APPROVAL OF MINUTES: September 20, 2023.
Councilmember Heiner motioned for approval of the Council Meeting minutes.
Councilmember Reece seconded motion for approval of minutes.
Roll Call: Evans -yes, Hernandez -yes, Reece -yes, Heiner -yes, motion passed.
GENERAL BUSINESS:
1. Approval of Pauline Flats Preliminary Plat and the findings, facts and conclusions of law.
(Council will discuss the application and if it meets City code).
Development Services Manager Sean Harris stated that this application had been
reviewed by City Staff and appears to meet the standards of Titles 16, 17 and 18 of City
Code, and recommended approval with conditions.
Councilmember Heiner motioned to approve Pauline Flats Preliminary Plat including the
findings, facts and conclusions of law as presented by City Staff.
Councilmember Hernandez seconded motion for approval.
Roll Call: Hernandez -yes, Reece -yes, Heiner -yes, Evans -yes, motion passed.
2. Acceptance of Offer of Dedication for Patriot Square Subdivision - East.
(Council will discuss if all city requirements have been inspected and completed).
Councilmember Hernandez motioned for acceptance of offer of dedication for Patriot Square
Subdivision - East. as presented. Councilmember Evans seconded motion for acceptance.
Roll Call: Reece -yes, Heiner -yes, Evans -yes, Hernandez -yes, motion passed.
3. Review and Accept Bid for Sanitary Sewer CCTV Inspection Project.
(The Council will Discuss and Possibly Authorize the Mayor to Enter into a Contract).
Public Works Director Bridger Morrison presented the Sanitary Sewer CCTV
Inspection Project bid.
Councilmember Hernandez motioned to approve the Sanitary Sewer CCTV Inspection Project
and authorize the Mayor to enter into a contract with Integrity Inspection Solutions in the amount
of $635,110.45 as presented. Councilmember Heiner seconded motion for approval.
Roll Call: Heiner -yes, Evans -yes, Hernandez -yes, Reece -yes, motion passed.
4. Acceptance of the City Clerks Declaration of Elected for Dan Heiner Council Seat #1 and
Norfnan Reece Council Seat #4 pursuant to Idaho Code 50-405.
(Council will discuss that such candidates are duly elected for their respective terms, and will be
installed at the first city council meeting in January).
Councilmember Evans motioned for approval of the City Clerks Declaration of Elected for Dan
Heiner Council Seat #1 and Norman Reece Council Seat #4 pursuant to Idaho Code 50-405.
Councilmember Hernandez seconded motion for approval.
Roll Call: Evans -yes, Reece -yes, Heiner -yes, Hernandez -yes, motion passed.
5. Discussion and Adoption of Ordinance 865 Title 18 Hotels or Motels.
(Council will discuss updates to sections of title 18 of city code).
Planning Manager Don Matson presented a definition for the functions of hotels and
motels, and limits their locations to the General Commercial (C-2) zone. Extended stay
facilities are a residential use and fall under the definition of apartments.
Councilmember Reece motioned for the waiver of three readings, including the reading of one
time in full for Ordinance 865.
Councilmember Heiner seconded motion for waiver.
Roll Call: Reece -yes, Heiner -yes, Hernandez -yes, Evans -yes, motion passed.
Councilmember Hernandez motioned for adoption of Ordinance 865 as presented.
Councilmember Evans seconded motion for adoption.
Roll Call: Heiner -yes, Hernandez -yes, Evans -yes, Reece -yes, motion passed.
CLAIMS:
1. City of Chubbuck claims for October 18, 2023 as presented to Mayor England and
Council.
Councilmember Reece motioned to approve the City of Chubbuck Claims as presented.
Councilmember Hernandez seconded motion for approval.
Roll Call: Hernandez -yes, Evans -yes, Reece -yes, Heiner -yes, motion passed.

Declaration of the City Clerk
I, Joey Bowers, City Clerk for the City of Chubbuck, pursuant to Idaho Code § 50-405 do hereby
declare the following individuals elected, and to be installed at the first city council meeting in 2024:
(1) for Seat No. I Dan Heiner for a term of 4 years, and (2) for Seat No. 4 Norman G. Reece, Jr. for a
tern of 2 years. This Declaration is made based on the following:
Idaho Code § 50-405 states, inter alfa, that "(1) A general election shall be held in each city
governed by this title, for officials as in this title provided, on the Tuesday following the first Monday of
November in each odd -numbered year. All such officials shall be elected and hold their respective
offices for the tern specified and until their successors are elected and qualified. All other city elections
that may be held under authority of general law shall be known as special city elections." Idaho Code §
50-405(2)(a) then states that "No city election shall be held for an office if, after the deadline for filing a
declaration of intent to be a write-in candidate for the office, it appears:...
(ii) For the office of city council member in cities that have established designated seats, as
provided in section 50-707, Idaho Code, only one (1) person has filed a declaration of candidacy
or a declaration of intent to be a write-in candidate for a particular seat up for election for a two
(2) year term or a four (4) year term;....
Since the City of Chubbuck has established designated seats, and the time for filing a declaration
of candidacy or a declaration of intent to be a write-in candidate for a particular seat has nun, and only
one person has declared for Seat No. 1 (Dan Heiner) and for Seat No. 4 (Norman G. Reece, Jr.), it is
appropriate pursuant to Idaho Code § 50-405(2)(b), to make the above declaration that these candidates
are to be declared elected, receive a certificate of election and be installed at the first city council
meeting in January following the election.
