Council Meeting Minutes

CALL TO ORDER: Mayor England
PLEDGE ALLEGIANCE TO THE FLAG: Councilmember Evans
COUNCIL PRESENT: Roger Hernandez, Melanie Evans, Dan Heiner, and Norman Reece.
STAFF MEMBERS PRESENT: Mayor Kevin England, City Attorney Ryan Lewis, Public Works
Director Bridger Morrison, Fire Chief Merlin Miller, Public Works Operations Manager Kami
Smoot, Community Services Director Devin Hillam, Police Chief Nick Sasser, Development
Services Manager Sean Harris, Human Resource Director Scott Gummersall, City Treasurer
Rich Morgan, and City Clerk Joey Bowers.
APPROVAL OF MINUTES: July 19, 2023.
Councilmember Heiner motioned for approval of the Council Meeting minutes.
Councilmember Hernandez seconded motion for approval of minutes.
Roll Call: Hernandez -yes, Heiner -yes, Reece -yes, Evans -recused, motion passed.
PUBLIC HEARING:
1. A proposed budget for the fiscal year 2024 from October 1, 2023, to September 30,
2024, and the consideration of the proposed use or reserve of forgone property taxes
pursuant to Idaho code 50-1002.
City Treasurer Rich Morgan presented a proposed tentative budget for FY24, and
reviewed the budget schedule; which included presentations and discussions on:
policies/goals, estimated general fund revenue and human resource expenses, budget
presentations by departments, special meetings, and incorporated feedback from the
Council. Mr. Morgan also went over the expiring 1992 urban renewal district and stated
that even though some of those funds were corning back to the City's general fund they
are significantly less than what was being allocated through the Chubbuck Development
Authority towards City streets over the last 30 years.
Mayor England declared the public hearing open for public comment.
Resident Roger Schei, was Neutral. Mr. Schei asked about forgone property taxes and
was concerned about road maintenance, weed control, and property maintenance
throughout the City.
Resident Rodney Burch, was Neutral. Mr. Burch supported the proposed water,
wastewater, and sanitation budgets but had some concerns and needed clarification on the
proposed general fund budget. Mr. Burch asked about future planning and who had the
authority to make changes to an adopted budget.
Resident Jason Mendenhall, was Neutral. Mr. Mendenhall recommended funding a
Deputy Fire Chief and Deputy Police Chief. Mr. Mendenhall also asked about the
Northwest Sewer Interceptor.
Resident Boyd Byrd, was In Favor. Mr. Byrd went over the proposed budget and
thanked City Staff for their open door policy and always being willing to answer his
questions. Mr. Byrd felt like the City of Chubbuck does a great job providing services to
the residents. Mr. Byrd was in favor of taking the proposed forgone to meet the needs of
the City.
Resident Jeff Hough, was Neutral. Mr. Hough thanked City Staff for their open door
policy and being willing to answer his questions. Mr. Hough questioned the need for
additional fire personnel and asked the council to postpone hiring additional personnel for
at least another year. Mr. Hough was supportive of hiring a Deputy Fire Chief and
Deputy Police Chief. Mr. Hough also recommended not taking any additional forgone.
Resident David Hall, was Neutral. Mr. Hall felt like that all the city departments use
these monies effectively and efficiently, and appreciated the change in the budget process
to gather additional information and the increase in public transparency. Mr. Hall asked
about future planning and service levels. Mr. Hall also asked if the extra fire personnel
was to meet an increase in EMS needs.
Resident Roger Schei, was Neutral. Mr. Schei asked about City Parks and was
supportive of the needs within emergency services and police.
Resident and Chair of the Chubbuck Development Authority Annette Baumeister, was
In Favor. Mrs. Baumeister stated that the proposed expenditures in the general budget
had been planned for years and that the fire department had made many sacrifices with
the understanding that the funds from the expiring 1992 urban renewal plan would be
used for emergency services including extra personnel. Mrs. Baumeister was also in favor
of taking the proposed forgone to meet the needs of the City.
Due to no more public comment Mayor England closed the public hearing.
City Treasurer Rich Morgan responded to Mr. Schei' s question about forgone
property taxes and went over the difference between taking 1 % and 3%. The 3% can only
be taken for capital projects. Mr. Morgan also responded to Mr. Burch's questions and
stated that the- Council are the only ones that have the authority to make changes to an
adopted budget. The proposed increases in the general fund had been budgeted towards
police, emergency services, community services, street maintenance, wage and
wage related expenses, and additional personnel. Mr. Morgan also stated that the City had
about 10 more years before the Northwest Sewer Interceptor would be paid off.
Community Services Director Devin Hillam stated that the City had made changes to
move towards building larger destination parks and away from smaller neighborhood
parks.
Chief Merlin Miller stated that the requested additional personnel is to help maintain
the same level of service for EMS calls and to assist with the increase in overlapping
calls.
Public Works Director Bridger Morrison stated that they would take any funding that
the Council provided towards street maintenance and make them stretch as far as they
could, but the proposed budget still does not meet the needs as recommended by the
street study to maintain the same levels of service.
GENERAL BUSINESS:
1. Discussion and Possible Adoption of Ordinance 860 Appropriations for FY2024.
(Council will discuss the possible adoption of a budget for FY24).
Councilmember Hernandez moved to adopt the proposed budget as presented.
Councilmember Reece motioned for the waiver of three readings, including the reading of one
time in full for Ordinance 860.
Councilmember Heiner seconded motion for waiver.
Roll Call: Heiner -yes, Reece -yes, Hernandez -yes, Evans -yes, motion passed.
Councilmember Hernandez motioned for adoption of Ordinance 860 Appropriations for FY24 as
presented. Councilmember Heiner seconded motion for adoption.
Roll Call: Evans -yes, Heiner -yes, Reece -yes, Hernandez -yes, motion passed.
2. Discussion and Possible Adoption of Resolution 2023-08 Forgone Property Taxes.
(Council will discuss the proposed use or reserve of forgone taxes)
Councilmember Heiner motioned for adoption of Resolution 2023-08 Forgone Property Taxes as
presented. Councilmember Hernandez seconded motion for adoption.
Roll Call: Heiner -yes, Reece -yes, Evans -yes, Hernandez -yes, motion passed.
3. Approval of the Updated Vehicle Use Policy.
(Council will discuss the updates to the vehicle use policy).
Human Resource Director Scott Gummersall presented an updated vehicle use policy
that would allow police personnel that live within a 30 miles radius of the police station
the use of a patrol car to commute back and forth.
Councilmember Reece motioned for approval of the updated vehicle use policy as presented.
Councilmember Hernandez seconded motion for approval.

