PLEDGE ALLEGIANCE TO THE FLAG: Councilmember Heiner COUNCIL PRESENT: Roger Hernandez, and Dan Heiner. COUNCIL PRESENT VIA ZOOM: Ryan Lewis. STAFF MEMBERS PRESENT: Mayor Kevin England, City Attorney Tom Holmes, Public Works Director Rodney Burch, Police Chief Bill Guiberson, Planning and Development Director Devin Hillam, Planning Manager Don Matson, Development Services Manager Sean Harris, Human Resource Director Scott Gummersall City Treasurer Rich Morgan, and City Clerk Joey Bowers Mayor England excused Councilmember Melanie Evans from the meeting. APPROVAL OF MINUTES: April 7, 2021. Councilmember Heiner motioned for approval of the Study Session and Council Meeting minutes. Councilmember Hernandez seconded motion for approval of minutes. Roll Call: Lewis -yes, Heiner -yes, Hernandez -yes, motion passed. PROCLAMATIONS: 1. Civitan Awareness Month Mayor England read aloud a proclamation and then presented a copy to Rainbow Maldonado. GENERAL BUSINESS: 1. Chief Guiberson POST Executive Certificate Presentation. Peace Officer Standards & Training (POST) Director Brad Johnson presented Chief Bill Guiberson with his POST Executive Certification. 2. Approval of Bear River Storage Final Plat. (Council will discuss the application and if it meets City code). Jesse Reynolds, Menlove Construction, represented the applicant. Mr. Reynolds presented a preliminary plat for storage units. As part of this plat the applicant will be widening W. Chubbuck Rd. and constructing Hiram Ave. along the property frontages. Development Services Manager Sean Harris stated that this application had been reviewed by City Staff and appears to meet the standards of Titles 16, 17 and 18 of City Code, and recommended approval, with conditions. Councilmember Heiner motioned for approval of Bear River Storage Final Plat, conditional upon construction plans/drawings to be accepted by the City Engineer. Councilmember Hernandez seconded motion for approval. Roll Call: Heiner -yes, Hernandez -yes, Lewis -yes, motion passed. 3. Approval of the Spring Cove Subdivision Short Plat. (Council will discuss the application and if it meets City code). This item of business was moved to the May 5, 2021 Council Meeting. 4. Update on Deviation Request for Overhead Power in the Harvest Springs Creative Corm-nunity Zone. (Council will discuss the application and if it meets City code). Planning and Development Director Devin Hillam stated that the applicant had worked with Idaho Power on an alternate route and had withdrawn his deviation request. 5. Adoption of Ordinance 827 Zone Change from Limited Residential (R-2) to Commercial (C-2). (Council will discuss a change in land use from Residential (R-2) to Commercial (C-2)). Councilmember Hernandez motioned for the waiver of three readings, including the reading of one time in full for Ordinance 827. Councilmember Heiner seconded motion for waiver. Roll Call: Hernandez -yes, Lewis -yes, Heiner -yes, motion passed. Councilmember Heiner motioned for adoption of Ordinance 827. Councilmember Lewis seconded motion for adoption. Roll Call: Heiner -yes, Lewis -yes, Hernandez -yes, motion passed. 6. Adoption of Ordinance 828 Building Valuations and Permit Fees. (Council will discuss amending 75.04.090 of city code). Councilmember Hernandez motioned for the waiver of three readings, including the reading of one time in full for Ordinance 828. Councilmember Heiner seconded motion for waiver. Roll Call: Lewis -yes, Hernandez -yes, Heiner -yes, motion passed. Councilmember Hernandez motioned for adoption of Ordinance 828. Councilmember Heiner seconded motion for adoption. Roll Call: Lewis -yes, Hernandez -yes, Heiner -yes, motion passed. 7. Adoption of Resolution 2021-04 Building Valuations and Permit Fees. (Council will discuss Building Valuations and Permit Fees). Councilmember Heiner motioned for adoption of Resolution 2021-04. Councilmember Hernandez seconded motion for adoption. Roll Call: Hernandez -yes, Heiner -yes, Lewis -yes, motion passed. 8. Adoption of Ordinance 829 Amending 13.20 Pretreatment Regulations. (Council will discuss amending 73.20 and removing 73.18 of city code). Councilmember Heiner motioned for the waiver of three readings, including the reading of one time in full for Ordinance 829. Councilmember Hernandez seconded motion for waiver. Roll Call: Lewis -yes, Hernandez -yes, Heiner -yes, motion passed. Councilmember Hernandez motioned for adoption of Ordinance 829. Councilmember Heiner seconded motion for adoption. Roll Call: Lewis -yes, Hernandez -yes, Heiner -yes, motion passed. 9. Approval of the City/Chubbuck Development Authority (CDA) 1992 Plan Agreement. (Council will review the City/CDA project development agreement for the 7992 plan). CLAIMS: This item of business was moved to a future Council Meeting. City of Chubbuck claims for April 21, 2021 as presented to Mayor England and Council. Councilmember Heiner motioned to approve the City of Chubbuck Claims as presented. Councilmember Hernandez seconded motion for approval. Roll Call: Heiner -yes, Lewis -yes, Hernandez -yes, motion passed. ADJOURN: Mayor Kevin England adjourned at 6:27. This meeting was available to the public electronically and by phone. in-person attendance was allowed, but strict social distancing measures were in place.
