Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn, Earl L. Romriell, Engineer John Alder and Clerk Vera Armstrong. Attorney Don Burnett excused. Meeting ca~led to order at 8:10 p.m. by Mayor Cotant. Mayor Cotant asked for any corrections or additions to minutes of August 10, 11, and 26. Attorney Burnett has requested the minutes be amended to reflect the word "Complaint" instead of "arrest" under item entitled "Junk on Mingo and Elsewhere in city. Councilman Fullmer moved the minutes of August 10, 11 and 26 be approved as written with the following amendment to August 10 minutes. Attorney Burnett has requested the minutes be amended to reflect the word "complaint" rather than "arrest" under the item entitled "Junk on Mingo and Elsewhere in City", (in third to last paragraph). Councilman Kinghorn seconded motion with an unanimous vote in favo~ MAIL DELIVERY - Mr. Lorenzo Palagi, U. S. Post Office Department attended the meeting to explain to Mayor and Council the postal department's requirements of the delivery 'of mail in subidivisions on the rural route. Mr. Palagi told council the rural carriers are not able to dismount from vehicle for deliveries. Therefore, rural carriers for the Bunce, Mountlake Terrace, Heights, Turner, Paradise and Alturas Park Subdivisions will not be able to deliver mail unless the boxes are accessible to the driver without dismounting from the vehicle. Mr. Palagi said carrier cars only dismount from car when area is designated city delivery. Mr. Palagi also~ommented it would be a lengthy matter to change the deliveries from rural to city delivery. Councilman Romriell suggested Mr. Palagi pursue the necessary procedure for acquiring city delivery in the ~ew subdivisions and throughout the city of Chubbuck. Mr. Palagi informed council the city would need to submit a request with enough petitions to make the application to postal department effective. Mayor Cotant told Mr. Palagi the city will need to allow the mail boxes immediately behind the curb until such time as a change of some sort can be made. DARRELL LARKIN PROPERTY - CLEAN-UP - Darrell Larkin, 237 Mingo Lane, was present and informed council he has hauled many loads of things from the front of his lot and has purchased a building permit to build storage sheds to house some of his articles. Mr. Dean Renfrow, 226 Mingo Lane, was also present and informed council that Mr. Larkin has cleaned his place up tremendously and that he (Mr. Renfrow) has faith that Mr. Larkin will complete the clean up. Mayor Cotant asked Darrell Larkin how long he felt it would take to accomplish the clean up. Mr. Larkin stated he had spent the past thirty days steady working on the clean up and he did have to get back to work to make a living so he felt it would ta~a year by the time he got the shed built and complete clean-up done. DALE ORTH COMMERCIAL DEVELOPMENT and easement for widening of Evan's Lane. Mr. Orth desires to obtain a building permit to build a drive in restaurant at the northern corner of Evans Lane and Yellowstone. Building inspector Dan Stuart asked Mr. Orth to attend the council meeting and discuss providing twenty foot easement to make possible a forty foot street on Evans Lane. City feels this necessary so that adequate access from Evans can be obtained not only for Mr. Orth's business but for other businesses and homes in area that have provided the present narrow right-of-way. Council suggested Mr. Orth provide a 20 ft. easement for Street and city will participate in grading and graveling of street. 103 D&LE ORTH COMMERCIAL DEVELOPMENT cont'd - Mayor Cotant informed Mr. Orth he would be required to curb along Evans Lane and provide driveway cuts for his business. Mr. Orth said he would see what he could do about the city's request. ~'BANNOCK COUNTY NEWS - Rod Clifford and Dennis Burgendorf were present. Mr. Rod Clifford informed city they would like to build a newspaper that can serve Chubbuck on a weekly basis. Mr. Clifford asked for the mayor and council's individual support in this effort. Mr. Clifford said another copy of their Bannock County News would be sent this week to all residents of the city with a follow up of six month subscription orders at a reduced rate. Mayor Cotant told Mr. Clifford the city support them. WATER ADJUSTMENT REQUEST - Mrs. Ethel Frey, 209 W. Siphon Road, requests an adjustment on her water bill. Letter of request read by Mayor and Council. Councilman Romriell moved the total bill be adjusted to $35.00. Councilman Kinghorn seconded motion with an unanimous vote in favor. Mayor Cotant asked council if water adjustments could not perhaps be handled from office level with approval of councilman