HomeMy WebLinkAbout12 28 1976 CM COUNCIL MEETING MINUTES 151 December 28, 1976 Minutes of the recessed meeting held in the city municipal building December 28, 1976. Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn, Wayne G. Taylor and Clerk Vera Armstrong. Attorney Don Burnett and Councilman Earl L. Romriell attended at 5:30 p.m. Councilman Boyd L Fullmer asked to be excused at 6:30 p.m. ' Meeting called to order at 4:45 p.m. PUBLIC HEARING - Housing and Urban Development Block Grant Program. The city plans to submit an application to HUD for a community development block grant. The project is designated to replace old steel lines on Valenty Road, Ward Drive, Briscoe Road and Burnside Avenue with new 6" ductible iron lines and provide copper services where necessary. Before a pre- application can be sent to HUD for the grant it is necessary for the city to hold two public hearings. The first hearing is being held today and the second will be held January 4, 1977 at 4:30 p.m. No one attended the hearing for any comments. FUND TRANSFER - It is necessary to transfer funds in the Sanitation Department. 433.1 Sanitation Salary & Administration needs $2,500.00 to balance out the years budget. Councilman Taylor moved to transfer $2,500.00 from 433.90 Sanitation Other Governmental Administration to 433.1 Sanitation Salary & Administration. Councilman Fullmer seconded motion. All councilmen voted in favor of motion. The following claims were submitted to be approved. Pacific States Cast Iron Pipe Co.=$26,431.55, Luchick Ford Tractor Co.=$3,535.00 and Jerry Stuart.= $350.00. ' Councilman Taylor moved to approve the claims. Councilman Kinghorn seconded motion will all councilmen voting in favor of motion. PROPOSED STIPULATION AND ORDER in regards to Denny Jones case. Attorney Don Burnett and Attorney Max Parrish have met and prepared a proposed stipulation in the JOnes case. Mayor and council discussed the proposed stipulation very thoroughly. Council felt a 7 ft. fence in height should be required, on all sides and screened. ADDITION~ After the thorough discussion, Councilman Romriell moved for council to authorize the mayor in conjuction with city attorney to contact Denny Jones ~ and his counsel to determine whether or not the parties can agree upon the stipulation reviewed today with the following amendments; 1) fence shall be well maintained, 2) fence shall be seven ft. in height, 3) fence shall not be situated nearer Y~llowstone than the front of the building. Councilman Taylor seconded motion. All councilmen voted in favor of motion. RESOLUTION #15-76 - vacating a portion of the Turner Subdivision plat was read in full by Mayor Cotant. Councilman Taylor moved to approve Resolution #15-76. Councilman Romriell seconded motion. Roll call vote: Kinghorn, yes; Romriell, yes; Taylor, yes.
