COUNCIL PRESENT: Roger Hernandez, Ryan Lewis, and Dan Heiner.

Director Rodney Burch, Planning & City Development Director Devin Hillam, Planning
Manager Don Matson, Municipal Services Program Administrator Kami Morrison, Police Chief
Bill Guiberson, Fire Chief Merlin Miller, Human Resource Director Scott Gummersall, City
Treasurer Rich Morgan, Deputy Clerk Paul Andrus, and City Clerk Joey Bowers.
Mayor England excused Councilmember Melanie Evans from the meeting.
APPROVAL OF MINUTES: January 19, 2022.
Councilmember Heiner motioned for approval of the Council Meeting minutes.
Councilmember Hernandez seconded motion for approval of minutes.
Roll Call: Hernandez -yes, Lewis -yes, Heiner -yes, motion passed
GENERAL BUSINESS:
1. Discussion on a Draft Confined Space Policy.
Municipal Services Program Administrator Kami Morrison presented a Public Works
confined space policy. To first identify any Permit -Required Confined Spaces (PROS)
and to eliminate or control hazards associated with PRCS operations. This program is in
accordance with the Occupational Safety and Health Administration's (OSHA) Permit -
Required Confined Spaces Standard, Title 29, Code of Federal Regulations 1910.146.
2. Discussion on a Draft Downtown Plan/City Code.
Planning and Development Director Devin Hillam presented examples of different
street layouts in other downtown areas; and presented a draft future street map for the
Chubbuck downtown area. Plazas/sidewalk areas can serve to move foot traffic without
the land and infrastructure costs of streets.
Planning Manager Don Matson presented a draft sign, landscaping, parking, and
frontage based codes to implement for the "downtown" area.
3. Discussion on a Draft Public Space Vendor Policy.
Planning and Development Director Devin Hillam presented a draft public space
vendor policy, which will allow a business to setup a temporary location in public spaces.
Public Space is defined as Property owned or controlled by the City of Chubbuck
including but not limited to City parks, streets, rights-of-way, and real estate. Mr. Hillam
asked the Council to look at section "P." that states a "vendor must maintain, and
specifically agree that it will maintain, throughout the term of the permit, Commercial
General Liability Insurance, Workers' Compensation Insurance, and Employers' Liability
Insurance in the form of a certificate of insurance issued on behalf of the City of
Chubbuck, naming the City as an additional insured on the lability policies." This section
of code was recommended by the city attorney.
The Council suggested looking into taking public comment at a future council study
session, to get public input about vendors using public space and insurance liability levels
to protect the community.
4. Approval of Public Works Vehicles for Disposal.
(Council will discuss City property for disposal).
City Clerk Joey Bowers presented vehicles for disposal.
Councilmember Heiner motioned for approval of Public Works vehicles for disposal.
Councilmember Hernandez seconded motion for approval.
Roll Call: Lewis -yes, Heiner -yes, Hernandez -yes, motion passed.
CLAIMS:
1. City of Chubbuck claims for February 2, 2022 as presented to Mayor England and
Council.
Councilmember Hernandez motioned to approve the City of Chubbuck Claims as presented.
Councilmember Heiner seconded motion for approval.
Roll Call: Heiner -yes, Hernandez -yes, Lewis -yes, motion passed.
