubbuck Road asked that before a decision is made tonight everyone sit dOW'l),and come to an agreement on the water and sewer connection fees. Kim Weber, D.L.EV8llSBankManager, 5013 Redfish expressed concern about what the water and sewer connection fees impact will do to the area. Mr. Weber asked the following questions: 1. What is the motivation for the water and sewer connection fees. 2. What is the impact on City Revenues. Would like a fact sheet. 3. Why are the water and sewer connection fees presented this way. Mayor EnglandsufJgeSfed Mr. Weber leave the questions with the City, the questions will be addressed by the City. Becky Ponkow, 2S4James Ave asked the Council to postpone the decision tonight. There are some questionstbat need to be answered. Mrs. Ponkow stated she will leave questions to be addtessed alSo. Darris Ellis, 922 ~O()th sPOke against water and sewer impact and connection fees. July 25th, 2006 PROPOSED WATER AND SEWER RATES AND WATER AND SEWER CONNECTION FEE IMPLEMENTATION - Dean Kreger, SE Chapter offhe Home Builders Association, Pocatello, Idaho spoke against the water and sewer cOl11lection fees. Mr. Kreger explained why, suggesting the decision be postp()ned tonight. There being no further comment, Mayor England declared the public hearing closed. PWD Smart responded to some. of the questions. Mayor England stated we have learned some concerns tonight that will be taken under consideration. Council tabled the proposed water and sewer rates along with water and sewer connection feesuntif the August 8lh, 2006 Council Meeting. CLAIMS - Computer print-out claims presented to Mayor England and Council. Councilman QUickrnoved to approve the computer print-out claims as presented, Councilman StOddard seconded.
