HomeMy WebLinkAbout08 10 1976 CM 87 COUNCIL MEETING MINUTES August lC, 1976 Minutes of the regular council meeting held in the city municipal building August 10, 1976. Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn, Wayne G. Taylor. Attorney Don Burnett and Clerk Vera Armstrong. Councilman Earl L. Romriell excused. Meeting called to order at 8:00 o'clock p.m. by Mayor Cotant. Mayor Cotant asked for corrections or additions to council minutes of July 27 meeting. There being none Councilman Taylor moved and Councilman Fullmer seconded for the minutes of July 27 to be approved as written. JUNK ON MINGO AND ELSEWHERE IN CITY - Dean Renfrow, 226 Mingo Lane, strongly voiced objection to mayor and council for allowing weeds everywhere in the city, specifically on Mingo Lane, Yellowstone Avenue, the Marker property and the lot north of the city office. Mrs. Renfrow also voiced objection to junk stored on Darrell Larkin's lot, 237 Mingo Lane. Mr. and Mrs. Renfrow informed council that Mr. Larkin is not cleaning up his lot, but is still hauling junk in. Mayor Cotant asked Attorney Burnett what the city can do to eliminate these junk and weed situations. Attorney Burnett suggested the city detail anofficer for ordinance enforcement. The officer could work with the attorney on which ordinances have the misdemeanor clause and the officer could do special work on this type of city law enforcement. Mayor Cotant asked Attorney Burnett to notify Mr. Larkin of the deadline of the second meeting in September to have his lot cleaned up and that city will definitely prosecute if lot is not cleaned up. Attorney Burnett said as far as he knew, no citations have been issued on mis- demeanors from weed ordinance or junk car ordinance and he was sure the courts would act fairly upon such citations. Harold Anderson, 225 Mingo, stated he felt there was a lack of law enforcement not only on weeds and junk but on the way cars park and drive in the city when law enforcement officers have seen the offenses. Mr. Anderson also mentioned the danger of parking at Wayne's Foodtown. Mayor Cotant requested the clerk telephone Chief Arnold Stone and ask him to attend the meeting. After Chief Stone arrived, it was again discussed about officers watching violations and not doing anything about them. Chief Stone told mayor and council if someone would give him the name of the officers that did not stop a violator he would be glad to talk to them about it, but he did not believe any of the officers would ignore a violation. Attorney Burnett told Chief Stone he would work with them and suggested Chief .,_ ~ Stone detail an officer for this type of law enforcement.. Attorney Burnett ~j.~-~ also informed residents they could file a citizensLr~wres-t)if officers were 0~"~'~ not available at time of call. ~-~1~,~ ~~_~ Chief Stone voiced appreciation of the Chubbuck residents reporting suspicious ~0~2'' or unusual acts which they see. ~ ~ Mayor Cotant asked Chief Stone to write citations on violators of weed and junk ordinance. NEWS COVERAGE - Dennis Bergendorf, KIFI-TV, informed mayor and council he plans to give the city of Chubbuck new coverage in the future. DIVERSIFIED INVESTMENT GROUP - Theron Pollard and Clyde Barney, members of the Diversified Investment Group attended the meeting in regards to the division of property at 5033 Hawthorne where they have purchased six building permits for four-plax units. Mr. Barney and Mr. Pollard informed council the division of property was made to enable them to secure financing to build the four-plax units. They said they had to separate ownership so that personal financing 89 would guarantee each_individual was personally responsible. Attorney Burnett asked if there was any reason they could not have complied with subdivision law to make these divisions legally. They answered they were not aware of subdivision requirement. Attorney Burnett told Mr. Pollard and Mr. Barney the city needs to work with Bannock County and take whatever steps necessary to bring the situation into compliance. Attorney Burnett also told them the city could put a stop order on construction and also refuse utitity services. Mr. Barney asked how long administrative procedures would take to plat the area. Attorney Burnett said the city could probably waive the preliminary plat requirements which would lessen the time involved. Attorney Burnett informed Mr. Pollard and Mr. Barney they might be able to satisfy the subdivision law but not be able to satisfy the zoning requirements and at time the plat is presented, if they cannot comply with zoning requirements they would need to request a variance. Mayor Cotant told Mr. Barney and Mr.