Minutes of the Regular Meeting of the Board of Trustees of the Village of Chubbuck
held in the Municipal Building on December 14, 1965.
Present-Ward, Hillman, Underwood, and McDevitt.
Absent- Christensen and Twiggs.
Called to order 8:00 P.M.
Minutes of last regular meeting read and approved as read.
Bills for month presented to Board. Motion to approve payment made by Hil]man,
seconded by Underwood. All in favor.
Financial and Police reports for month presented to Board.
Well and Water System in Greener Pastures- Bob Bennett was present and gave these -
figures to the Board. Original cost was 2~,211.00 and will offer to Vil]_age for ~
16,000.00, and is available now. Well is 262 ft. deep. Pump is 50 horse-power Lane~
9 houses are being serviced now. Village is only interested in well, not the syste~.
Actual cost oft well was drilling-4,611.00, pump-11,360.O0, testing-500.OO,
lot-l,000.O0 and building-3,OO0.O0. Village will study this more before any action
on purchasing is discussed.
Parrish Drive- Bob Vesser asked if road could be fixed now before winter weather
makes it impossible to use the raad. After discussion it was decided the State is
supposed to fix this, and after checking with the State, if they don't fix it, the
Village will h~ve to assume this responsibility.
Charles McCloskey, 225 E. Linden voiced a protest against oiling streets. He stated
they should be paved.
Motion to permit the telephone Co. to palce and underground telephone conduit with
one manhole on U S Hiway 91-191 between the south Chubbuck City limit and Troy Lane
was made by Hillman, seconded by Underwood. All in favor. The permit was signed by
Ward and the copy of the Map is to be sent to Ballif.
Safety Hazard- Building of Parrish's at Yellowstone and Burnside was discussed.
Hensley has already approached them about this hazard. After a long discussion the
Board all agreed this will have to be remedied in 30 days or removed. If the Village
has to remove it, Parrish will be billed for it. Hensleywill notify Parrish of the
Board's decision.
Pipe for Watersystem- Board authorized Brennan to check and get some 4" and 6" pipe
at the best possible price, so we can have some on hand, and we will need some for
i~ediate use in extending some lines. Also Brennan is to see about repairs to the
Canal Banks on W. Chubbuck Road.
Neider Addition Streets- Residents want streets oiled. Ward has already explained to
Neider haw the Stuart Ave,was done. Residents will have to check further and see just
how they want to pay for theirs.
Water for U & I Sugar Co.- This will have to be checked further to see how may loads
they got and we will bill them for it.
Sign on Property at Hiway Ave. & Yellowstone- Board all agreed that Jerry Morrison ~
could erect a sign at the Qounset property inside our fence if it is h~gh enough
and will not bloch out the road. Sign to be 3' x 57 and subject to removal on request.
Budget- Copy is attached herewith. Study of Sewer System was discussed. Resolution on
Estimate of expenses read by Cl~rk. Motion to pass resolution made by Hillman,
seconded by Underwood. Roll Call Vote- Hillman-yes, Underwood-yes, and Ward-yes.
Resolution for holding Public Hearing on question of a general tax levy read by Clerk.

To The Village Board of Chubb~ck
January 11, 1966
We, the Petroleum Dealers of Chubbuck, ask that the Honorable
Members of the Chubbuck Village Board, hear us out, consider our
testimony, and attempt to render some solution to the problem
that is certainly ours and which we also consider ~ problem of
our community.
This is a REGISTERING OW A COMPLAINT toward the manner in
which the COin 0perat~~~ck ia~being, and
has continually been operated, s~nce being changed to bhis type
of operation.
First, we submit the illegalities that exist in this oper-
ation: The HAZARDOUS SUBSTANCES LAW, prohibiting the handling of
flamable substances in specific ways. There is nothing to stop
anyone in the violation of this, good and reasonable, law. In
case of fire on the premises or at the pumps,there is no one
available or nothing to use to combat this menace. There are no
fire extinguishers, no water, or even a telephone to make the
calls necessary for these emergencies.
Violations of the State Sales Tax Laws: We all must have
sufficient re~rds of our sales, and submit our tax collections
to the State Department by the 15th of each month following the
month in which the tax was collected.
Violation of Unfair Sales Practices: The owner and operator
of the premises is a wholesaler and distributor of automotive
products. Uses a ,John Doe' type of alias to cover his activi-
ties and uses this outlet to disrupt the market and the economy
of the entire area. Ne continually prices the gasoline on these
pumps at below tank wagon prices, creating c~pletely unfair
competition against the dealers that must buy the products from
outlets such as his.
Therefore, but are not allowed to be used by the public,
the proper facilities needed that have become the American
Motor Public's way of life. Namely rest rooms, water, air, and
the proper checking and caring of the customer,s automobile to
assure better visibility, checking for tire and brake safety,
to minimize dangers ~ life and proerty of the driver and to
that of all other people. This type of operation causes its own
customers to become leeches on the other business men of the
community in that they must go to these other business men to
obtain the free services that are essential to the motoring
public. There is absolutely no contribution to the community,
from this type of business, and the small business man that is
being hurt by this, has always been and will always be a very
essential part of the community in our American way of life.
We do not feel that this is an unethical procedure on our
part since we are striving to save our businesses from what might
be termed a bad cancer. We also take the feeling of security in
the fact that two brothers of the owner of this place in question
were amongst the leaders in a like objection having been voiced
with the governing body of our Mother City on our south border,
Pocatello, in the near past, and that the governing body there,
did find good ~nd sufficient reason to disallow this type of
operation within their city limits.
Let it be noted that this group does not advocate the closure
or elimination of this place, but that we do ask that proper
legislation be enacted and enforced along with the existing laws
pertaining to the handling of hazardous substances, in our comm-
unity ~ud to our motoring public. We, the fellow competitors,o~
this business, do feel that we could keep our places open for
business, and could exist ~n competition against this business
if the unfair sales practices were discontinued and if the State
and Fedemml laws were complied with, and if these businesses were
required to comply with the health and safety rules of f~rnishing
adequate rest rooms, water aud other facilities essential to the
use of the motoring public.
