HomeMy WebLinkAbout11 22 2005 CM237 COUNCIL MEETING MINUTES November 22 °d, 2005 Minutes of a regular meeting held at the Chubbuck City Council Chambers, November 22nd, 2005. Present: Mayor John O. Cotant, Council members Steven M. England, Marvin C. Gunter, Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Councilman Leroy S. Quick is excused. Council members Elect Dennis Stoddard and Richard Morgan were present. PLEDGE ALLEGIANCE TO THE FLAG was led by Council member Elect Richard Morgan. INVOCATION was given by Police Chief Randy Severe. APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Special Meeting Minutes of November 9`", 2005 and Regular Meeting Minutes of November 91h, 2005. Councilman Kearns moved to approve the Special Meeting Minutes and Regular Meeting Minutes of November 9", 2005 as read, Councilman Gunter seconded. All council members present voted in favor of motion. PUBLIC HEARING - An application by BNR Development, LLC, 4907 Easy Street, Chubbuck, Idaho for annexation and a zone change to Limited Residential, (R -2). The property is located west of Petersburg Drive, south of irrigation lateral, north of Chick Bilyeu property, east of Horse Arena. The developer was not present. Mayor Cotant declared the public hearing open. Sherman W. Schmidt, 5148 Leesburg stated the concern of the neighborhood is that in R -1 there can be single dwelling homes, but they have been informed there can be 10% duplexes allowed. The residents in the area do not want duplexes. Attorney Holmes stated there can be no duplexes, but there can be zero lot line homes if approved in R -1 zoning. Mr. Schmidt stated the residents would like to see on the plat there will be no duplexes or zero lot line homes allowed. Residents are concerns about traffic. 239 COUNCIL MEETING MINUTES - (cont.) November 22nd, 2005 PUBLIC HEARING - BNR DEVELOPMENT - (cont.) Attorney Holmes stated the preliminary plat will be a separate hearing at the Land Use & Development Commission Meeting, December 6 ', 2005. Mark Madsen, 5077 Independence expressed concern about how many homes can go into the proposed subdivision before an additional road out of the subdivision is required. Mr. Madsen expressed concern about additional traffic impact on the existing Heritage West Subdivision. Mayor Cotant stated we cannot tell, it will depend when the property to the south and north is developed. Vess Pearson, 5021 Liberty expressed concern about construction trucks going through the existing subdivision, can the City require the developer to go other directions with their construction trucks. Mayor Cotant said the City will look at ways to require construction trucks, etc from going through existing subdivision streets. Mayor Cotant declared the public hearing closed. Councilman Kearns moved to accept the Land Use & Development recommendation to approve the application by BNR Development, LLC for annexation and zone change to R -1, on property located west of Petersburg Drive, south of irrigation lateral, north of Chick Bilyeu property, east of Horse Arena, Councilman England seconded. All council members voted in favor of motion. DAY CARE FACILITY APPLICATION - Paula Ames, 397 Lavender Street has applied for a day care facility license to operate a day care facility at her residence at 397 Lavender Street. All departments recommended approval of the proposed day care facility. Councilman England moved to grant Paula Ames a day care facility license to operate a day care facility at 397 Lavender Street, Councilman Kearns seconded. All council members present voted in favor of motion. ._ ORDINANCE - Adopting Chapter 15.58, public safety radio amplification systems, to assure all buildings constructed in the City of Chubbuck allow adequate signal penetration for the radio frequency used by the City of Chubbuck e4mergency service workers, including, but not limited to, the Police, Fire, EMS and Department of Public Works employees. 241 COUNCIL MEETING MINUTES - (cont.) November 22nd, 2005 ORDINANCE - PUBLIC RADIO AMPLIFICATIONS SYSTEMS - (cont.) Attorney Holmes read ordinance by title only for the first reading. Council tabled the ordinance until the December 13', 2005 Council Meeting. 1ST AMENDED HAWTHORNE GROVE CONDOMINIUMS SUBDIVISION FINAL PLAT - Gary Nelson presented the Is'. Amended Hawthorne Grove Condominiums Subdivision Final Plat. PWD Smart explained this is a short plat. PWD Smart recommended approval of the final plat. Councilman Gunter asked if this included the finishing of the southern part of the building that has not be finished. Mr. Nelson stated the reason the building has not been completed is they anticipated having to put different doors, windows, etc. for the tenant build out. Mr. Nelson stated they are in negotiations with a party that has expressed interest in Unit 3. Councilman Gunter moved to approve the 1 S`. Amended Hawthorne Grove Condominiums Subdivision Final Plat, subject to the exterior of the Unit 3 being completed within one year, Councilman Kearns seconded. All council members present voted in favor of motion. BUSINESS LICENSE APPLICATION - Don R. Green, Rte #1 North, Box 73E, Pocatello, Idaho has applied for a business license to operate a horse and wagon ride business on W. Chubbuck and Hawthorne Roads from November 25`h through December 31", 2005. Police Department did not have a problem with the application. Councilman Gunter suggested who ever makes application for these wagon rides clean up the horse manure shortly after the event. Councilman Gunter moved to grant a business license to Don R. Green, David D Wagon Rides to operate a horse and wagon ride business on West Chubbuck and Hawthorne Roads from November 25' through December 31 S`, 2005 subject to; 1) Having liability Insurance, 2) Responsible for clean up of horse manure, debris from City Streets in a timely manner, 3) Police Department inspecting and approve lighting on the wagon, Councilman Kearns seconded. All council members present voted in favor of motion. 243 COUNCIL MEETING MINUTES - (cont.) November 22nd, 2005 CLAIMS - Computer print -out claims presented to Mayor Cotant and Council. Councilman England moved to approve computer print -out claims as presented, Councilman Gunter seconded. All council members present voted in favor of motion.
