COUNC!L MEETING MINUTES October 12, 1976
Minutes of the regular council meeting held in the city municipal building
October 12, 1976.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn,
Wayne G. Taylor, Attorney Don Burnett, Engineer John Alder and Clerk Vera Armstrong.
Councilman Earl L. Romriell excused.
Meeting called to order at 8:08 p.m. by Mayor Cotant.
Mayor Cotant asked for corrections or additions to council minutes of September 28.
There being none, Councilman Taylor moved to approve minutes of September 28
meeting as written. Councilman Kinghorn seconded motion and all councilmen
voted in favor.
GLEN MARSHALL INDUSTRIAL PARK PRELIMINARY PLAT - No one was present to represent
the plat. The Planning and Zoning Commission have recommended approval of
preliminary plat.
Council discussed the problem of developing the street within the park at a
location on property where fill has been placed, the location where a gravel
pit was a few years ago.
Councilman Taylor stated the water and sewer lines would have to be imbedded to
solid ground.
Engineer Alder said that the city could probably accept the plat with the
stipulations this particular street would be subject to city inspections and
might need be rebuilt from solid ground if city so feels necessary.
It was suggested that the street location be cored for underground materials
and based on materials found the city could require a complete new fill
material.
Council decided the zone should remain General Commercial (C-3) zone.
After further discussions Councilman Kinghorn moved the council accept the
Glen Marshall Industrial Park preliminary plat as recommended by the
Planning and Zoning Commission with additional stipulations pertaining to street,
sewer and water construction, 1) sewer and water utility lines must be placed
on newly imbedded materials to solid ground, 2) street would be subject to city
inspections and might need to be rebuilt from solid ground if city feels
necessary, 3) all other comments'as listed on the preliminary plat by
Engineer Alder with excepttion of zone change. Councilman Fullmer seconded
motion with all councilmen voting in favor of motion.
COMMUNITY BLOCK GRANT APPLICATION - Rod Watkins, Southeast Idaho Council of Govern-
ments, reminded the mayor and council it was time again to submit a pre-application
for Housing and Urban Development grant funds from the community block grant
source if the city cares to apply.
Mayor and council asked Mr. Watkins about other grant possibilities such as
E.P.A., Farmers Home, E.D.A. etc.
Mayor and council asked Mr. Watkins to leave the forms and the city would work
out a project for the application.
BAR X TRACTS FINAL PLAT - Klane Forsgren, Forsgren, Perkins and Assoc. Engineering
firm, informed mayor and council the Bar X Tract plat has become a forced plat
through the county. Mr. Forsgren stated it is not necessary for all property
owners to sign the plat and asked council if they would accept the final plat.

BAR X TRACTS cont'd - Attorney Burnett told council if Bar X Tracts seems to be an
acceptable plat according to the overall planning of the area the council should
not have any particular responsibilities in approving same as the county has
ordered the plat designed.
Engineer Forsgren stated the county has contracted with him for his firm's
services as the engineer on Bar X Tracts plat and will pay for all engineering
services.
Attorney Burnett advised council the Planning and Zoning Commission should
take action on the final plat prior to the council taking their action upon
the plat. '
Councilman Kinghorn made a motion the Planning and Zoning Commission hold a
special meeting Thursday, October 21 to act upon the Bar X Tract Final plat.
Councilman Taylor seconded motion with all councilmen voting in favor.
Attorney Burnett advised the city to send notice to Planning and Zoning members
informing them of the special meeting and purpose of same.
RESOLUTION passed by city requesting the Planning and Zoning Commission to consider
providing a zone that would allow storage of wrecked cars, possibly limiting
number of cars and also limiting time cars can be kept was d~.scussed by mayor
and council.
Jack Menard, P & Z Chairman wanted to know just what the council intended.
Attorney Burnett has prepared a public hearing notice so the P & Z Commission
will consider this request of city to provide a zone for storage of wrecked etc.

UNION PACIFIC RAILROAD SEWER EASEMENT AGREEMENT - FROM BRIAR WOOD MOBILE HOME COURT
UNDER RAILROAD TRACKAGE - Attorney Burnett has reviewed the easement agreement
returned by the U.P.R.R. Company which included adoption of a resolution city
requested to become a part of original easement. The U.P.R.R. Company has
incorporated the resolution into the agreement.
Attorney Burnett informed mayor and council the agreement has been approved by
the U.P.R.R. Company and no further action need be taken by the city.
ORDINANCE # 172 - Amending Ordinance #109 in regards to animal control was read
in full by Attorney Burnett. Attorney Burnett has added a new Section A to
ordinance which requires city to hold a hearing on nuisance dogs before destroy-
ing same.
Councilman Taylor moved to dispense with rule of reading ordinance on three
separate days. Motion seconded by Councilman Fullmer. Roll call vote: Fullmer,
yes; Kinghorn, yes; Taylor, yes.
Councilman Fullmer moved to adopt Ordinance #172 as read. Councilman Kinghorn
seconded motion. Roll call vote: Fullmer, yes; Kinghorn, yes; Taylor, yes.
INTERGOVERNMENTAL AGREEMENT WITH CITY OF POCATELLO for use of the Animal Shelter read in full by Attorney Burnett.
Councilman Taylor moved to approve the Intergovernmental Agreement with the City of
Pocatello for use of the Animal Shelter. Councilman Fullmer seconded motion.
Roll call vote: Fullmer, yes; Kinghorn, yes; Taylor, yes.
ORDINANCE #171 - Creating a Municipal Improvement and Advisory Board read by Mayor
Cotant.
Councilman Taylor moved to dispense with rule of reading ordinance on three
separate days. Councilman Fullmer seconded motion. Roll call vote- Fullmer,
yes; Kinghorn, yes; Taylor, yes.

AGREEMENT AND RESOLUTION #11-76 With the Idaho Department of Highways on Painting of crossing signs at railroad crossing within city.
Resolution #11-76 read in full bv Mavor Cotant. Councilman Kinehorn moved to
adopt Resolution #11-76. Councilman Taylor seconded motion. Roll call vote:
Fullmer, yes; Kinghorn, yes; Taylor~ ~
ENGINEERING CLAIM - Rodney Clark has requested a re-imbursement on additional engineering fees paid by him to re-design the Heights Subdivision Plat to
all°w a sixty foot street on West Chubbuck Road and then re_design back to
a fifty foot street.
Councilman~Taylor moved to approve the $803.00 claim presented to city.
Councilman Kinghorn seconded motion with an unanimous vote in favor of motion.
FINANCIAL STATEMENT presented to mayor and council.
CLAIMS TO BE PAID IN OCTOBER presented to mayor and council. After reviewing,
Councilman Taylor moved to pay claims including $2,500.00 to Gayle Anderson
for develoPment and planting of lawn at Paradise Acres Park. Councilman
Kinghorn seconded motion with all councilmen in favor of motion.
GENERAL DISCUSSIONS: 1. City needs written bid to clean rock on Chandler property.
2. D. K. Evans sewer servcie line to be completed as soon as city public
works department can work it into their schedule.
CLAIM - Empire Construction Company presented claim for site preparation of 1.5 Million gallon water reservoir in the amount of $11,377.02.
Councilman Kinghorn moved to pay Empire Construction claim of $11,377.02,
and that city issue an interim certificate to Idaho Bank & Trust Company for
the same amount. Councilman Fullmer seconded motion. All councilmen present
voted in favor of motion with exception of Wayne Taylor who abstained from
voting.
