* Minutes are assuming C-1 zone change is approved, if not, applicant would need to come back to the
Committee for an amended decision based on the R-2 zoning district, and will be required to receive a
Conditional Use Permit.
* Design review approval is not an approval of any other required permits or licenses and is only an approval of
authorized functions of the Committee pursuant to Chapter 18.16 of Chubbuck Municipal Code.
Applicant not present. If Applicant would like a meeting with the Committee to discuss these requirements,
please contact Paul Andrus otherwise, all decisions of the Committee may be appealed if written request for
review is received by the Clerk prior to the conclusion of the next regularly scheduled Council meeting.
1. Traffic Safety and Traffic Congestion: (ingress, egress, off-street parking, unloading)
• Entire lot frontage is okay to remain as access to the lot, applicant plans to have one-way travel lane
around building. Access locations as shown on the plans are approved for one way traffic, as shown.
• Needs minimum of 6 parking stalls or 2 stalls for each classroom, whichever is greater.
• If use or building changes, access and number of parking may need to change based on city code
requirements.
• Committee upholds City Code sections 18.08.046.4-5 that paved drive aisles and off-street parking are
required. Parking stalls shall be striped, be maintained, and comply with the Americans with
Disabilities Act.
• No on-street parking is allowed.
2. Traffic Studies, Utility Studies: (as requested)
• No study required.
• Applicant will need to submit a Traffic Impact Statement.
3. Drainage: (storm & surface water, to be engineered, retained on site)
• In accordance with the adopted Portneuf Valley Stormwater Design Manual, if adding or replacing
5,000 sq. ft. or more of impervious surface, will be required to comply with stormwater requirements
and design would need to include on-site retention for runoff, as required.

4. Pretreatment / Nonresidential Wastewater Permit: (grease or oil/silt separator)
• Will need permit.
5. Development Agreement (when needed)
• Yes, as part of platting process through Development Services.
6. Structures and Site Layout: (exterior design, buffering, fencing, dumpster enclosure)
• Per section 18.12.060 of City Code, 6’ tall solid fencing required along south, east, and north property
lines to prevent intrusion of unwanted light, dust, or blowing debris. per buffering requirements due to
fact that surrounding zoning and uses are Residential.
• Dumpster is likely not serviceable on site but if feasible, it will need to be within an enclosure meeting
requirements of City Code section 18.12.040.D (5’ solid wall/fence, 3 side minimum, adequate
vehicular access)
7. Building Department: (professionally approved plans, ADA compliance, dumpster enclosure)
• Per Ron, interior issues have been worked out, waiting for new plan from drafter.
8. Signs / Advertising: (advertising signs, height, structure)
• Building sign permit application needs to be submitted through Building Department.
9. Landscaping: (ordinance copy, approved tree list)
• Planter boxes in lieu of landscaping strip recommended by committee to help with separation of wide
entry.
10. Exterior lighting: (light shielding, light trespass)
• Need to be below 15’ since in a C-1 zone.
• All lighting to be shielded from trespass off of the site.
11. Development: (platting, addressing)
• Short plat is required.
• Address is 5122 Hawthorne Rd.
12. Fire Department: (knox Box, fire hydrant locations, sprinkling, visible street address)
• Knox box required.
13. Police Department: (safety issues)
• No issues.
14. Business License: (before opening)
• Will need for new location and required to comply with all daycare requirements.
15. Other:
• C-1 zoning and buffering standards require a 6-foot solid fence on any side with residential zoning or
uses. So the north, east, and south property lines all need solid fencing.
