Minutes of a special council meeting held in the city municipal building September
16, 1946.
Present' Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn,
Earl L. Romriell and Wayne G. Taylor, Engineer John Alder, Attorney Don Burnett
and Clerk Vera Armstrong.
Meeting called to order at 4:45 p.m. by Mayor Cotant.
Purpose of special meeting is to consider the following; 1) Mountain Bell telephone
permit 2) F. W. Kahley & Son Construction claim 3) Ordinance creating a Municipal
Improvements and Advisory Board 4) Ordinance prohibiting cars backing out on
main arterial thoroughfares 5) Ordinance amending animal control ordinance
6) Resolutions adopting the Uniform Fire Code and the Uniform Building Code
7) Ordinance providing pedestrian walkways with no equestrian traffic _8) Darrell
Larkin zoning problem 9) Consideration of future HeaVy Industrial zone]
MOUNTAIN BELL PERMIT - Attorney Burnett informed mayor and council he is preparing
a limited permit for Mountain Bell to install a telephone line on Hiline Road
and coupled with an indemnity from Mountain Bell to cover the city in any legal
damages that might arise from the construction, or issuance of permit.
F. W. KAHLEY & SON CONSTRUCTION CLAIM - F. W. Kahley & Son Construction has submitted
a claim of $49,762.80. The water revenue bond sale is set for September 28, 1976
and the Idaho Bank & Trust will not loan any money to the city for construction
payments until the bonds are sold.
Attorney Burnett advised the city to l) Contact F. W. Kahley & Son Construction
and ask if they will wait until September 29 for payment. And if F. W. Kahley
Construction will not approve delay in payment 2) Compute the advantage of cashing
in Time Certificate of Deposits against the borrowing of money from another bank
if possible so payment of claim can be made.
RESOLUTION 8-76 - Adopting the 1976 Uniform Fire Code read in full by Mayor Cotant.
Councilman Taylor moved to adopt Resolution #8-76 (Uniform Fire Code). Councilman
Kinghorn seconded motion. Roll call vote: Fullmer, yes' Kinghorn yes' Romriell
no; Taylor, yes. ~ ' ' ,
RESOLUTION 7-76 - Adopting the 1976 Uniform Building Code read in full by Mayor
Cotant. ,~
Councilman Romriell moved to adopt Resolution # 7-76 (1976 Uniform Building Code)
Councilman Fullmer seconded motion. Roll call vote: Fullmer, yes; Kinghorn, yes; ~
Romriell, yes; Taylor yes. i
ORDINANCE #172 - Amending animal control ordinance - increasing impound fee, defining ~'
dog nuisance and impoundment of nuisance dogs, etc. read in full by Mayor Cotant ~
as first reading.
Councilman Fullmer suggested this ordinance also be reviewed further at other meetings.
ORDINANCE #171 Creating a Municipal Improvements and Advisory Board was read in full
by Mayor Cotant for the first reading. The mayor and council will send this
ordinance onto the Traffic Safety and Beautification Committee for study and comments.
ORDINANCE prohibiting cars backing out on main arterial thoroughfares read in full
by Mayor Cotant. Council discussed the need for this ordinance and asked that
the Planning and Zoning Commission review same.

DON LARKIN PROPERTY - Junk at 237 Mingo Lane - Attorney Burnett informed council
he felt a compliance schedule should be set up for the clean-up on Mr. Larkin's
property. Clerk was requested to contact Mr. Larkin and request he attend the
next council meeting for setting up a compliance schedule.
CONSIDERATION OF HEAVY INDUSTRIAL ZONE - Attorney Burnett discussed with mayor and
council the subject and possibility of city providing a heavy industrial zone.
Mayor, Council and Attorney decided to invite Dennis Jones and Marvin Christensen
to a council meeting to discuss their needs of automobile storage andapossible
zone for same.
Meeting adjourned at 6:50 p.m.

Please accept this written notice as confirmation of a telephone
call advising you of a special meeting called by Mayor Cotant and
to be held September 16, 1976, 4:30 o'clock p.m. and held at the
City Municipal Building.
Purpose of the meeting is to consider the following items-
1. Mountain Bell Telephone Permit
2. F. W. Kahley Claim - Water Tank ConStruction
37 Ordinance creating a consolidated Traffic, Safety and Beautification
Committee with the Park and Recreation Committee.
4. Resolution adopting the 1976 Edition of the Uniform Fire Code
and the 1976 Uniform Building Code
5. Ordinance prohibiting cars backing out on main roads
6. Ordinance providing pedestrian walkways with no equestrian traffic
7. Darrell Larkin property - 238 Mingo Lane
8. Consi:de~ation of future Heavy Industrial zone.
