HomeMy WebLinkAbout07 26 2005 CM157 COUNCIL MEETING MINUTES July 26th, 2005 Minutes of a regular meeting held at the Chubbuck City Council Chambers, July 26th, 2005. Present: Mayor John O. Cotant, Council members Steven M. England, Marvin C. Gunter, Kent Keams, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Council member Leroy S. Quick was excused. Meeting was called to order at 7:32 p.m. by Mayor Cotant. PLEDGE ALLEGIANCE TO THE FLAG was led by Mark Bunce. INVOCATION was given by Councilman Marvin C. Gunter. APPROVAL OF MINUTES - Mayor Cotant asked for corrections and additions to the Special Meeting Minutes of July 12th, 2005 and Regular Meeting Minutes of July 12th, 2005. Councilman Keams moved to approve the Special Meeting Minutes of July 12th, 2005, and Regular Meeting Minutes of July 12th, 2005, with correction of spelling errors, Councilman England seconded. All council members present voted in favor of motion. BUSINESS LICENSE APPLICATION - An application by Steve Greninger, Boise, Idaho has applied for a business license to sell sunglasses at 4010 Yellowstone Ave, (the Green Triangle Parking Lot). Police Department gave approval of the business license application. Steve Greninger was not present at this meeting. Councilman England moved to grant a business license to Steve Greninger, Boise, Idaho to sell sunglasses at 4010 Yellowstone Ave, (the Green Triangle Parking Lot), Councilman Kearns seconded. All council members present voted in favor of motion. ORDINANCE - Amending Chapter 16.12 to update the provisions for streets and street construction and to change the right-of-way widths; to amend references to "City Engineer" to "City"; to change the length of cul-de-sac streets by setting a design standard and factors to consider rather than a set length. Within Chapter 17.12 to update the provisions for plats; to provide a time limit for the validity of final plats if not recorded within two years of Council approval. 159 COUNCIL MEETiNG MINUTES - (cont.) July 26th, 2005 ORDiNANCE - VARIOUS PROVISIONS WITHiN CHAPTER 16.12 - (cont.) Attorney Holmes stated the ordinance has been amended in response to Dams Ellis's comments, we have noted a Page 2, streets in addition being consistent with the Comprehensive Plan developments in the process, or prior to August 1 st, 2005 and on Page 4 we added (s) trying to take care of the no man land sections of property lying in the street right-of-way, these areas we did not feel they needed to be landscaped, we need to catch them in the construction stage to require something be done, possibly extending the sidewalk, possibly to the fence. Attorney Holmes read ordinance by title for the second reading. Dams Ellis asked if this ordinance will increase the requirement of the developer being required to install an 8' sidewalk. Mr. Ellis was concerned about the cost to the developer if he has to install an additional 3' of sidewalk. Attorney Holmes said the ordinance is not requiring sidewalk, it states it will be covered with sidewalk, or other safe similar treatments so as to reserve the area for future expansion of the street or for utility usage. PWD Smart stated the City needs this 3' strip of right-of-way, this ordinance covers the area so there is not a maintenance problem. Rob Ray, 803 E. Mountain Park Road spoke in favor of the developer installing the covering that is required. Council tabled the ordinance until the August 9th, 2005 Council Meeting. ORDiNANCE #598 - Adding Section 18.14.020 (D)(4) to provide any area within the right-of- way shall be landscaped if not covered by pavement, curb, gutter or sidewalk; adding Section 18.14.050 to require that any trees removed during development be replaced. Attorney Holmes read Ordinance #598 in full for the third and final reading. Councilman Kearns moved to adopt Ordinance #598 as read, Councilman Gunter seconded. Roll Call Vote: Quick, absent; England, yes; Gunter, yes; Kearns, yes. Motion passes. 161 COUNCIL MEETING MINUTES - (cont.) July 26th, 2005 RESOLUTION #6-2005 - Updates the Comprehensive Plan. Mayor Cotant read Resolution #6-2005 in full. Councilman England moved to adopt Resolution #6-2005 as read with change in paragraph 4 to read "the Land Use and Development Commission at its meeting on June 7th, 2005", instead as "2004", Councilman Gunter seconded. All council members present voted in favor of motion. ORDINANCE - Creating Section 10.08.055, "School Zones," to establish school zones for Chubbuck Elementary School on Chubbuck Road and for Ellis Elementary School on Whitaker Road; establishing a 20 MPH speed limit in those zones when certain conditions are present. Attorney Holmes read ordinance by title only for the first reading. Council tabled the ordinance until the August 9th, 2005 Council Meeting. DISPOSAL OF SURPLUS EQUIPMENT - PWD Smart presented to the Council a list of Disposal of Surplus Equipment. Prime Time Auction will conduct an auction for the City of Chubbuck on August 20th, 2005. After discussion, Councilman England moved to approve the Disposal of Surplus Equipment List as presented, Councilman Kearns seconded. All council members present voted in favor of motion. CLAIMS - Computer print-out claims presented to Mayor Cotant and Council. Councilman Gunter moved to approve the computer print-out claims as presented, Councilman Kearns seconded. All council members present voted in favor of motion. At 8:21 p.m, Councilman England moved, Councilman Kearns seconded, with full council approval to adjourn meeting. Ron C.
