Minutes of the recessed meeting of October ~0, 1967, held in the Municipal Building of
the City of Chubbuck, on November 8, 19670
Pre~ent- Hillman, Henry, Buchanan, Taylor and McDevitt.
Absent- Underwood.
Called to order 8:00 P.M.
Purpose- Official Canvas of Election Results.
Ballot Box then unlocked, Tally and Pole Books removed, and returns officially
checked by Mayor, Council and residents present in the audience. Results as
follows: Hillman-2A1, Twiggs-2A7. (Mayor). For Councilman Anderson-2~. Thompson-237.
Taylor- 221 in one Tally book and 227 in the other Tally book. The discrepancy in
the count on Taylor caused the Council and Mayor to postpone certification of the
results until all legal questions are answered. Mary Brennan, Senior Judge of the
election was present and stated that confusion at the polls caused the election
officials to become confused and may have caused the difference in count in the
Tally books. McDevitt asked her if there was any confusion during the counting of
the votes and she answered "no". Hillman announced that he would call for a recount.?
After discussion the Council and Mayor decided to put all the election books back
in the Ballot Box with the Ballots, lock the Ballot Bax and have it taken to the
Sherrif's Office, to be kept in custody there until the next regular meeting and
thus give the Attorney's time to answer the legal questions involved.
Motion was made by Buchanan, seconded by Henry, that this meeting be recessed till
we have more information. All in favor of the motion.
All candidates are to be oresent at the next regular meeting on November 1~, 1967.
Clemk asked all candidates if they n~ed to be called to remind them of the~next
meeting and they all agreed that they~'~ufficient notice at this meeting, and would
be oresent at the next meeting.

To you~ question of what is the proper procedure $o be
followed comeerning the failure of ~he election books to coincide.
You are instructed if the City Council has found a dis-
crepancy in the books or in the returns of the election or in
their canvaa, s that the City Council should no~i~ the Sheriff of
the Couaty C in whose possession the ballots a~d books ah. Ould be
placed for aafekeepin~) that they, the City Council, reject the
returns of the election Judges.
The Sheriff should then notify the election Judges and
clerks to meet under his'supervision, or one of his deputies, at
the polling place of the Precinct involved and that the election
Judges shottld thereupon correct their records to truly reflect the
results of :the election. That the election Judges may re-examine
the ballots at such time a~d place if' nsOessary. That it is proper
.that other persons of the public or representatives of the candi-
dates be present at such time aad place, as long as they do not
in~erfere in ~he pr~ceedings or a~em~t to ir, fluence the outcome.
The election judges should then certify ~e corrected
returns to the ¢l~y Council, who ~ill Canvass them as usual.

You are instructed ~hat any aggrieved candidate can file
a request in writing with the Office of the Attorney General of the
State of Idaho, together with a filing fee of One _N~tndred Dollars
for each Precinct involved and can seem.we a recounZ under the gen-
eral statutes of the State of Ida_ho. ~is recount may be required,
although it would appear to be unnecessary, even after ~he election
Judges have corrected their records.

ACCOMPLISHED OVER THE NEXT FEW MONTHS AT A RATE COMMENSURATE
WITH YOUR BUDGET.
AS WE HAVE DISCUSSED THESE PLATS SHOULD BE BROUGHT UP TO
DATE AND THEN KEPT UP TO DATE SO THAT THEY CAN BE OF VALUE
IN FUTURE PLANNING AND IN YOUR MAINTENENCE OPERATIONS.
