APPROVAL OF MINUTES: August 2, 2023,
Councilmember Reece motioned for approval of the Study Session and Council Meeting minutes.
Councilmember Heiner seconded motion for approval of minutes.
Roll Call: Reece -yes, Heiner -yes, Hernandez -yes, Evans -yes, motion passed.
GENERAL BUSINESS:
1. Approval of J.L Estates Preliminary Plat and the findings, facts and conclusions of law.
(Council will discuss the application and if it meets City code).
Adam Thayer from Dioptra represented the applicant. Mr. Thayer presented a 7 lot
Preliminary Plat for 4 twin home building lots, 2 single family residential building lots
and 1 non -buildable lot, which also includes constructing a private drive for access and
providing water and sewer services to all buildable lots.
Development Services Manager Sean Harris stated that this application had been
reviewed by City Staff and appears to meet the standards of Titles 16, 17 and 18 of City
Code, and recommended approval with conditions.
Councilmember Hernandez motioned to approve J.L. Estates Preliminary Plat as presented,
including the findings, facts and conclusions of law as presented by City Staff.
Councilmember Heiner seconded motion for approval.
Roll Call: Heiner -yes, Hernandez -yes, Evans -yes, Reece -yes, motion passed.
2. Approval of J.L Estates Final Plat and the findings, facts and conclusions of law.
(Council will discuss the application and if it meets City code).
Adam Thayer from Dioptra represented the applicant, and presented a Final Plat.
Development Services Manager Sean Harris stated that this application had been
reviewed by City Staff and appears to meet the standards of Titles 16, 17 and 18 of City
Code, and recommended approval with conditions.

findings, facts and conclusions of law as presented by City Staff.

3. Discussion and Possible Adoption of Ordinance 861 for the Annexation of approximately
22.67 acres of land located at the northwest corner of Philbin Road and Angela Street,
also known as Miller Park.
(Council will discuss the annexation of 22.67 acres into the City limits).
Community Services Director Devin Hillam presented an application for initial
designation of property into the Limited Residential (R-2) Land Use District (zone) that
is proposed to be annexed into the City of Chubbuck. The subject property comprises
approximately 22.67 acres of land located at the northwest corner of Philbin Road and
Angela Street, also known as Miller Park. This parcel and an adjacent lot were purchased
several years ago for development as a city park and a fire station, with a combined area
of over 31 acres. The other parcel, along the north side of Angela St and south of this
parcel, was annexed in 2007. A city -owned secondary pressurized irrigation pump station
is located on the northwest corner of the property. Surrounding parcels are built with
suburban (single-family) and rural (large lot) residential development.
Councilmember Heiner motioned for the waiver of three readings, including the reading of one
time in full for Ordinance 861.
Councilmember Hernandez seconded motion for waiver.

4. Discussion and Possibly Authorize the Mayor to sign the loan offer agreement
amendment for the DEQ Drinking Water Loan for Project DW 1602.
Public Works Operations Manager Kami Smoot presented an amendment to the Loan
Offer agreement between the Idaho Department of Environmental Quality (DEQ) and the
City of Chubbuck.
Councilmember Heiner motioned to approve the amendment to the loan offer agreement for
water project DW 1602 as presented.
Councilmember Reece seconded motion for approval.

5. Discussion and Adoption of Ordinance 862 Water Revenue Bond.
(Council will discuss the sale of water revenue bond to the DEQ). (Action Item)

time in full for Ordinance 862.

6. Discussion and Adoption of Ordinance 863 Title 18 Height Limits.
(Council will discuss updates to several sections of title 78 of city code).
Planning Manager Don Matson presented updates to several sections of City Code:
Title 18, Land Use, regarding the height limits of architectural features and various
monuments, and height of buildings in the Village and Highway Corridor land use
districts; and Title 15, Buildings and Construction, regarding the height, width, and
placement of signs, and clarifying standards for temporary signs.
Councilmember Reece motioned for the waiver of three readings, including the reading of one
time in full for Ordinance 863.
Councilmember Heiner seconded motion for waiver.
