Cotant, Jr., Councilmen Dwain A. Kinghorn, Earl L. Romriell. Attorney Don Burnett and Clerk Vera Armstrong. Meeting called to order at 8:10 p.m. For lack of a quorum, meeting was recessed until Wednesday afternoon at 5:00 o' clock p.m. Vera C. Armstrong, John O. Cotant, Jr., Mayor COUNCIL MEETING MINUTES July 14, 1976 Minutes of the recessed council meeting of July 13, 1976 held in the city municipal building July 14, 1976. Present: Mayor John O. Cotant, Jr., Councilmen Dwain A. Kinghorn, Wayne G. Taylor, Earl L. Romriell and Clerk Vera Armstrong. Councilman Boyd L. Fullmer excused. Meeting called to order at 5:10 p.m. Mayor Cotant asked for corrections or additions to council minutes of June 22, 1976. There being none Councilman Kinghorn moved to approve minutes of June 22 as written. Councilman Taylor seconded motion with unanimous council approval. PUBLIC HEARING ITEM: Kim W. Cooper was in attendance representing the East Congregation of the Jehovah's Witnesses. They are requesting an R-2 (Combined Residential) zone on property located on the east side of the proposed Annette Street in the Turner Subdivision to build a church on. The property is presently zoned AT (Agricultural Transitional). Planning and Zoning Commission have recommended the property be rezoned, however, they recommend an agreement on completion of development of street be filed with city. Mr. Cooper requested the city approve rezoning but stated they will not occupy the building until the street is completed. Mayor and Council advised Mr. Cooper a building permit cannot be issued until street is developed. Councilman Romriell moved the council approve the requested rezoning of R-2 (Combined Residential) on the real property more particularly described as A tract of land in the NE¼ NW¼ of Section 11, Township 6 South, Range 34 East of the Boise Meridian, Bannock County, Idaho described as follows: Commencing at the West 1/16 Corner on the North line of said Section 11; Thence N 89059'32' E, along the North line of said Section, 425.00 feet; Thence South, 299.00 feet to the True point of Beginning; Thence continuing South, 197.00 feet; Thence N 89052;32'' E, 161.49 feet; Thence North, 197.00 feet; Thence S89O52'32' W, 161.49 feet to the True Point of Beginning and containing .73 acres more or less. The property is presently zoned Agricultural Transitional. Councilman Taylor seconded motion. Roll call vote: Kinghonn., no; Romriell, yes; Taylor,yes. Councilman Kinghorn said he voted no because no determination has been made on development of street. AUDIT REPORT: Ray Carter, Auditor from the Ken V. Carter & Co., Certified Public Accountant, presented the city audit for fiscal year ending December 31, 1975. Mr. Carter stated it was a very good year for the city. FINANCIAL STATEMENT presented to Mayor and Council. CLAIMS FOR JULY presented to Mayor and Council. ~i~ter reviewing, Councilman Romriell moved to approve payment of claims.
