Siphon Rd. Chubbuck, ID 83202  Email: telenamkgirl@yahoo.com  Date: June 29, 2021   Applicants Dave & Telena Hall, presented project. They have ran a preschool out of their home for several years and are ready to expand. This space offers an opportunity to have two classrooms of students instead of one. Their goal is to stick to the same number of students (12) but with more space. Classes are 4-5 days a week, September through May. Also offer summer camps for 3 days. Business offers a unique need in the community, Applicant specified it is an educational program not childcare. 1. Traffic Safety and Traffic Congestion: (ingress, egress, off-street parking, unloading) If site gets redeveloped two accesses points may need to be reduced to one. Concerns about traffic backing up onto Siphon Rd. If that happens Applicant may need to change staggering times. If 5 minute stagger isn’t enough, this would need to be addressed so cars aren’t stopping on Siphon. City Code requires driveway and parking areas to be paved. Applicants had several concerns with requirement: Applicant made reference to other locations in the City that have gravel and are not paved – Committee commented that these facilities were likely established before changes to the code. Any changes in use on this property or other properties would still require paving per City Code. Applicants stated that paving would essentially end the deal for them. The owner has stated he won’t pave and Applicants were told they wouldn’t need to pave when they signed the lease agreement. Applicants are concerned about making major improvements to a building they don’t even own. Applicant’s revenue per year is very minimal so going in to pave will end the deal. Property is flood irrigated from east to west, so paving for parking in the back/side would impede water drainage on the site. Applicant made reference to the previous use of the Dollhouse as a business and they are just wanting to use as a business again. Committee stated the land use table would definitely interpret it as a change of use. Applicant stated they are revitalizing infill space and improving the site. It’s tough to find any commercial space in Chubbuck but they may have to go to Pocatello. Applicant asked if there could be any deviation from code. Committee stated Applicants are free to appeal the decision with City Council with a proposal that works for them. Appeal letter can be sent to Joey Bowers today to get on the Council Agenda for July 7th. 2. Traffic Studies, Utility Studies: (as requested) None. 3. Drainage: (storm & surface water, to be engineered, retained on site) If applicants do pave more than 5000 sq. ft. would need to address additional storm water retention areas to direct water to. 4. Pretreatment / Nonresidential Waste Water Permit: (grease or oil/silt separator) Not needed. 5. Development Agreement (when needed) May end up needing one for paving timeline. 6. Structures and Site Layout: (exterior design, buffering, fencing, dumpster enclosure) Using residential cart. 7. Building Department: (professionally approved plans, ADA compliance, dumpster enclosure) Minimal renovations. ADA accessibility from parking into building would be needed. 8. Signs / Advertising: (advertising signs, height, structure) 12 sq. ft. limit on sign. 9. Landscaping: (ordinance copy, approved tree list) If frontage area length is 56ft would need additional tree. Don can send approved tree list. 10. Exterior lighting: (light shielding, light trespass) Two existing flood lightings on west, two porch lights on front. No business in evening night time hours. Applicant will need to make sure lights are shielded to prevent light trespass onto other properties. 11. Development: (platting, addressing) Has address. 12. Fire Department: (knox Box, fire hydrant locations, sprinkling, visible street address) As long as they stay under 49 kids it won’t trigger any changes to sprinklers, etc. Won’t need Knox box unless they change to commercial doors. 13. Police Department: (safety issues) No concerns. 14. Business License: (before opening) Will be required. Additional notes: CUP application available to Applicant if needed. Council packets going out today. Applicant can send an appeal letter to Joey Bowers today and can bring additional facts to the Council Meeting. Applicant stated enrollment at facility is already set. They will have 84 students with nowhere to go. They have major concerns about delaying the process even further. Or having to go through the CUP process to be denied. They have already invested several thousand dollars in the property and will essentially be down to one month with all the construction still left to do.
