June 22, 1976
Minutes of the regular council meeting held in the city municipal building June 22,
1976.
Present: Mayor John O. Cotant, Jr., Councilmen Boyd L. Fullmer, Dwain A. Kinghorn
and Wayne G. Taylor, Attorney Don Burnett and Clerk Vera Armstrong.
Meeting called to order at 8:03 p.m.
Mayor Cotant asked for any additions or corrections to minutes of June 8. There
being none, Councilman Fullmer moved the minutes of June 8 be approved as written.
Councilman Taylor seconded motion with all councilmen approving.
CLEAN-UP OF PROPERTY - Darrell Larkin, 237 Mingo was present and recognized the fact
he had received a letter from Attorney Burnett regarding the junk conditions of
his property. Mr. Larkin told the council he intends to start cleaning up his lot
this week and he inquired at city office today in regards to a building permit
for a shed to house some articles.
Mr. Larkin informed council he would like to build a six foot fence around the
rear of his property to protect some of the items he has. He owns several rare
and antique items and informed council he has had some theft.
Mayor Cotant told Mr. Larkin the city appreciated his desire to clean up his lot
and would like him to attend the first meeting in September to review the matter¥
PLANNING AND ZONING COMMISSION Mayor Cotant informed council and those present the
city council needs to appoint three members to the zoning commission, and are considering
amending Ordinance #108 which modifies Ordinance #77 which deals with the form-
ation of the Planning and Zoning Commission. The amendment to increase the member-
ship of the Planning and Zoning Commission to nine members instead of seven.
Mayor Cotant informed council he and Councilman Kinghorn had interviewed several
persons in regards to serving on the P & Z Commission and that he recommends the
following men be appointed. Del Peters to be reappointed for a four year term,
Dee Stalder and Jim Chatterton to replace James Branson and Allen Martin whose
terms have expired and desire not to stay on commission because of conflict of
time of P & Z meeting with other meetings. These terms will expire June 1, 1980.
If and when the amended ordinance is passed and approved two additional members
will be appointed. Mayor Cotant recommended Clifford Payne as one of these
members. Council voiced no objections to the recommended appointments.
BASEBALL PROGRAM - Francis Beck representing the baseball program told council the
baseball invitational tournament would be held 29, 30 and 31st of July.
Mr. Beck requested permission of council to purchase trousers for the all star
team, jerseys were purchased last year.
Besides the usual trophies awarded to teams and boys, Mr. Beck said they would
also like to acknowledge a sponsor or two for their dedication.
Mr. Beck informed council they would make up some teams to play for the Bicentennial
Chubbuck Days celebration scheduled August 7th.
Councilman Fullmer moved the city approve the purchase of a set of 15 trousers
for the all star team. Councilman Kinghorn seconded motion and all councilmen
voted in favor.
Mayor Cotant asked Mr. Beck about parking at the Teton park, if he felt vertical
parking would be more favorable. Mr. Beck said he thought the vertical parking
would be good.
Mr. Beck also asked if restroom facilities could be arranged for at Teton Park,
especially during the tournament. Mayor Cotant told Mr. BEck the city would take
care of this request.

SUBDIVISION HOOK-UP - A developer within the city has questioned the separate
sewer hook-up fee of $200.00 plus $10.00 per lot for his subdivision.
Attorney Burnett stated if a subdivision is platted and recorded separately
he felt it s'hould be subject to the $200.00 sewer hook-up fee and the $10.00
per lot charge as required in ordinance. Mayor and council all agreed to uphold
the ordinance requirement.
BEER LICENCE - Roadrunner Development, Inc. has applied for a beer license for the
Roadrunner Travel Shop. The incorporated owners are James S. Sullivan, Andrew
W. McRoberts, John A. Engleson and George A. Frost. Police department have
recommended granting of license.
Councilman Taylor moved the beer license for the Roadrunner Travel Shop be
approved. Councilman Fullmer seconded motion. All councilmen voted in favor.
ORDINANCE LIMITING VEHICULAR ACCESS to city streets consisting of four or more
lanes, making ordinance applicable to narrower streets designated by published
resolution of city council was read in full by Mayor Cotant.
Mayor and council discussed how the limited access might affect future commercial
development.
Councilman Fullmer questioned adopting the ordinance without further study with
others concerned.
Council discussed the distance access streets should be located. Council decided
that 500 foot whould be distance allowed between access streets.
RESOLUTION WHICH MAKES ORDINANCE LIMITING VEHICULAR ACCESS APPLICABLE TO THE
thoroughfare of Hiline Road was read in full by Mayor Cotant.
Mayor and Council decided to table the limited access ordinance and resolution
until study and comments can be obtained from others concerned.
Attorney Burnett to send copy of ordinance and resolution to Pocatello city and
Bannock County.
