Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. The meeting was called to order at 5:03 p.m. by Mayor Cotant. Council members Elect Dennis Stoddard and Richard Morgan were present. PURPOSE OF SPECIAL MEETING shall be 1) Resolution - Water Tank Rehabilitation Loan, 2) Waiver of Right to Purchase - Abandoned RR Spur along the north side of Bullock Street, 3) Beer License Application - Tobacco Connection at 4822 Yellowstone Ave. 4) Executive Session Meeting as authorized by Idaho Code 67- 2345(b) Personnel Matter. 5) Craig Merrill Appeal. RESOLUTION #9 -2005 - Authorizing and confirming the financing of water system improvements through the State of Idaho Department of Environmental Quality and in particular authorizing a promissory note, loan offer, acceptance and contract and related documents with the Department of Environmental Quality in an amount up to $360,630. to finance said water system improvements, authorizing a reserve fund and authorizing related matters proceedings and providing an effective date. PWD Smart explained Resolution #9 -2005 to the Council. Councilman Quick moved to adopt Resolution #9 -2005 as read, Councilman England seconded. All council members voted in favor of motion. WAIVER OF RIGHT TO PURCHASE - Abandoned RR spur along the north side of Bullock Street. PWD Smart explained the Waiver of Right to Purchase. Councilman England moved to approve the Waiver of Right to repurchase that portion of Gary Cooper's property on the north side of Bullock Street, Councilman Kearns seconded. All council members voted in favor of motion. BEER LICENSE APPLICATION - Keith A. Weeks, Tobacco Connection, 5116 W. Emerald, Suite A, Boise, Idaho has applied for a beer license to sell beer at the Tobacco Connection at 4822 Yellowstone Ave. Police Department ran a check and recommended approval of a beer license to the Tobacco Connection at 4822 Yellowstone Ave. 261 COUNCIL MEETING MINUTES - (cont.) Councilman Gunter moved to grant a beer license to the Tobacco Connection at 4822 Yellowstone Ave, Councilman Kearns seconded. All council members voted in favor of motion. APPEAL OF CITY EMPLOYEE CRAIG MERRILL - 4 Councilman Quick moved to deny the appeal presented by Craig Merrill, Councilman Kearns seconded. All council members voted in favor of motion. Cotant, Mayor CALL OF SPECIAL MEETING CITY OF CHUBBUCK Pursuant to Idaho Code Section 50 -604, the undersigned Mayor of the City of Chubbuck, Idaho, hereby calls a special meeting of the City Council to be held in the Chubbuck City Council Chambers, 5160 Yellowstone, Chubbuck, Idaho at the hour of 5:00 p.m, Tuesday, December 20th, 2005. The purpose of Special Meeting shall be to 1) Resolution -Water Tank Rehabilitation Loan. 2) Waiver of Right to Purchase - Abandoned RR Spur along the north side of Bullock Street. 3) Beer License Application - Tobacco Connection at 4822 Yellowstone Ave. 4) Cfi Employee Appeal.