over water department. Councilman Romriell stated that this might be all right if Mayor Cotant also approved or reviewed the claim. No further discussion. WATER ADJUSTMENT REQUEST - Mrs. Wallace Bayliss, 150 W. Linden' requested an adjustment on her parents bill, Mr. and Mrs. Roy M. Bayliss, 150½ W. Linden. Mrs. Bayliss informed council they have never had such a large amount of water used. It was noted by city clerk some of the August readings consisted of five weeks usage. Mayor and Council told Mrs. Bayliss the city would review this meter reading a month or so for accuracy. STREET DRAINAGE COMPLAINT - John R. Valenty, 4803 Valenty Road, asked the council to please make the drainage repairs necessary so his basement will not get flooded when surface water floods from rain or thawing. Mr. Valenty requests the city use one of two methods to correct this. 1) Construct a valley across Valenty Road or 2) construct a drainage system for the run-off. Mr. Valenty offered city the use of his cesspool he no longer is using and is located at edge of the streetfor a drywell for this surface drainage. Mayor Cotant and council assured Mr. Valenty the city would take care of this problem and felt that using the cesspool as a dry well should be the method used to eliminate this drainage problem in this area. HAWTHORNE TERRACE SUBDIVISION - Max and Kent Parrish were present and requested approval of their final subdivision plans. The question of the sewer utility plans were discussed as this utility is not shown on the only plans submitted. The sewer line is installed and lies south of the buildings and consists of four inch lateral service lines from the building running into a six inch lateral. Mayor Cotant said he didn't see how the city could accept any responsibility for maintenance of the sewer lines from the development of these lots until such point as it entered the main sewer line on Hawthorne Rd. Max and Kent Parrish agreed to this and informed the city that a private easement for the sewer lines has been recorded. Councilman Romriell asked Max and Kent Parrish to furnish proof of the private easement that has been recorded to the city. Councilman Romriell moved the council accept the final plat with the private easement to be shown on final plat and subject to the engineers approval. Councilman Fullmer seconded motion. All councilmen voted in favor of motion. 105 RETIRED SENIOR VOLUNTEER PROGRAM - Vola Elldredge requested the city pay the RSVP the $1,000.00 budgeted for this purpose. Mayor and Council told Mrs. Elldredge this disbursement can be made and claim will be approved and paid this week. Mrs. Ellderdge also asked the mayor and council to transfer the agreement of the IBM Typewriter provided for use by the RSVP Program to the American Red Cross where she is now employed. Mayor and council told Mrs Elldredge they would consider her request. ' ABANDONED CARS - Marvin Christensen, Christensen's Texaco Station, explained to Mayor and Council he has a problem of holding abandoned and wrecked cars for safe keeping for a period of time. He requested the city allow him to hold these cars for a period of two weeks. Mr. Christensen said he probably would not need space for more than five to ten cars. COuncilman Romriell said if it were a blacktopped area and fenced it probably wouldn't be so bad looking and informed Mr. Christensen if he found an area he would like to use he could request a variance to use the property for this purpose. Mayor Cotant told Mr. Christensen the council would consider his request and investigate the possibilitiesoffazone for such use of property. F. W. KAHLEY AND SON CONSTRUCTION CLAIM - F. W. Kahley has presented a claim in the amount of $49,762.80. Mayor and council tabled the claim until reviewed with Attorney Burnett. PAINTING OF WATER TANK - Councilman Romriell moved to approve the avacodo green color for painting of the new 1.5 MG water tank. Councilman Kinghorn seconded motion with all councilmen voting in favor. INSTITUTE AT McCALL - City Clerk requests permission to attend the City Clerks and Finance Officers Institute at McCall September 23, 24 and 25th. Councilman Romriell moved and Councilman Fullmer seconded motion of approval for clerk to attend the institute. All councilmen voted in favor of motion. INVESTMENT OF FUNDS - City Treasurer disclosed notice to Mayor and Council of contemplated investment of $7,500.00 in Time Certificates of Deposit from the Sewer Bond REserve Fund. FINANCIAL STATEMENT presented to Mayor and Council. CLAIMS PRESENTED TO Mayor and Council. After reviewing claims Councilman Fullmer moved to pay the bills including the RSVP claim of $1,000.00.
