COUNCIL MEETING MINUTES
SEPTEMBER 1, 2021 — 6:00PM

CALL TO ORDER: Council President Ryan Lewis
PLEDGE ALLEGIANCE TO THE FLAG: Councilmember Hernandez
COUNCIL PRESENT: Ryan Lewis, Dan Heiner, Melanie Evans, and Roger Hernandez.
STAFF MEMBERS PRESENT: City Attorney Tom Holmes, Public Works Director Rodney Burch,
Planning & Development Director Devin Hillam, Police Chief Bill Guiberson, Human Resource
Director Scott Gummersall, City Treasurer Rich Morgan, and City Clerk Joey Bowers.
Council President Ryan Lewis excused Mayor Kevin England from the meeting.
APPROVAL OF MINUTES: August 18, 2021.
Councilmember Evans motioned for approval of the Study Session and Council Meeting minutes.
Councilmember Heiner seconded motion for approval of minutes.
Roll Call: Lewis -yes, Heiner -yes, Evans -yes, Hernandez -yes, motion passed.
PUBLIC HEARING:
1. A public hearing, pursuant to Idaho code 50-1002, will be held for consideration of the proposed
reserve of forgone property taxes for the fiscal year October 1, 2021, to September 30, 2022.
The hearing will be held at Chubbuck City Council Chambers, 290 E Linden, Chubbuck, Idaho at
6:00pm on September 1, 2021. All interested persons are invited to appear and show cause, if
any, why such reserve should or should not be adopted.
City Treasurer Rich Morgan presented a resolution that is required by state law to
accrue property taxes that was available for FY2022. This will allow the City to access
this forgone property tax in the future.
Council President Lewis opened the public hearing. There being no comment, Council President
Lewis closed the public hearing.
GENERAL BUSINESS:
1. Adoption of Resolution 2021-08 Forgone Property Taxes.
(Council will discuss the intent and purpose of collecting forgone taxes.)
Councilmember Heiner motioned for adoption of Resolution 2021-08.
Councilmember Evans seconded motion for adoption.
Roll Call: Heiner -yes, Evans -yes, Hernandez -yes, Lewis -yes, motion passed.
2. Adoption of Ordinance 835 De -annexation for Properties Adjacent to Fairgrounds Road.
(Council will discuss the application and if it meets City code).
Councilmember Evans motioned for the waiver of three readings, including the reading of one
time in full for Ordinance 835.
Councilmember Hernandez seconded motion for waiver.
Roll Call: Evans -yes, Hernandez -yes, Lewis -yes, Heiner -yes, motion passed.
Councilmember Evans motioned for adoption of Ordinance 835.
Councilmember Heiner seconded motion for adoption.

3. Adoption of Ordinance 836 Replacing Chapter 18.13 Wireless Telecommunication Facilities.
(Council will discuss replacing chapter 18.13 of city code).
Councilmember Heiner motioned for the waiver of three readings, including the reading of one
time in full for Ordinance 836.
Councilmember Evans seconded motion for waiver.
Roll Call: Heiner -yes, Evans -yes, Lewis -yes, Hernandez -yes, motion passed.

Councilmember Hernandez seconded motion for adoption.

4. Adoption of Ordinance 837 Amending 2.28.010 Land Use & Development Commission.
(Council will discuss amending chapter 2.28.010 of city code).
Councilmember Hernandez motioned for the waiver of three readings, including the reading of
one time in full for Ordinance 837.
Councilmember Heiner seconded motion for waiver.
Roll Call: Lewis -yes, Hernandez -yes, Heiner -yes, Evans -yes, motion passed.

5. Approval of the FY22 Health Plan Trust Contribution.
(Council will discuss the City's contribution to the health plan trust).
Scott Gummersall presented the financial status of the City's Health Plan Trust and
explained that the State Department of Insurance is requiring that the Trust carry 3 times
the monthly contribution in the fund balance.
Councilmember Evans motioned for the approval of the FY22 Health Plan Trust Contribution,
conditional upon the Idaho Department of Insurance's approval of funding contributions.
Councilmember Hernandez seconded the motion.
Roll Call: Evans -yes, Heiner -yes, Lewis -yes, Hernandez -yes, motion passed.
CLAIMS:
City of Chubbuck claims for September 1, 2021 as presented to Mayor England and
Council.
Councilmember Heiner motioned to approve the City of Chubbuck Claims as presented.
Councilmember Hernandez seconded motion for approval.
Roll Call: Heiner -yes, Lewis -yes, Hernandez -yes, Evans -yes, motion passed.
ADJOURN: Council President Lewis adjourned at 6:19.