WIDENING OF EAST AND WEST CHUBBUCK ROAD - Engineer Forsgren reported to mayor and
council the State Highway Department has requested the city of Chubbuck meet
with homeowners involved in the widening of East and West Chubbuck Road which
· will be widened at the time the Yellowstone Highway project is constructed. A
determination must be made on how much property will need to be acquired from
the north side and how much from the south side.
Councilman Fullmer stated he felt the council should make arrangements for this
public hearing and expedite this decision.
Mayor Cotant said the city should get a determination from the State on the
damages of the corner property before the city can follow thru on their determin-
ation of property necessary to construct the four lanes and turn bays at the
Chubbuck Road and Yellowstone intersection. Engineer Forsgren to contact the
Idaho Division of Highways concerning this problem.
ORDINANCE #168 requiring curb, gutter and sidewalk along arterial thoroughfares, Was read in full by Mayor Cotant.
This ordinance will 'require curb, gutter and sidewalk along Yellowstone Highway
where a proposed project is planned for widening to four lane highway.
A discussion followed as to the wisdom of requiring sidewalks on all arterial
streets.
After a thorough discussion of impact on residential and commercial development,
Councilman Kinghorn moved to dispense with rule of reading ordinance on three
separate days. Councilman Taylor seconded motion. Roll call vote' Fullmer, yes;
Kinghorn, yes; Taylor, yes.

ORDINANCE #168 cont'd - Councilman Taylor moved to adopt Ordinance #168.
Councilman Kinghorn seconded motion. Roll call vote: Fullmer, yes; Kinghorn,
yes; Taylor, yes.
SIDEWALKS - Mayor Cotant emphasized the need for sidewalks on Hawthorne Road from
Stuart canal to the school road and from Scott to Chubbuck Road. Councilman
Kinghorn said there was also a need for sidewalks for children from Country Acres
Subdivision.
It was determined there is approximately 1,000 feet from Stuart Canal to the school
road, with a cost of 3.75 per foot this would be a~total cost of approximately
$4,000.00. Council discussed the expenditure of a portion of the $10,000.00
revenue sharing money budgeted in Highway, Streets & Roads for this project.
Council planned a meeting for Tuesday, June 29th with area residents and all
residents in Stuart Addition to discuss a cooperative agreement for sidewalks
along Hawthorne Road.
GENE GALLOWAY CLAIM - Art Anderson, Adjuster for Safeco Insurance Company reported
to city that Safeco insurance company would not pay the claim on damages of
rescinding building permit for four-plex on West Chubbuck Road. Mayor Cotant
suggested Attorney Burnett contact Mr. Galloway and request he backfill the
excavation where the four-plex was started.
ROAD CUTS Mayor and council discussed procedure in requiring contractors to
repair cuts in streets without a lengthy delay. Attorney Burnett suggested
instructing contractors they will be required to repair cut within 72 hours.
It was also suggested contractors be informed bond will be pulled if street
is not repaired in the alotted time.
GENERAL DISCUSSIONS:
1.Earl Ellis Case - Attorney Burnett reported motion been denied to dismiss
case and will be going to court.
2.Hearing of DEK Enterprises vs City of Chubbuck scheduled for June 28th.
3.Denny Jones Case, gathering information on case.
4.William Sparks meter installed on Burley Drive. It was decided city move
meter serving duplex formerly owned by Mr. McOmber to Burley Drive.
5. McOmber sewer line to serve New Colonial Motel - City to pour bottom in
manhole.
6.Parrish Company Store sewer line - Councilman Kinghorn stated no reason
service line cannot be installed. City might need to give easement.
7. Parks & Recreation Board - Attorney Burnett requested someone to determine
purpose and duties of board prior to him drafting an ordinance providing
the formation of a Parks and Recreation Board. Councilman Fullmer suggested
the Traffic, Safety and Beautification broaden their scope to parks planning
also. Council approved.
8. Dog Control disposing of dogs. City's time extension to take dogs to Animal
Clinic has lapsed. Chief Stone reported city manager Chuck Moss said Bannock
Humane animal shelter will take them but he has not determined a fee as yet.
ORDINANCE #169 - Amending Ordinance 108 which modifies Ordinance #77, restructuring
the formation of Planning and Zoning Commission, increasing membership to 9 members,
etc., read in full by Attorney Burnett.
Councilman Taylor moved to dispense with rule of reading ordinance on three separate
days. Councilman Fullmer seconded motion. Roll call vote: Fullmer, yes; Kinghorn,
yes; Taylor, yes.
Councilman Kinghorn moved to adopt Ordinance #169. Councilman Fullmer seconded
motion. Roll call vote: Fullmer, yes; Kinghorn, yes; Taylor, yes.
