HomeMy WebLinkAbout03 27 2001 CM31 COUNCIL MEETING MINUTES March 27th, 2001 Minutes of a regular meeting held at the Chubbuck City Council Chambers, March 27t~, 2001. Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, B. Kent Kearns, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor Cotant. INVOCATION was given by Pastor Ely, Heritage Baptist Church. PLEDGE ALLEGIANCE TO THE FLAG lead by Ashley Williams. APPROVAL OF MINUTES -Mayor Cotant asked for corrections or additions to regular meeting minutes of March 134, 2001. Councilman Quick moved to approve regular meeting minutes of March 27th, 2001 as read, Councilman England seconded. All council members present voted in favor of motion. KEN & JENNY SNYDER, 5590 WHITAKER ROAD - REQUEST TO SPLIT EXISTING 2 ACRE LOT INTO 2 SEPARATE 1 ACRE LOTS AND BUILD A HOUSE ON THE NEW 1 ACRE LOT TO THE EAST - Jenny Snyder, 5590 Whitaker Road presented a revised site plan for their request to split existing two acre lots into two separate one acre lots, they want to build a house on the new lot to the east. Councilman Gunter expressed concern about fire truck turn around. Mayor Cotant suggested the request be discussed at Staff Meeting. PROPOSED ORDINANCE - Adding Section 13.04.120 to the Chubbuck Municipal Code to require that any municipal utility services ordered by someone other than the owner of the property must have payment and performance guaranteed by the property owner before services will be delivered. Property owners were mailed a copy of the proposed ordinance. Dave Packer, President of Local Property Association expressed the following concerns about the proposed ordinance: 33 COUNCIL MEETING MINUTES - (cont.) March 27th, 2001 PROPOSED ORDINANCE - (cont.) 1. Prejudicial to property owners. 2. Felt the property owner does not have the power to turn the water off' on residents. 3. Mr. Packer stated the City should collect at least two months deposit rather than put the burden of collecting the utility bill on the property owner. LaDona Aslett, 119 Abraham spoke against the proposed ordinance. Mrs. Aslett said she did not think the proposed ordinance would be legal and would be willing to sue the City if the ordinance is adopted. Marva Churchill, 2709 Jerome, Pocatello stated, if the ordinance is adopted she will have to sell her rental property. Mrs. Churchill said the City of Pocatello's Policy on single family dwellings is to charge $130.00 deposit if they do not have a previous payment record, as long has payments are maintained current for a year, they received $100.00 of the deposit back. Property owner's present were in favor of moving up the turn off day. Becky Parrish, 229 Parrish said that when tenants find out the property owner are responsible for the utility bill, they will leave the water bill for the property owner to pay. Mrs. Parrish is against raising the deposit to $200.00. Larry Herrod, 5612 Hawthorne Road asked why the City cannot absorb the $7,000.00, Mr. Herrod feels the property owners provide a service for the City. Fred Parrish said he is not in favor of raising the deposits in the City, raising the deposit will not be fair to the tenants. Dale Arnold, CPA said the intent of the ordinance is admirable, the Council should save monies for the residents in the City, but he felt the $7,000. lost is not an abnormal amount of loss in any business. Mr. Arnold stated he is opposed to the proposed ordinance. Mr. Arnold said he is in favor of cutting the amount of time before the tenant is shutoff for lack of payment. Dean Funk spoke against the proposed ordinance. Mayor Cotant said the Council will review all comments. Council tabled the proposed ordinance. COUNCIL MEETING MINUTES - (cont.) March 27m, 2001 BID - YELLOWSTONE TO HAWTHORNE WATERLINE CONSTRUCTION CONNECTION BID TABULATION - PWD Smart presented the following bids received: Western Pipeline Inc. Bannock Paving 35 Frasure Construction $44,381.00 $44,583.25 $47,225.00 PWD Smart said according to State Law the bidder is required to name their subcontractors, especially if they are electrical, heating, plumbing, venting or air conditioning. PWD Smart said not knowing whether or not the plumbing trap was required we kept that requirement to name subcontractors in the bid documents. PWD Smart said the low bidder did not include either of the items, therefore Western Pipeline should be declared non-responsive and recommended Bannock Paving get the bid. The council discussed at length alternative routes for this water line to avoid the high costs of obtaining easements for this corridor. It was the consensus of the council to construct the waterline connection along a less expensive route, if possible. Steve was directed to analyze costs of utilizing a different route. Councilman England moved to accept the Bannock Paving Bid and authorize Mayor Cotant to enter into agreement with Bannock Paving for the Yellowstone Hawthorne Rd waterline construction in the event an alternative route is not satisfactory, Councilman Quick seconded. All council members voted in favor of motion. BID - HAWTHORNE ROAD-QUINN ROAD TO INTERSTATE 1-86 BID TABULATION - PWD Smart presented the following bids received: Bannock Paving HK Contractors $363,176.30 $471,087.90 PWDSmart stated everything isin order and recommended the Bannock Paving Bid be accepted. Councilman Gunter moved to accept the low bid from Bannock Paving and authorize Mayor Cotant to enter into agreement with Bannock Paving for the Hawthorne-Quinn Road street construction, Councilman Quick seconded. All council members voted in favor of motion. COUNCIL MEETING MINUTES - (com.) March 27th, 2001 CLAIMS - Computer prim-out claims presented to Mayor Cotant and Council. Councilman Quick moved to approve the computer print-out claims as presented, Councilman England seconded. All council members voted in favor of motion.