4. Discussion and Possible Approval of Changes to Briarwood Park.
Public Works Director Bridger Morrison asked if the Council had any questions.
Councilmember Hernandez motioned for approval of the storm water changes to Briarwood Park
as presented during their August 2, 2023 study session.
Councilmember Evans seconded motion for approval.
Roll Call: Hernandez -yes, Evans -yes, Heiner -yes, Reece -yes, motion passed.
5. Review and Accept bid for City Hall Park to Seasons West.
(The Council will Discuss and Possibly Authorize the Mayor to Enter into a Contract for park
improvements by city hall).
Community Services Director Devin Hillam presented a bid for the city hall park and
stated that the funding for this park was from a Blue Cross of Idaho Foundation grant.
Mr. Hillain stated that the bid came within the proposed budget but recommended
removing the cement ping pong tables from the awarded bid due to costs.
Councilmember Evans motioned to approve the proposed park amenities at the City Hall Park
minus the cement ping pong tables as recommended and authorize the Mayor to enter into a
contract with Seasons West in the amount of $124,590 as presented.
Councilmember Hernandez seconded motion for approval.

6. Review and Accept bid for the 2023 Asphalt Maintenance Project to Depatco.
(The Council will Discuss and Possibly Authorize the Mayor to Enter into a Contract for asphalt
maintenance).
Public Works Director Bridger Morrison presented the 2023 Asphalt Maintenance
Project bid and stated that this bid came in under the proposed budget. The street
department is planning to work with the contractor and add a few more streets to the list
this year during a future council meeting.
Councilmember Heiner motioned to approve the 2023 Asphalt Maintenance Project and
authorize the Mayor to enter into a contract with Depatco in the amount of $266,665 as
presented. Councilmember Hernandez seconded motion for approval.

7. Acceptance of Offer of Dedication for Arbor Court.
(Council will discuss if all city requirements have been inspected and completed),
Councilmember Reece motioned for acceptance of offer of dedication for Arbor Court as
presented. Councilmember Heiner seconded motion for acceptance.
Roll Call: Reece -yes, Hernandez -yes, Evans -yes, Heiner -yes, motion passed.
CLAIMS:
1. City of Chubbuck claims for August 2, 2023 as presented to Mayor England and
Council.
Councilmember Heiner motioned to approve the City of Chubbuck Claims as presented.
Councilmember Hernandez seconded motion for approval.
Roll Call: Hernandez -yes, Evans -yes, Heiner -yes, Reece -yes, motion passed.
