HomeMy WebLinkAbout06 28 2005 Special CM113 COUNCIL MEETING MINUTES June 28th, 2005 Minutes of a Special Meeting held at the Chubbuck City Council Chambers, June 28th, 2005. Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, Marvin C. Gunter, Kent Kearns, Attorney Thomas J. Holmes, Public Work Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 6:10 p.m. by Mayor Cotant. PURPOSE OF SPECIAL MEETING is to conduct a study session on 1) E. Chubbuck Road Comprehensive Plan change, east of Hiline Road to east City Limits. 2) Comprehensive Plan change for Homestead Subdivision. EAST CHUBBUCK ROAD EAST OF HILINE ROAD REQUESTED COMPREHENSIVE PLAN CHANGE STUDY SESSION - Councilman England stated as we looked at the Comprehensive Plan the discussion was that the property east of Hiline Road was probably going to be mostly residential in the near future. Councilman England stated it will be years before commercial goes east from Hiline Road to City Limits because of 1) Traffic and, 2) There are still a lot of nice residential homes on the street. Mayor Cotant stated we need to be careful going from Hiline east, because we have the Parrish Property that will probably go commercial soon. Mayor Cotant suggested from the east boundary of Bistline Park to the east, and from Buffalo Road to the east be changed back to residential in the Comprehensive Plan, all the property to the west from Buffalo Road and east boundary of Bistline Park stay as is in the Comprehensive Plan. Councilman Keams stated the residents concerned would probably not care about the property west of Buffalo Road and the east boundary, west of Bistline Park being left as is, in the Comprehensive Plan. HOMESTEAD SUBDIVISION STUDY SESSION - Council reviewed two proposed plats presented by Daniel Bull and Wayne Taysom. One of the plats show a plan of twenty acres with approx. 59 homes, and one showing a 40 acre plan with approx. 100 homes. Mayor Cotant stated he felt that when the City annexes we should be able to tell the developer what size lots the developer can put in based on the sewer capacity, etc. Attorney Holmes stated the City has no precedence, nor an ordinance to require larger lots than Residential, (R- 1). 115 COUNCIL MEETING MINUTES - (cont.) June 28th, 2005 HOMESTEAD SUBDWISION STUDY SESSION - (cont.) Councilman England suggested if we had hindsight we probably would not have allowed Wayne Taysom's 20 acres into the Chubbuck's Urban Service Boundary, but we did. We did make a commitment to Wayne Taysom to allow the 20 acres, if we allow the forty acre plan, we just compound our sewer concerns. Councilman England stated we should allow the committed twenty acres and should give the residents as good as transition as we can. Councilman England suggested we required the bridge to Cole Street to allow an orderly pattern of traffic in the proposed subdivision. Discussion about the residents concerns in the area, buffer between residents there, traffic, safety, etc. Discussion about a road to Siphon Road and who will build the road. Councilman England stated we should do all we can do to preserve the residents life style within the realm of the property they own. Attomey Holmes stated he talked to Association of Idaho Cities Attorney, he advised that if the City has a history of doing development agreements, and we have standards in place, we are all right requiring larger lots than the (R-1), if not, the City probably should not require the larger lots. Councilman Gunter said the residents on Homestead are entitled to their rural setting on property they own, but there is no guarantee from the end of Homestead Road west. Discussion about amount of traffic the Homestead Subdivision will create on Homestead Road. Attorney Holmes stated the issue tonight, is the City going to extend it's Urban Service Boundary in the Comprehensive Plan. Councilman Kearns stated the proposed bridge on Cole Street makes more sense at this time rather than constructing a street to the north to Siphon Road. Attorney Holmes stated the Council can approve, extending the Urban Service Boundary subject to getting an agreement with this developer on how the twenty acres is going to be developed. 117 COUNCIL MEETING M1NUTES - (cont.)