-Pollard the Planning and Zoning Commission will be meeting August 19 and if they would have the plat into the city by August 13 their plans can be reviewed at the August 19 meeting. Mr. Pollard informed mayor and council the Parrishes were out of town or had other committments and could not the meeting. JUNK CARS AT VALENTY PROPERTY ON EAST CHUBBUCK ROAD - Attorney Burnett said he would check with police department on this matter. Chief Stone reported he had talked to Mr. Valenty and Mr Christensen, who is using the property and they have reported the use is temporary. ANIMAL CONTROL - Mayor Cotant reviewed a letter from William Herrington, Pocatello deputy city attorney, informing the city council the city of Pocatello will handle Chubbuck's dogs at the Humane Shelter for $10.00 fee Per dog, regardless of the disposition of the dog. Mayor and council agreed this was a good proposal and discussed amending the city ordinance to increase the impound fee so the cost to the city will not be so high. An impound fee of from $10.00 to $20.00 was discussed. Mayor and council decided to amend ordinance to require a $15.00 impound fee for the first offense of dog being impounded and $20.00 for the second and subsequent offenses. ALTURAS PARK SUBDIVISION WATER LINES - Roger Seaton, developer and Bob Thompson, engineer of Alturas subdivision requested permission to have water hook-ups installed to Lot 3, Block 3 and Lot 1 Block 5 other than from a main line in Ryan Street. Roger Seaton expressed the desire to allow the lots to be served through easements as shown on the final plat. Mayor Cotant said as an alternative the city might want to participate on a six or four inch line to installed in Ryan Street. city After further discussion, Councilman Taylor moved the install a four inch cast iron water line in Ryan Street to east property line of Ryan. Roger Seaton, developer of Alturas will be reimburse or pay the city the cost of 250 ft. of 3/4 inch copper pipe and installation charges for 125 feet of excavation and backfill. City will install and stand additional cost of line, including 1 tee, 1 valve and 1 plug, a circulation line to be installed at dead end of street. Councilman Kinghorn seconded motion with an unanimous vote in favor of motion. ORDINANCE LIMITING ACCESS ON FOUR LANE STREET AND RESOLUTION DECLARING HILINE ROAD A FOUR LANE STREET - Mayor and council discussed the 500 ft. distance between access roads. Council felt the 500 ft. requirement should be kept. 91 Jack Menard, P & Z Chairman, asked city's intention in regards to this ordinance and resolution as they have a request for trailer park development along Hiline Road. Attorney Burnett will inquire of what Pocatello city has done in regards to de- signating Hiline a four lane street. Mayor Cotant said the city should invite the parties concerned with development along Hiline Road to a meeting and discuss this ordinance and resolution with them. CITY ENGINEER - Jerry O'Neal was present and inquired of city's desire in regards to hiring of an engineer. Mr. O'Neal has submitted an application. Mayor Cotant informed Mr. O'Neal the city has some more interviews to make and it will probablYb~eptember before any decisions could be made. WATER CHARGE ADJUSTMENT - Charles Abramson, 5163 Yellowstone has submitted a letter to city asking for an adjustment on water charges. While on a three week vacation someone turned their outside water tap on resulting in a very high water meter reading. Councilman Kinghorn moved to approve a $50.00 credit adjustment on the water charge. Councilman Fullmer seconded motion and all councilmen voted in favor. SEWER SERVICE LINES - Mayor and council discussed the delinquent sewer accounts of the New Colonial Motel, owned by Arthur McOmber and Parrish Furniture, owned or managed by Rodney Parrish. Mayor Cotant asked what legal steps could be taken. Attorney Burnett informed council the city could sue for what the businesses owe for sewer service and also could file injunctive relief to cause service lines to be installed. FINANCIAL CLAIM presented to mayor and council. CLAIMS to be paid during month of August were presented to mayor and council. Councilman Fullmer moved the claims be approved, including the additional claims presented this evening. Councilman Kinghorn seconded motion with all councilmen voting in favor. PUBLIC HEARING ITEM FROM PLANNING AND ZONING. - The rezoning request of John O. Cotant, Jr. was recommended to be denied by the Planning and Zoning Commission at the August 5th meeting. Mr. Cotant informed the council he is withdrawing his request on rezoning. Council will not hold a public hearing on rezoning. BUNCE SUBDIVISION - Mark Bunce, developer of Bunce Subdivision, questioned if his subdivision development has been accepted. He was informed JOrdon Stuart had not signed inspection form as yet. Letter of approval will be sent when in- spection form is signed. BICENTENNIAL CELEBRATION - Councilman Fullmer suggested the city send a letter to those persons that organized the celebration commending them for their dedicated efforts to make this celebration successful. Councilman Fullmer also suggested the retired Planning and Zoning members be given a certificate of appreciation for their services on the P & Z Commission. GENERAL DISCUSSIONS : 1. Traffic, Safety, Parks & Recreation - Attorney Burnett to draw an ordinance to form committee. It was suggested by Mayor Cotant the membership be increased. 2. Flooding of basement at 5164 Yellowstone. Art Anderson, Safeco Insurance adjuster made inspection on Tuesday morning following the mishap. 3. Mobile Manor Law suit - Attorney Burnett said he is awaiting calender on this case. 4. Denny JoneSlawsuit . Attorney Burnett said this case is also awaiting calender. 5, Capital improvement project. Councilman Kinghorn asked how departments were coming with their long range planning. The need of this planning '~ ea$ empbasized~by Jack-Menard, Planning and Zoning Chairman. CERTIFICATE OF APPRECIATION - Mayor and council presented Jack Menard with a certificate of appreciation for his service to the city as past councilman. 93 Councilman Taylor moved and Councilman Fullmer seconded the meeting be adjourned at 11:50 p.m. ~John O.
