COUNCIL MEETING MINUTES
OCTOBER 20, 2021 — 6:00PM

CALL TO ORDER: Mayor England.
PLEDGE ALLEGIANCE TO THE FLAG: Councilmember Heiner
COUNCIL PRESENT: Dan Heiner, Melanie Evans, and Roger Hernandez.
STAFF MEMBERS PRESENT: Mayor Kevin England, Public Works Director Rodney Burch,
Planning & Development Director Devin Hillam, Police Chief Bill Guiberson, Fire Chief Merlin
Miller, Development Services Manager Sean Harris, Human Resource Director Scott
Gummersall, City Treasurer Rich Morgan, and City Clerk Joey Bowers.
Mayor Kevin England excused Councilmember Ryan Lewis from the meeting.
APPROVAL OF MINUTES: October 6, 2021.
Councilmember Heiner motioned for approval of the Council Meeting minutes.
Councilmember Hernandez seconded motion for approval of minutes.
Roll Call: Hernandez -yes, Evans -yes, Heiner -yes, motion passed.

GENERAL BUSINESS:
1. Approval of Arbor Court Final Plat.
(Council will discuss the application and if it meets City code).
Development Services Manager Sean Harris stated that this application had been
reviewed by City Staff and appears to meet the standards of Titles 16, 17 and 18 of City
Code, and recommended approval.
Councilmember Hernandez motioned for approval of Arbor Court Final Plat, conditional upon
construction plans/drawings to be accepted by development services.
Councilmember Heiner seconded motion for approval.
Roll Call: Evans -yes, Heiner -yes, Hernandez -yes, motion passed.
2. Adoption of Ordinance 838 for the Annexation of 40 Acres of Land, to Amend the
Comprehensive Plan Land Use Designation Map from Commercial and Employment to
Commercial and High Density Residential, and Specify the Zoning on 21.07 Acres of
Land as Commercial (C-2) and 18.43 Acres of Land as Dense Residential (R-4) on the
East Side of Yellowstone Avenue, North of Adams Street and South of New Day
Parkway. (Council will discuss the application and if it meets City code).
Councilmember Heiner motioned for the waiver of three readings, including the reading of one
time in full for Ordinance 838.
Councilmember Hernandez seconded motion for waiver.

3. Adoption of Ordinance 839 to Amend the Comprehensive Plan Land Use Designation on
4.18 Acres of Land from Commercial and Mixed Use to Mixed Use and Change the Land
Use District from Limited Residential (R-2) to Dense Residential (R-4) on Quinn Rd.
West of Ronald Rd. (Council will discuss the application and if it meets City code).
Councilmember Hernandez motioned for the waiver of three readings, including the reading of
one time in full for Ordinance 839.
Councilmember Heiner seconded motion for waiver.

4. Consideration and Adoption of Resolution 202 1 -10 to Place an Emergency Moratorium
Pursuant to Idaho Code 67-6523 on Plat Applications, Design Review Applications, and
Building Permits for New Structures and Additions within the Geographic Area from I-
86 at the South to East Chubbuck Road at the North, and from Yellowstone Ave. at the
West and the Railroad Tracks at the East.
(Council will discuss placing a moratorium on the downtown area).
Planning & Development Director Devin Hillam presented a resolution to place an
emergency moratorium on Plat Applications, Design Review Applications, and Building
Permits for New Structures and Additions within the Geographic Area from I-86 at the
South to East Chubbuck Road at the North, and from Yellowstone Ave. at the West and
the Railroad Tracks at the East. Which will allow City Staff 182 days to redefine zoning
and development standards within the proposed downtown area.
Mayor Kevin England asked City Staff to work diligently to accomplish the goal of
this moratorium as quickly as possible, to allow for property owners to be able to develop
their property under the new standards.
Councilmember Heiner motioned for adoption of Resolution 2021-10.
Councilmember Hernandez seconded motion for adoption.
Roll Call: Hernandez -yes, Evans -yes, Heiner -yes, motion passed.
CLAIMS:
City of Chubbuck claims for October 20, 2021 as presented to Mayor England and
Council.
Councilmember Hernandez motioned to approve the City of Chubbuck Claims as presented.
Councilmember Heiner seconded motion for approval.
Roll Call: Evans -yes, Heiner -yes, Hernandez -yes, motion passed.
ADJOURN: Mayor Kevin England adjourned at 6:19.
